BREWSTER PLANNING BOARD MEETING MINUTES Wednesday, May 10 , 2017 at 6 : 30 pm Brewster Town Office Building Chairman Richard Judd convened the Planning Board meeting at 6 : 35 pm in the Brewster Town Office Building with members : Scott Collum , Charlotte Degen , Madalyn Hillis- Dineen , William Hoag , Kari Hoffmann and Elizabeth Taylor . Also present : Ryan Bennett , Town Planner and Lynn St . Applicant/Owner: Larry and Susan Lepard for property located at 0 Long Pond Road and shown on Assessor' s Map 85 , Lot 111 in the C - H Zoning District , The Applicant is proposing to construct a 5 , 940 square foot commercial building to house a fitness center. Documents . • Draft decision • 04/26/ 17 Plans David A . Clark , P . E . of Clark Engineering LLC and Attorney Bill Riley of Riley and Norcross were present on behalf of the Applicant . Collum and Hoffmann read the draft decision into the record . The Board reviewed and discussed the draft decision . Motion by Hillis -Dineen to Approve Special Permit Application #2017-01 . Second by Taylor. Vote : 6 - 1 -0 . Voting Yay : Collum , Degen , Hillis -Dineen , Hoag , Hoffmann and Judd . Voting Nay : Taylor. Motion by Hoag to Approve Site Plan Review Application #2017-01 . Approval of Meetina Minutes The Board reviewed the April 26 , 2017 meeting minutes . Motion by Hoffmann to Approve April 26 , 2017 Meeting Minutes . Second by Degen . Vote : 7 =0 -0 , Liaison Reports Hoffmann reported on upcoming workshops being held by the Vision Advisory Group , PB Minutes 05/10/2017 Page 1 of 4 Members of the Board thanked Bill Hoag for 5 years of service to the Town as a Planning Board member. The Board discussed their meeting schedule and decided to hold a work session to discuss zoning bylaw amendments at the May 24th meeting . Motion by Hillis -Dineen to Recess to 7 : 05 pm . Second by Taylor. Vote : 7-0 -0 . Motion by Collum to Re -open Meeting . Second by Hillis - Dineen . Vote : 7=0 -0 . Meeting reopened at 7 : 08 pm . 7 : 08 PM JOINT PUBLIC HEARING WITH TREE WARDEN Application #2017 -07 : On behalf of Eversource Energy , Kyle Barry will be discussing the 2017 Eversource Energy Vegetation Management Plan . In compliance with Chapter 87 Section 14 of the Massachusetts General Law , the Planning Board and Tree Warden will hear the proposal for selective tree pruning on electric circuits 4- 8913 -945 and 4-8913-576 . These circuits include the following designated Scenic Roads : Route 6A , Lower Road , Breakwater Road and Millstone Road . Documents . • 03/27/ 17 Letter from Kyle Barry , Eversorce Arborist with Circuit Maps and Eversource Specification for Local Distribution Line Clearance Tree Work and Brush Control • 05/02/ 17 Department Review Comments Kyle Barry of Eversource Energy and James Jones of the Brewster Department of Public Works on behalf of the Tree Warden were present . Barry presented the 2017 Vegetation Management Plan to the Board . Taylor asked about work on private roads and Barry explained that Eversource has electrical transmission easements that allow for the work to be done on private roads . Taylor asked if trees removed would be replaced . Barry responded that Eversource does not have a 1 to 1 replacement policy but they would work with the Tree Warden to replace some of the removed trees . Hoffmann asked how many trees were totally removed the previous year . Barry responded that approximately 100 trees were removed earlier in the year. He explained that Eversource works with the Tree Warden on removal and replacement of trees . Hoffmann also suggested replacement of some of the removed trees . Taylor referenced trees that needed removal and replacement on Route 6A . Collum stated that it was the Tree Warden ' s job to remove and replace trees to beautify Brewster. Collum noted that Eversource ' s pruning standards have changed in the last few years to allow for more clearance . Barry noted the tree pruning specifications have been in place for 6 years . Bennett suggested Eversource provide an inventory of trees removed to the Tree Warden . Collum suggested the Board could make recommendations to the Tree Warden regarding replacement plantings and Bennett suggested a condition of the permit be that Eversource present a replanting plan . Hoag noted that replanting may be tough on Route 6A because there are telephone poles on both sides and a number of private property owners . Hoffmann read Department Review Comments into the record . The hearing was opened for public comment . There was no comment from the public . PB Minutes 05/10/2017 Page 2 of 4 Degen suggested a condition that Eversource work with the Tree Warden to provide a reasonable expectation for replanting of certain areas to be determined . Bennett suggested adding a time frame to the condition . Hoffmann suggested requiring a spring planting plan on an annual basis . The Board discussed requiring Eversource to provide a replanting plan within one year of approval . Hillis - Dineen asked for clarification on the use of herbicides and Barry confirmed that herbicides would not be used . Motion by Collum to Close Public Hearing on Application #2017 -07 . Second by Taylor. Vote : 8 =0 =0 ( including vote of Tree Warden ) . Motion by Degen to Approve ADMication #2017 =07 with Condition that within one year of approval , Eversource will provide a planting plan that has been developed with the Brewster Tree Warden . Second by Hoffmann . Vote : 8 =0 =0 ( including vote of Tree Warden ) 7 : 50 PM MODIFICATION OF SPECIAL PERMIT CONTINUED Application #2016 -14 : ( Continued from April 26 , 2017) Applicant/Owner: Cape Cod Bible Alliance Church . Representative : John Bologna , Coastal Engineering Company , Inc . , for property located at 3580/3634 Main Street and shown on Assessor' s Map 126 , Lot 87 , 88 and 89 in the R- M Zoning District , The Applicant is proposing to modify previously approved Special Permit #2014- 03 issued in accordance with Brewster Zoning Bylaw § 179-51 and § 179-66 . Documents : Draft decision • 03/ 12/ 14 Landscape Plan • 10/04/ 16 Landscape Plan • 04/26/ 17 Plan Showing Existing Conditions • 05/09/ 17 Letter from Daniel Guertin • 05/ 10/ 17 Letter from John Bologna John Bologna of Coastal Engineering and Peter Dew, landscaper were present on behalf of the Applicant . Degen and Taylor read the draft decision into the record . Bologna reviewed revisions to the landscaping plan . Hillis - Dineen asked for clarification on conditions and enforcement . Bennett responded that enforcement of the permit would be through the Building Commissioner. Judd referenced a letter received from the abutter, Dan Guertin , and concerns about overflow parking . Bologna stated that there are 40 trees planted as buffer between the church and abutter and the Applicant would prefer not to plant additional trees in the overflow parking area . Taylor inquired about the landscaped island that appeared to be removed from the current plan . Daniel Guertin , an abutter, addressed the Board . He stated concerns regarding drainage issues . The Applicant noted that there has been no erosion issues on site and that the drainage system appears to be working properly . Guertin also raised concerns about the overflow parking area . Bologna stated that the overflow parking area is not paved and is a multi - use space . He noted that safety cones are in place to direct people to parking spaces . Bologna stated that if there is a large event , an usher/attendant is present to direct traffic. Hoffmann asked about maintenance of the overflow parking area . Bologna noted that the area is irrigated and at the end of the season grass seed is put down . PB Minutes 05/10/2017 Page 3 of 4 Hoffmann asked about erosion on the area in front of the church and how to prevent overflow onto Route 6A . Peter Dew reviewed the landscaping plan for the front of the church . Bennett suggested a condition of the permit be that the vegetative bank be maintained to prevent erosion . Hoffmann raised concern about idling vehicles . Bennett stated that the Board had no direct jurisdiction over idling vehicles . Bologna stated he did not believe idling vehicles would be an issue . Motion by Collum to Close the Public Hearing on Modification of Special Permit Application #2016 -14 . Second by Hillis -Dineen . Vote : 7 -0-0 . The Board discussed additional findings and conditions . Bennett suggested a condition that the cedar fence be installed before the Certificate of Occupancy is issued . Motion by Collum to Approve Modification of Special Permit Application #2016 =14 with Amended Conditions . Second by Hillis- Dineen . Vote : 7 -0 -0 . CONTINUED Application #2016 -25 : ( Continued from April 12 , 2017 ) Applicant/Owner: Diane M . Romme . Representative : John M . O ' Reilly of J . M . O ' Reilly & Associates , Inc . for property located at 100 Proprietors Cartway and shown on Assessor' s Map 64 , Lot 36 in the R- R Zoning District . The Applicant is requesting modification of Special Permit #2007-22 granted in accordance with 179-26 . D of the Zoning Bylaw , known as the " Dirt Road Bylaw" .
