HomeMy Public PortalAbout1983-044Member 5c n ere v introduced the following resolution and moved its adoption: CITY OF MEDINQQA RESOLUTION NO. a13 RESOLUTION GRANTING A VARIANCE TO WILLIAM NELSON TO PERMIT CONSTRUCTION OF A DECK AND ENTRANCE TO HOME AT 3065 LAKESHORE AVENUE WHEREAS, William Nelson, ("applicant") has applied for a variance to the provisions of Sections 408(8) and 610.5 of the Medina Zoning Ordinance to construct a deck and entrance to his home at 3065 Lakeshore Avenue; and WHEREAS, a variance to Sections 408(8) and 610.5 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: The existing structure is built at a location that does not comply with the setback requirements of the current Medina Zoning Code. and WHEREAS, the granting of the variance requested will not confer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on May 10, 1983, and before the Medina City Council on June 7, 1983. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, that a variance to the provisions of Sections 408(8) and 610.5 of the Medina Zoning Ordinance is hereby granted subject to the following terms and conditions: (1) Said construction of a deck and entrance to the home shall be in accordance with plans submitted to the City of Medina on property legally described as: Lot 7, Block 8 of Independence Beach. (2) The variance shall expire if the action requested by the variance has not been completed or installed within one year after the date of this Resolution. (3) The applicant shall comply with all provisions of the Medina Zoning Ordinance. (4) The deck shall be no longer than 10' x 24'. (5) The deck shall never be enclosed and shall be open slated so that water may run through and off the structure. (6) The deck shall be constructed no closer to the lake than 35 feet. (7) The entrance on the north side of the house shall be constructed no closer than 5 feet from the west property line. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance.
