MINUTES OF THE MEETING OF
FEBRUARY 1 # 1983
The Brewster Planning Board met on February 11 1983 at 7 : 30 PM in Town Hall with
members Wise $ Eldredget Reedy Montgomery and Anderson present . After Chairman
Eldredge opened the meeting Realtor G . Howard Hayes introduced Mrs Charles Mitchell
and Mrs . Ann Waters , owners of a 31 . 8 -acre - tract- of - land- off - the a / s - of Mitchell Lane .
Mr . Hayes displayed a conceptual sketch of the property and explained that it had
been modified somewhat from the original plan shown at an earlier meetings The sketch
delineated five lots , four of which are an acre and a half in size and one contains
three acres : with the remainder of the tract dedicated to conservation . He said the
existing cottages will remain while the lots are offered for sale with a stipulation
that they must be removed later . He continued that currently the subdivision is
neither a grid or a cluster although it is closer to the cluster concept . When Mrs
Anderson inquired about road construction Mr . Eldredge said that pavement does not
pertain to zoning but to subdivision rules and regulations and that it may be waived .
Mrs Hayes related that in a previous discussion members agreed that the pavement
could be waived with the condition that there 'be five lots of two acres each
with the remainder in conservation . He said that a cul -de - sac with minimum footage
would be created at the end of a common driveways Mrs Anderson asked if a 401 way
would be laid out on paper and Mr . Hayes said that it would be so designated on the
plan . He added that the cottages are serviced with electricity and telephones . � Mr .
Reed felt that since there is already a layout that the cul-de - sac could be laid
out in any perimeter .
When Mr . Hayes asked if open space must be contiguous Mr . Eldredge replied in the
affirmative . Mr . Hayes then asked if a five foot wide open space would be sufficient
to keep it contiguous due to the sharp incline to the marsh . Mrs Reed said that
no precedent has been established for buffer width with Mrs Eldredge concurring that
the By-Law does not give a specific width . He said the purpose of the buffer was to
allow residents to walk around the perimeter of the property and felt that an area
wide enough for a foot path was perfect . Mr . Montgomery said he didn ' t want the
plan to establish a five foot wide buffer area . Mr . Reed felt tha plan was a bene -
ficial one for the Town since so much land will be conserved . Mr . Hayes felt that
a conservation trust may be established as the owners have not definitely decided
deed the area to the Towns Mrs Hayes said the cottages are 241 apart but when new
houses are built on the lots cluster setbacks will be established by deed restrictions .
Concern was expressed by members that the public using the conservation tract may useing
the footpath in the area of the cottages Mr . Hayes felt this could be taken care of
In one section of the ownership and that the buffer would be larger in the other area .

Mr . Montgomery read the minutes of the January 18p 1983 meeting and since there were
no errors , omissions or amendments noted Mr . Reed moved and Miss Wise seconded that
they be accepted as read . Mr . Reed read an opinion received from Town Counsel
Lawrence O . Spauldingt Jr . regarding the special permit lapse of the State Street
Development Company subsidized housing for the elderly concept . Since the attorney
didn1t address how to extend the permit time if the Board voted to do so the sec-
retary was requested to write another letter asking him to recommend procedure . Mr .
Spaulding also stated that he assumed that State Street had been graded funding
from the Federal Government but that it had not been allocated as yet . Miss Alm
was aksed to inquire about this assumption since neither the project managers Dennis
Maloney or Attorney Richard Anderson had given this indication . The Board also
wished to know a reasonable time period for extension .
Members briefly discussed various policies for further subdivision approval off
Run Hill Road . Suggestions were for upgrading the roadway in front of the lots
to current standards9 refusing large subdivisions due to inferior access and
limiting the number of lots to be created off the roadway.
Mr . Reed said that he had talked with Water Department Superintendent Robert
Zontini and it was agreed that standard easements for water easements cml& bekused
as this was the practice of other towns and that he would prepare a draft and
ask for Town Counselts approval on- it .
Messrs . Reed and ' Eldredge told other members of. their meeting with Planning Con-
sultant Philip Herr and his recommendation of a different approach for a slow-down
of growth for the Town . It was felt that the extension of the moratorium on PUDs
and multifamily housing and the use of Mr . Hems recommendations would be addressed
as zoning by- law amendments for submittal to the Town Meeting Warrant and that the
Board should take a longer period of time to review and study the findings of the
Citizens Study Committee for Planed Unit Developments .
