P,3 -.9 4 RESOLUTION TO VACATE UNUSED PORTIONS OF CHEROKEE ROAD WHEREAS, the City of Medina has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the S. J. Groves and Sons Company has requested and been granted approval of the City of Medina of the final plat of Meadowwoods Farm Subdivision, such approval granted in Resolution 80-34; and WHEREAS, Cherokee Road was a cul-de-sac prior to develop- ment of Meadowwoods Farm Subdivision and has been constructed into a through street according to the final plat of Meadowwoods Farm Subdivision; and WHEREAS, all of the owners of land affected by the pro- posed vacation have requested that the unused portion of the Cherokee Road cul-de-sac be vacated and combined with the adjoining property; and WHEREAS, published and posted notice of the proposed street vacation was given 14 days or more prior to the hearing; and WHEREAS, it appears in the interest of the public to so vacate the unused portion of the Cherokee Road cul-de-sac. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: 1. The unused portion of the Cherokee Road cul-de-sac legally described as follows: That part of Cherokee Road as dedicated in the plat of Maplewood Trail, according to the recorded plat thereof, Hennepin County, Minne- sota, lying northerly of a line 60 feet north of, measured at right angles to and parallel with the south right-of-way line of said Cherokee Road, and its easterly extension, is hereby vacated, conditioned on the following. 2. The portion of the vacated property described in paragraph 1, legally described as follows: That part of vacated Cherokee Road as origi- nally dedicated in the plat of Maplewood Trail, according to the recorded plat thereof, Hennepin County, Minnesota, lying easterly of the southerly extension of the west line of Lot 6, Block 1, Meadowwoods Farm, according to the recorded plat thereof, Hennepin County, Minnesota, and a line 60 feet north of, mea- sured at right angles to and parallel with the south right-of-way line of said Cherokee Road, and its easterly extension, shall be combined with Lot 6, Block 1, Meadowwoods Farm, at the expense of the owner of the said Lot 6, Block 1, Meadowwoods Farm. 3. The portion of the vacated property described in paragraph 1, legally described as follows: That part of vacated Cherokee Road as originally dedicated in the plat of Maplewood Trail, according to the recorded plat thereof, Hennepin County, Minnesota, lying westerly of the southerly exten- sion of the east line of said Lot 3, Block 1, said Maplewood Trail, and lying northerly of a line 60 feet north of, measured at right angles to and parallel with the south right-of-way line of said Cherokee Road, and its easterly extension, shall be combined with Lot 3, Block 1, Maplewood Trail, at the expense of the owner of the said Lot 3, Block 1, Maplewood Trail.
