BREWSTER PLANNING BOARD
MINUTES OF THE MEETING OF
NOVEMBER 169 1982
The Brewster Planning Board met on November 16 , 1982 at 7 : 30 PM in Town Hall with
1 Miss Wise , Mrs . Gage and Messrs . Eldredget Wilkinsong Montgomeryp Anderson and Reed
present .
Town Engineer Dennis Hanson appeared at the request of the - Board - of - Selectmeng acting
as Chairmen of the Department of Public Works . Mr . Eldredge read a letter from that
2 Board asking for a recommendation from the Planning Board for a road taking bfr the
Town of Woodstock Drivel Highridge Road , Ridge Court and Pleasant Court within the
Pleasant Bay Heights subdivision off the w/s of Tar Kiln Road . Mr . Hanson reviewed
the history of the development and advised it is mandatory for the Planning Board
to make a wiitten assessment within .forty-five days of receiving such a request which
will be filed with the Town Clerk by the Selectmen . He added that a hearing has been
set down for January 18 , 1983 and that he felt that the Heritage Development Corp .
did a good job in constructing the subdivision in compliance with the Subdivision
Rules and Regulations . Mr . Eldredge said he did not want to present the Article at
Town Meeting as the Town has so many problems with its own roads . Mr . Hanson said
that a resident of Pleasant �.42cty Heights is the spokesman for the group seeking the
taking . and he will make the presentation of the .Article . He added that the Planning
Board is ,just a stepping stone in the process and that somev but not all of the
petitioners are registered voters . The ownership of and the fee in the roads were
conveyed with the lots . He felt that the Finance Committee will advise against the
taking . Mr . Reed commented that when a developer complies with the curr!pnt _ Eoard
rules and regulations for road constructonn the Town should take them - Mr . Wilkinson
moved and Miss Wise seconded that the Planning Board recommend tha 'tang by the
Town of the roads within the cluster subdivision Pleasant Bay Heights ana it was so
voted .
Mr . Eldredge read a letter from Town Engineer * Dennis Hanson recommending that an item
be included in the Planning Board Fiscal 1984 Budget for the updating of the Town Map .
Mr . Eldredge observed that so much time and expense was involved in starting it that
3 it is not fair for it to fall into disrepairo Mr . Reed suggested that roadways should
be left of it if they have not be accepted by the Board . Wehn Engineer Albion Hart
was consulted about an estimated costa figure of $ 500o including printing was enough .
When Mr . Hanson suggested that the Zoning Map be updated simultaneously it was agreed
that this was a good idea . It was voted that the sum of $ 800 . be set down in the
1984 Fiscal Year Budget for updating of the Town and Zoning Maps .
Mr . Hart entered into a discussion of a large lot to the left of SeaView II in the
Tonne Inc . subdivision off the n/ s of Route #6A . He exhibited a discussion plan of
4 the tract which Tonn hoped to sell as an estate but was unsuccessful . The developer
would like to create four large lots off Upland Circle . A cul -de - sac would service
three regular lots and a panhandle one . He advised that the tract includes consid -
erable upland , salt marsh and an old bog . The unlabelled lot on the plan would re -
main as open space for Sea View I and II . Mr . Anderson questioned if Town water is

available and Mr . Hart assured him of it . At this point Mr . Wilkinson abstained from
the discussion . A rough preliminary road profile with an average grade of one percent
5 was exhibited and Mr . Hart advised that all drainage from the Sea View developments has
gone into the natural wetland areas which has worked well and Mr . Hanson was in agree -
ment . . as there has been no damage to marshes or bogs . He concluded by saying the plans
would be ready for a January hearing .
He also gave a progress report on the Callahan/Dickey subdivision off Crowellfs Bog Road .
All major work is completed with loaming and seeding done on _Crowells Bog Road but water
6 was not installed due to the exhorbitant cost of 800f of 120 pipe outside of the sub-
division as required by the Water Department . Mr . Hanson has given him particulars about
street name signs and the setting of bounds and the as -built plan are yet to be done .
Since the -covenant expires on December 16th he requested a two months extension of cov-
enant time to complete the subdivision . He felt the developers would provide a bank
passbook for suretyv if the Board so desired . Mr . Eldredge indicated that if a written
request for a covenant extension for two months is made the Board would look favorably
on it :
At 8PM a legal hearing was held for two definitive subdivision plans of property of
Morris M. Kazanjianv Jr . on the w/ s of Skipjack Way . Mr . Eldredge read THE CAPE CODDER
7 legal advertisement of it and Mr . Hart made the presentation . He advised that since Skip-
jack Way is incomplete and Mr . Kazanjian purchased the abutting rear tract of the Fales
property two plans are necessary to incorporate the Land Courted portion of the Baywoods
subdivision with the unregistered addition to it . He explained the engineering tech -
nicalities and the Land Court involvement which should be settled Lp early Spring . He
displayed one plan delineating the Land Court registration line and three small parcels
which are to be incorporated into the three new lots of unregistered land . The second
plan delineated these lots as A # B and C all containing over 40 , 000 square feet with at
least 1351 frontage on Skipjack Way . Mr . John Lathamq an abuttor , asked how the line
was obtained on the southerly border as one of his bounds was knocked out . Mr . Hart
replied that a traverse line was usedl rather than the property -line , for the configur
ationsl and .. that the bound , unsettled by a contractor following a rough road layout ,
impinging on the Latham tracts would be re-established and the portion of the tract
damaged< would be reloamed and seeded , He added that water and utilities would also be
installed along Mr . Latham ' s property line . Mr . , Anderson moved and Mr . Wilkinson seconded
that the two definitive subdivision plans of property of Morris Kazanjian off Skip-
jack Way be approved pending no appeal and it was a vote .
Mr . Hart also asked to discuss the status of the John and Marjorie Crane cluster sub -
division off the e /s . of Leland Road . Mr . Eldredge read an inspection report of August
8 49 1981 from Town Engineer Dennis Hanson stating that 1500 of shoulder had eroded and
required reloaming and seeding and that a street name sign is necessary . He felt that
this would represent $ 150 over the amount of the two year maintenance bond of $ 750 . Mr .
Hart apologized for his negligence in not completing the requirements sooner and ad -
vised that the erosion has been repaired and the street sign ready to be installed .
It was agreed that he would return to the Board after its installation and• a conference
with Mr . .Hanson about the maintenance bond figure and fulfillment of any other require -
ments .

Surveyor James Moore presented an Approval Not Required Plan of property of Dorothy
Darbyshire off the e / s of Slough Road abutting Elbow Pond . He advised that the orig -
inal plan was approved in 1977 and subsequently lost and its purpose is to convey a
small triangular portion of the tract to an abuttor to become part. of the adjacent
property . Mr . Reed moved and Mr . Montgomery seconded that the Approval Not Required
9 Plan of Dorothy Darbyshire ' s property be approved and endorsed and it was a vote and
the plan signed .
Attorney Edward Veara gave a progress report of the David Miller subdivision "South-
hill " off the s / s of Route #137 . He advised that Phase I of the cluster subdivision is
10 complete with the exception of street name sign installation . Chairman Eldredge read
an inspection report from Dennis Hanson in which he stated that 4371 of Mount Pleasant
Road , the main access , and Hemlock Hollow Road , the first cul -de - sac , are completed and
the two year road maintenance bond is set down as $ 830 . Mr . Veara presented a Partial
Release of Covenant for lots 1 through 8 and a Cape Cod Five Cents Savings Bank passbook
in the amount of $ 830 . which he asked the Board to hold until the Assignment forms to
the Town are received from Mr . Miller and the street name signs are installed . Engineer
Peter Soule exhibited a road profile plan which also included Phase II . When Mr .
Eldredge asked for a time schedule Mr '. Veara said that he appeared for Attorney .lay
Murphy who would send a letter concerning it . Mr . Wilkinson moved and Miss Wise seconded
the endorsement of a Partial Release of Covenant for Lots l: through 8 in the David
Miller cluster subdivision and it was a vote and the document signed . It was agreed
that it would be held by the secretary until the bankbook assignments forms are re -
ceived .
Mr . Eldredge asked Mr . Veara about a recent invoice for services for the Mullin vs the
Planning Board suit . He explained that the Bay Colony Property Company had filed a
11 motion for a bond which they didnft get , The case now is before the Appeals Court and
there is no need to go forward by the Board and the bill is a final one .
Clerk Montgomery read the minutes of the November 3v 1982 meeting and since there were
no errors , omissions or deletions noted Miss Wise moved and Mr . Reed seconded that they
12 be accepted as read . It was so voted .
In a discussion of Kings Landing II Housing for the Elderly concept the secretary re -
lated that Project Manager Dennis Maloney had not responded to her request for future
13 plans of State Street Development Company for the project . Mr . Eldredge asked her to
telephone or write to him and request that he get his act together .
Members reviewed a printing bill from Zip Printing Center Inc . which was paid by Mr .
14 Delbert Francis , Chairman of the Growth Study Committee . It was for $ 76 . 82 and it was
brought out that the Board had voted to pay $ 50 of the printing costs of the questionaire
sent out by the committee . Mrs . Gage felt the Board should reimbure Mr . Francis for the
whole amount as he has done a good job in chairing the committee and volunteers shouldn ' t
be expected to pay such a bill . Miss Wise was in agreement and Mr . Anderson moved and
Mr . Reed seconded that . the Board reimburse Mr . Francis for the full amount of the in-
voice less the tax and it was a vote .

Mr . Eldredge reviewed the re -wording of Item #1 of the Conditions of Approval of the
15 Amendment of the Decision of the Special Permit of the Ocean Edge PUD and felt that it
looked fine and both he and Clerk Montgomery signed the document to be filed with the
Town Clerk for the 20 day appeal period .
He also read a letter from C . Huntley Rylanderg owner of a large tract of land on
16 Greenland Pond the access of which is over an ancient way . The letter was forwarded
to the Board by the Deputy Tax Assessor . The secretary was asked to reply that the
Board appreciates the problems involved and suggest that Mr . Rylander make an appoint-
ment to appear before the Board when he is again in the area to discuss the problems
and a possible division of the tract .
During a discussion of` the Fiscal Year 1984 budget the Chairman read a request from
17 the Board of Selectmen that the individual departments and Boards set aside an amount
in their budgets for physical examinations . It was agreed that the budget should in-
clude money for a revision of the Zoning By-Law Booklet .
18 Mr . Reed introduced his neighbors Mr . Thomas Watkinsv of the Management Study Comm-
ittee . Adjournment was at 9 : 00 PM .
