A RESOLUTION OF THE CITY COUNCIL OF THE CITY
~~ OF LYNWOOD, APPROVING APPEAL NO. 2001-06,
THEREBY OVERTURNING THE PLANNING
COMMISSION DECISION TO APPROVE CONDITIONAL
USE PERMIT NO. 2001-07, DENYING THE
CONVERSION OF A SINGLE FAMILY RESIDENTIAL
DWELLING INTO A DUPLEX (2 UNITS) AT 11445
PLUM STREET, IN THE R-2 (TWO FAMILY
RESIDENTIAL) .ZONE, LYNWOOD, CALIFORNIA.
WHEREAS, the Lynwood City Council did pursuant to law, on October 2,. 2001,
conduct a public hearing on Appeal No. 2001-06, an application to overturn the decision
of the Planning Commission approval of Conditional Use Permit No. 2001-07; and
WHEREAS,. the Planning Commission of the City of Lynwood did pursuant to law,
conduct a public hearing and approve Conditional Use Permit No. 2001-07 on August
14, 2001; and
WHEREAS, the City Council considered all pertinent public oral and written
testimony offered at the public hearing; and -
WHEREAS, the Community Development Department has determined that the
proposal is categorically exempt from the provisions of the,California Environmental
Quality Act (CEQA) Guidelines pursuant to Section 15303(b);
Section 1. The City Council hereby finds and determines as follows:
A. The location of the subject property and the conditions under which two
(2) residential dwelling units would be operated and maintained may be
detrimental to the public health, safety, or welfare, or materially injurious
to properties or improvements in the vicinity.
B. The subject property is insufficient in size and shape to accommodate two
(2) residential dwelling units.
C. Parking facilities on-site are inadequate to address parking and traffic
circulation for a duplex.
D. Redwood Avenue and Plum Street are too narrow to accommodate
additional traffic and parking for a duplex.
E. Redwood Avenue dead ends adjacent to the rear of a manufacturing
property. The end of the street does not cul-de-sac or provide adequate
turnaround.
F. The property owner has a history of violations of the Lynwood Municipal
Code and Uniform Building Code.
Section 2. The City Council of the City of Lynwood, based upon the
aforementioned findings and determinations, hereby approves Appeal No. 2001-
06 and overturns the Planning Commission decision to approve Conditional Use
Permit No. 2001-07, thereby denying aduplex. -

Section 3. The City Clerk is hereby directed to certify to the passage and
adoption of this Resolution and to cause it to be published or posted as required by law.
Section 4. A copy of this Resolution and its conditions shall be delivered to the
applicants.
