BREWSTER PLANNING BOARD
MINUTES OF THE MEETING OF
SEPT EMBER 17 , 1980
The Brewster Planning Board met on September 17 , 1980 at 7 . 30 PM in Brewster Town
Hall with Mesdames Gage and Ellis and Messrs . Eldredge , Reed , - Montgomery and
Anderson present . Mr . Eldredge read the minutes of the September . 2nd meeting
and the Chairman asked . if there were errors , omissions or amendments . There
being none Mrs . Gage moved and Mr . Anderson seconded that they be accepted as
read and it was a vote .
In the election of a Clerk of the Board Mrs . Gage nominated Mr . Eldredge and it
was seconded by Mr . Anderson and all were in favor .
Attorney Steven Jones came invrepresenting a client interested in purchasing
the Herbert Mallard subdivision off the w/s of Brier Lane . He reviewed the
Board ' s action of 8/19/80 when Lot # 1 was released from Covenant and advised
that his client wishes to create a one or two lot subdivision with a waiver of
roadway construction instead of the six lot tract and asked the Board ' s con-
Sideration . ,of procedure . Members expressed concern about the validity of Lot
# 1 and of access--if a rescission - is made and considered modification of lot lines .
Mr . Anderson moved and - Mrs . - Gage - seconded that a modification plan showing two
lots be considered - and it_was- - so - voted .
Ms . Joan Hammatt delivered an executed covenant for her two lot subdivision off
! the w/s - of- Great Fields Road and the definitive plan was endorsed and agreed that

i At 8 * 15 PM Ms . Jane - Wagoner and Mr . - John Schwalbe , representing the Board of
Appeals , appeared for a discussion of a proposed Zoning By-Law amendment . Ms .
Wagoner delivered an Article proposed for submission at the next Special Town
Meeting . It is to amend SECTION V , Table 1 , USE REGULATIONS - RETAIL AND SERVICE ,
by adding an Item # 26 - "Boat Building and allied activity .with restrictions as
permitted uses in the C-H and . I Zones . . Mr . Schwalbe explained that in the_ _
original By-Law a boat building classification was included in the C-H Zone and
in later amendments it was dropped and the designation changes to " repair and
sell " . He continued that the Board of Appeals went on record to permit the oper-
ation to continue for one year to allow the owner to complete boats under con-
tract and to allow sufficient time for a new By=Law to be adopted or for the owner
to relocate . He added that the word " build " is all that is necessary as an add-
- ition to the By-Law .
Attorney David Woods appeared with his client , Paul Krikorian , an abuttor . Mr .
Krikorian said that Mr . Eldredge was aware of Zoning Requireir►ents when he started
the present operation . Mr . Woods urged that if boat building is considered , other
building activities should be taken into account for the area and suggested the
Article be considered in • biboader terms . Mrs . Ellis said she felt all businesses

should be taken into regard and not individual problems . She favored working out
the problems on a long range basis . Ms . Wagoneer disagreed , saying she felt this
specific case should be taken into account . An audience spokesman said it is
easy to b� sympathetic to both sides and suggested there is a need to catagorize
uses more thoroughly . Mr . Eldredge said he feels his operation is no more detri-
mental than some others in the area . It was decided to take the matter under
advisement . The Board of Appeals delegates said they would like the Article
submitted to the Special Town Meeting and Mr . Eldredge said that if the Planning
Board does not submit it , it will be done by petition .
Engineer Albion Hart presented an Approval Not Required Plan of land of Leona
Sullivan on the n/s of Main Street showing a division into two lots - one 24 , 462
square feet and the other 31 , 205 square feet . Neither comply with zoning require-
ments and the plan , he said , is presented under Chapter 81-L of the MGL which
permits the division as buildings on both lots precede zoning . Mr . Anderson
moved and Mr . Montgomery seconded that the plan be approved and it was endorsed
by all members .
Ms . Jane MacKenzie came in to discuss the covenant expiration of her subdivision
off the s/s of Main Street . Mrs . - Gage abstained from the discussion and vote .
Ms . MacKenzie said she is unable to afford the installation of bounds . It was
decided that Mr . Anderson consult with the Town Engineer regarding the necessary
number of bounds . Mr . Montgomery moved and Mrs . Ellis seconded that a covenant
extension to December 6 , 1980 be granted . It was so voted .
Mr . Hart reported-on--progress being made in the -Callahan/'Dickey - subdivision off
Crowell ' s Bog Road . - The owners , he said , - requested him to prepare - the roadways
for construction ;__ quotations _ have--been - received _ and_a contractor is - ready- to pro=
ceed : The- utility ccmpanys are having great difficulty due to the - long drought -
and there is concern that the subdivision will not be completed by the December
6 oovenant - expiration date . - He -asked - for an extension from then until June 6 ,
1981 = This -was = favorable. - and Mr :-Anderson moved --and=Mr.".Nbntgomery.� seconded - that-- -
an extension -- of- covenant- time : be ' granted= to :June -6- , "1981==and -it -vaas a vote .
Engineer_ Ira - Thacher= with prospective owner-, � - Christian Witte , appeared with a per-
imeter plan of - the Frank Kynor property on the s/s of Main Street . Mr . Montgomery
moved and Mr . Anderson seconded approval ; _ it was a vote . and the plan endorsed .
Engineer Peter Soule resubmitted a Preliminary . Subdivision Plan of Richard and
Barbara Will for ther Freeman ' s Way property . - - He- explained the -topography of the
land , road grades and said the - feeling is that Freeman ' s Way will become a major
road so a 50 ' road width is proposed with no waivers . Taken into consideration
were water runoff , roadway grades and the need for a pan handle lot . Mrs . Gage
moved and Mr . Anderson seconded approval of the preliminary plan and it was a vote .
King ' s Landing II was discussed and Messrs . Montgomery and Reed told members
of their viewing of Rock Harbor Village in Orleans and Kings Laind I in regard
to maintenance . It was decided that sewage and drainage information specifically
addressed to Section 6F of the By-Law Decision be requested for the Health Agent ' s
recormendations and suggestions . Mr . Reed agreed to contact Agent Richard Anderson
and Mr . Majewski . It was also agreed that the Board wait until the plans for
Brewster Village are presented at a Legal Hearing before taking a vote on the
concept .

A letter was read from Walter Babbitt regarding a proposed change of use of his
Main Street property to a Cemetary and Crematory . After discussion it was agreed
that the secretary write a letter to the Zoning Agent asking for his interpret-
ation and a. reply to Mr . Babbitt .
Hoard members signed Releases of Covenants for the Amato subdivision off Cathedral
P,oad and Leona Leary ' s subdivision off Pond View Drive .
Adjournment was at 11 : 00 PM .
