HomeMy Public PortalAbout1983-027Member �V'o �b�/ introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. S.3- 2 7 RESOLUTION TO GRANT APPROVAL OF CONSTRUCTION OF A PRIVATE ROAD WHEREAS, the City of Medina has adopted a Zoning Ordinance for the orderly, economic and safe development of land within the City; and WHEREAS, the Zoning Ordinance requires that all private roadways be approved by the Medina City Council; and WHEREAS, Thomas and Stephanie Ditter have requested approval of the Medina City Council for construction of a private roadway and have obtained fully executed easements that provide access to their lot; and WHEREAS, it would be in the public interest to approve such construction to enable Thomas and Stephanie Ditter to improve their lot. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the application of Thomas and Stephanie Ditter to construct a private road to provide access to their lot from a public road, said lot being legally described as: That part of the East half of the Northeast quar- ter of Section 24, Township 118 North, Range 23 West of the 5th Principal Meridian, described as follows: Beginning at a point in the East line of said Northeast quarter distant 1171.1 feet North of the Southeast corner of said Northeast quarter; thence on an assumed bearing of North along said East line a distance of 865 feet; thence South 45° 30' West a distance of 457.38 feet; thence South 35° 30' West to an intersection with a line drawn on a bearing of West from the point of beginning; thence on a bearing of East to the point of begin- ning, and said easement being legally described as set forth in Exhibit B of the attached Declaration of Covenants, Conditions, Restric- tions and Maintenance Agreement for a Private Road, is hereby granted upon the following conditions: 1. That the owners of all property abutting the easement execute the attached Declaration of Covenants, Conditions, Restrictions and Maintenance Agreement For A Private Road and agree to be bound by its provisions. 2.
