HomeMy Public PortalAboutPlanning Board -- 1982-12-07 Minutes �REwsr Town of Brewster O�( t 1,1. oc R e� �`� 1 PLANNING BOARD i O ' to Brewster , Massachusetts 02631 R`s '' BREWSTER PLANNING BOARD MINUTES OF THE MEETING OF DECEMBER 70 1982 The Brewster Planning Board met on December 7 , 1982 at 7 : 30 PM in Town Hall with members Eldredgep Montgomeryq Wilkinson ,, Anderson and Reed present , Chairman Eldredge 1 opened the meeting by asking Clerk Montgomery to read the minutes of the November 16th meeting . Since there were no errorsp deletions or amendments noted Mr . Anderson moved and Mr . Wilkinson seconded that they be accepted as read and it was a vote . Mrs . Catherine Hart presented an Approval Not Required Plan of her property on Captain Dunbar Road off the w/ s of Ellis Landing . She advised that the adjacent lot had recently been sold and the new owners wish to buy Parcel B on the plan containing 815 square 2 feet , for parking purposes as the lot is very small . Mr . Eldredge pointed out that Note 3 on the plan denotes that "Parcel B . to be conveyed ,, is not to be used as a sep- arate building lot " . Mr . Wilkinson Iabstained from discussion and Mr . Reed moved and Mr . Anderson seconded that the plan be endorsed and it was a vote with the plan signed . Mr . Robert Eddy arrived for a discussion of a 19 acre tract on East Gate Roadq an an - cient way off the w/s of Great Fields Road . He exhibited a map of the property in the 3 Tucker ' s Pond area : and advised that a friend wants -to -buy the tract and has offered to half of it to the Eddys as a gift . Since the topography is very irregular it could accomodate two farms with a house . .on . -each . parcels, _ The . .property line is _at the last . tI' phone pole on East Gate Road on which there are two houses . Mr . Wilkinson felt that Mr . Eddy should consult the Inspector of Building before proceeding further . Mr . Eldredge explained the Fire Chief o s requirements for access over dirt roads by emer- gency vehicles and advised that a plan must be presented showing the division and de - fining a road 24+ 1 wide , also that there could be no further subdivision of the tract without the road being brought up -to current standards . Members agreed it was a good use- - of the_ - land* Engineer David Mead presented an Approval Not Required Plan of property of George Cahoont Jr . on the n/ s of Route #39 delineating a six lot division of the tract for 4 which a Land Court decree has just come down . He pointed out a vehicle track near the western perimeter on Lot #6 which is on a 509 wide strip which the owner provided to serve as a way in the event two large parcels in the rear may be developed in the future . The strip has the proper radial rounding for an access . Mr . Wilkinson moved and Mr . Anderson seconded that the -six lot Approval Not Required Plan of George Cahoong Jr . be approved and it was a vote and the plan signed . He also made a request for a Partial Release of Covenant for Lot #7 within the John Rogers , Jr . Trust subdivisions Fieldstone Farm , off the e / s of Great Feilds Road . He 5 - advised that the , lot has frontage on Great Fields Road and the subdivision is complete except for two lengths of frainage pipe to the pond . Mr . Wilkinson moved and Mr . Mongtomery seconded that the request for a Partial Release of Covenant for Lot #7 in the John Rogers , Jr . Trust Subdivision be approved and it was a vote and the document . signed and notarized . i BREWSTER PLANNING BOARD MINUTES OF THE MEETING OF DECEMBER 7 , 1982 - Continued Page 2 6 Board members aigned the three lot definitive subdivision plan of Land Courted property of Morena Ellis off Pond View Drive , West Brewster which was voted approved at the Nov - ember 3rd meeting . Realtor Herbert Montgomery appeared for a Preliminary Plan Hearing for property of 7 Cayetano G . Arriolap Jr who is creating a definitive subdivision of his Land Courted tract on the n/s of Tubman Road . Mr . Montgomery advised when exhibiting the plan that at the final hearing two plans will be presented as one tract is already a subdivision which is being modified to provide larger lots of the Land Courted property and another plan will include the adjacent unregistered tract with a total number of six lots . The Board found no objections to the plan . Realtor G . Howard Hayes asked the preference of the Board as to the type of subdivision 8 of the Mitchell property on the e / s of Mitchell Lane , the subject of an earlier dis - cussion . It was felt that if the number of lots and houses remains unchanged the Board has no preference . 9 He asked the Board to briefly review the discussion with Mr . Robert Eddy as his firm 9 is marketing the property . Members of the Management Study Committee failed to appear for a discussion of Planninng Board procedures . A letter from Town Counsel Lawrence O . Spaulding , Jr . was read in which he advised Selectman Lawrence Doyle that the buildings relocated from - Camp Monomoy to Camp Wono 12 may be used by resident campers and day campers under the provisions of Section II of the Brewster Zoning By-Law as the buildings would be continued to be used as recreational camps for children . Board members agreed it was a clearly defined opinion . Mr . Eldredge also read a letter from Mrs . Lillian Callahan requesting a two month ex- 13 tension of covenant time to complete the Callahan/Dickey subdivision off Crowell ' s Bog Roadl the status of which was discussed at the last meeting . Mr . Wilkinson moved and Mr . Anderson seconded that a two months extension of covenant time until February 16 1983 be granted for the Callahan/Dickey subdivision and- -it was - so -voted-: - - Mr . Eldredge read an inspection report from Engineer Dennis Hanson regarding road maintenance within the Lee Way subdivision of Leona Leary . Mr . Hanson advised that 14 the roadway has been properly maintained for the required two year period and sugg - ested a release of the bond . Mr . Montgomery moved and Mr . . Anderson seconded that the two year road maintenance bond for the Leona Leary subdivision be released with the assignment to The Town removed and • it was a vote . Mr . Eldredge read a letter from Dennis Maloneyo Director of Development for the State 15 Street Development Company asking for an extension of the Special Permit Decision for the Kings Landing II subsidized housing for the Elderly concept proposed for State Street . The secretary advised that the Decision expired on November 14th and she and Mr . Maloney had several telephone calls and communications about the expiration . Mr . Maloney asked for an extension of six months as his firm believes the MHFA will re - ceive some fisdal 1982 allocations in the next few months which could be assigned to this project . He also read excerpts from the Land Use Manager published by the Dep ' t. of Community Affairs which quoted that "if a substantial use authorized by4the BREWSTER PLANNING BOARD MINUTES OF THE MEETING OF DECEMBER 7t 1982 - Continued Page 3 special permit is not commenced within such time period or the construction authorized by the special permit is not begun within such time period except in either case for good cause a special permit will lapse " . "If a special permit lapsest another special permit can be granted only after notice is given , a hearing is held rand theistatutorl• 16 findings are made by the !' special permit granting authority " . It was felt that lack of federal and state funding receipt was not good cause and the secretary was asked to so inform Fir . Maloney and include a copy of the Land Use Manager with the letter . Mr . Walter Strattont a member of the Citizen ' s Study Committees asked to discuss Parking and Loading Lot Standards of the By-Law . He suggested that , insteal of the require - 17 ment for the total area be paved that only the lanes be paved . and asked if this would create problems . M r . Eldredge felt that no surface lasts as long as pavement and that gravel requires constant maintenance . He felt that when the By;Law was adopted there were no policing powers and not as much interest in ecology . Mr . Reed felt that there could be drainage problems and snow plowing of gravelled surfaces creates problems . It was agreed that a parking area could be broken up into spaces for ten with buffer divisions . A sub - committee to work on drafting amendments to the By-Law was not appointed and 18 there was no disuccsion of the Moratorium due to 14rs . Gagers absence . Adjournment was at 8 : 45 PIS: .
