Present were Mrs . Gage , Mr . Montgomery , Mr . Eldredge and Chairman Reed whointroduced 1 � new members Ms . Janette iodise and Mr . Robert Wilkinson . Clerk Eldredge read the min - utes of the January 209 - 1981 meeting . It was noted that on Page 2 , Paragraph 1 , Sen - tence #8 is amended to read "After discussion Mrs . Gage moved and Mr . Montgomery sec- onded that the modification plan be conditionally approved pending appeal and the waivers accepted and it was so voted . It was voted to accept the minutes as amended . The new members signed signature letters for the recording and registering of plans at the Registry of Deeds and in Land Court . Members were advised that the last date for the submission of Articles for the Annual 2e Town Meeting Warrant is February 26th . It was decided to hold a subcommittee meeting on Thursday evening , February 5th , to draft proposed amendments to the Zoning By-Law . Mrs . Gage and Messrs . Wilkinson and Reed agreed to serve on the committee . The Secretary told members that the Planning Board A . B . Dick mimeograph machine had 3 * not been used for several years due to its inefficiency and suggested that an Article be inserted in the Annual Town Meeting Warrant for authorization to sell or dispose of it . Mrs . Gage moved and ' Mr . Wilkinson seconded that this action be taken and it was so voted . Attorney Myer Singer entered into a preliminary discussion with the Board of a pro - posed planned unit development of the Thornton property on Lower Road . He intro- a , duced the development team of Louis Vallencourt , builder of Newport , Rhode Island , Arthur Harrison , Vice President of the National Shawmut Bank of Boston and Michael Maholan , developer and counsel and Frances DeMello of Huygens and Tappe , Inc . Architectural Firm . He then asked Engineer Albion Hart to explain the density computations . He stated that of the 31 . 37 acre tract 4% is exposed wetlands ; 75% is upland and 25 . 81 acres useable for development . There are sixty two residential units planned for the R-L zoned property . Soil tests have been performed in twenty locations and he delivered a confirmatory letter from Will Joy of Coastal Engineering Co . that the soil is acceptable for the intended use . A sewage system of septic tanks and leach pits is to be installed . Mr . Hart displayed a sketch indicating locations of soil tests on the land which abuts Cape Cod Bay to the North and Lower Road to the South . Architect DeMello exhibited a site plan and described the property as densely wooded with white pine and spruce . He explained that the southerly area is rather damp with standing water in a peat pond to the east . There is an opening in the tree cover in the middle with a gully on the easterly border . The property opens up in the vicinity 5 ' of the existing dwelling giving a dramatic view of the bay . It is planned , Mr . DeMello continued , to convert the house into three dwelling units and place fifty nine units in clusters of three to eight houses . Since the approach road , site of the present driveway , is very close to the property line on the west there is a possibility of locatinq it further to the east to reduce its visability . Amenities include a feeling of privacy for potential owners ; use of a 550 ' beach and two tennis courts which will be unlighted at night . It is to be developed to attract buyers in the age brackett of BREWSTER PLANNING BOARD MINUTES OF THE MEETING OF FEBRUARY 39 1981 - Continued Page 2 45 and up with an eye to retirement and units will cost from - the middle to upper $ 100 , 000s . Abuttors voiced concern regarding security to the west and Mr . DeMello 6e said some type of fencing would be installed to blend with the vegetation . He added that the majority of units would be placed to the east with none closer than 30 ' to the property line . He advised that the market suggests two bedroom homes of one and two stories with one garage attached or detached per house . Attorney Roger O ' Day , appearing for his clients , the Misses Eddy , asked if commercial use was con- templated and Mr . Singer replied there was none . Mr . O ' Day also asked if there would be an on- site inspection and the Board was agreeable and the Misses Eddy asked to be included . Mr . Singer said he felt the work would commence in the summer and that the pace of construction depends on the market . Robert Finch , Co -Chairman of the Conservation Commission , said he felt . the developers showed good sensitivity in developing the site plan and suggested keeping a con- 7 . tiguous green belt and placing the houses more than 100 ' from the wetland in the Bay area . Mr . Singer said there would be no time sharing and that this development is com- pletely independent of the development of the LaFleur property to the East . It 80 is hoped to build twenty units per year and that simultaneous meetings would be arranged with the various boards involved . It was agreed that the project was ready for the Pre -Application Meeting . Engineer Albion Hart presented an Approval Not Required Plan of property of Helen Wilkinson on the s /s of Main Street , West Brewster . It showed a division into 3 90 lots with Lot #15 having an area of 40 , 175 square feet ; Lot 16 containing the main structure was a pan handle lot of 50 , 825 square feet and Lot #17 had 40 , 095 square feet and showed an easement for a view from Lot #16 . Chairman Reed , quoting from the By-Law , advised that such a division is allowed for not more than two lots and L� xplained the thinking behind the By-Law . He suggested a revision of the plan removing the line between 15 and 16 and then returning to the Board with another plan for the remainder of the tract . There were no objections to this procedure and Mr . Hart was allowed to withdraw the plan without prejudice . He advised the Board that he would like to have the Morris Kazanjian subdivision 10 . Plan file reopened . He presented an executed Grant of Easement copy from Waaowa , Inc . , developers of Captain ' s Village containing Mate ' s Way on the n/ s of Route 6A to Mr . Kazanjian giving rights to the roadway and use of power lines and utility service connections with the Grantor holding the fee in the road . He explained the delay in working the subdivision out was due to reopening the original corporation for the granting of the easement . After discussion it was agreed that the file be reopened ; an inspection with residents of Mates Way made before and after road con- , struction , to satisfy abuttors and preparation of a covenant . It was decided that the Secretary would advise Mr . Hart regarding the details . Engineer Clifford Holman presented for the second time an Approval Not Required 11 . Plan of land of Elder Brewster , Inc . on Aunt Sophie ' s Way . He explained he changed the lot lines on the original plan as the Board requested and Lot #1 is now conveyed to Lot #5 thus giving Lot #3 adequate frontage . Mr . Montgomery moved and Mr . Eldredge seconded that the plan be endorsed . It was a vote and the plan, signed °py members Reed , Gage , Montgomery and Eldredge . Holman also presented a Partial Release of Covenant for Lots 1 , 2 and 3 , each on a different Land Court Plan of the Thousand Oaks II subdivision of Standish 12 . Realty , Inc . off the n/ s of Freemans Way . The Release read in part that the plans are recorded in Land Court and are the same parcels released by the Planning Board on November 9 , 1979 as Lots 52A , B , C and D . In a letter of explanation from Atty . John Sullivan he stated the original plan was never recorded and the original release was inadvertently filed on the unregistered side of the Barnstable Registry of Deeds . Now an urgency exists as the . owner of the property , Steven Rose , has a passing on the property immediately pending . The release was executed by Board members . Miss Joan Hammatt delivered a letter to the Board from Engineer Albion Hart stating that he had entered into a contract with Miss Hammatt for the setting of the bounds 13 . within her subdivision off Great Fields Road and they would be installed as soon as weather permits . The Partial Release of Covenant for Lot #7 was signed by members as voted at the last meeting . Mr . Malcolm Rancourt arrived to discuss the covenant expiration on his subdivision off the n/ s of Long Pond Road . He stated that he preferred not to pave the road 14 . further ; that the utilities and water are installed 375 ' into the subdivision and asked for a Release of Lots 41 and 3 . It was agreed that the file would be checked to see if a ' Release had been granted on Lot * 2 on which he has built his house . Mrs . Gage moved and Mr . Montgomery seconded that a Partial Release of Covenant for these lots be granted if the file is in order and it was a vote . The Board discussed proposed amendments to the Zoning By-Law for submission as Articles '! in the Annual Town Meeting Warrant , Robert Finch , ' Co-Chairman of the 15 . Conservation Commission asked if he could enter into the discussion . He asked the Board to take a long look at the Planned Unit Development By-Law and suggested that a change should be made so that the 20% of buildable upland should be open space and that density should he submitted on . a one to one basis . He discussed a book " Creative Land Development" regarding subdivision of property in Lincoln , Mass , The Board considered this proposal and also others concerning wind generators and concluded they would be worked on at the subcommittee meeting . A communication from A . Thomas Colo concerning his subdivision "Angelo Acres " off the east side of Slough Road was read and it was determined that the Chairman ad 160 vise him to consult an attorney and /or surveyor as the problem wasn ' t in the pur- vue of the Board .
