HomeMy Public PortalAbout20120716 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 16 July 2012 Page 1 of 4 MINUTES- 16 July 2012 Called to Order: 7:30 PM Hopkinton Town Hall, Room 215-216 Adjourned: 9:10 PM Members Present: Jeffrey Barnes, Frank D’Urso, Andre Griben, Craig Nation, Melissa Recos, Marcus Waldron, Bob Ingram: Conservation Scientist, Don MacAdam: Conservation Administrator Members Absent: none 7:30 PM Commission Business  Mr. Waldron made a motion to approve the Requests for Payment dated 16 July 2012. The motion was seconded by Mr. Griben and it passed unanimously.  Mr. Waldron made a motion to approve the minutes of 25 June 2012. The motion was seconded by Mr. Griben and it passed unanimously.  Ms. Recos made a motion to approve the minutes of 05 July 2012. The motion was seconded by Mr. Waldron and it was passed by everyone except Mr. Barnes who abstained.  A discussion was held with Mr. Mark Mastroianni, Pulte Homes, and James Bernadino, Bohler Engineering, regarding condition number 74 of the Order of Conditions for Pulte Homes, Southwest, Southeast and East Main Villages at Legacy Farms, 0 Clinton Street (188-1489). The Commission determined that a boilerplate condition, condition number 74, was inadvertently included in the drafting of the Order of Conditions. Mr. Waldron made a motion to issue a Corrected Order of Conditions which removes condition number 74. The motion was seconded by Mr. Nation and it passed unanimously.  The Commission signed the following document: - Pulte Homes, Southwest, Southeast and East Main Villages at Legacy Farms, 0 Clinton St – Corrected Order of Condition (188-1489)  The Commission reviewed proposed project change plans submitted by Robidoux, 232 Ash Street (188-1485). The site plans identified the final Title V septic system design that was approved by the Board of Health. Mr. Waldron made a motion to approve, as an insignificant project change, the proposed relocation and revised grading for the septic system as identified in the revised engineered plan dated 14 November 2011 with a final revision date of 14 February 2012. The motion was seconded by Mr. Griben and it passed unanimously. Conservation Commission Meeting 16 July 2012 Page 2 of 4  The Commission reviewed proposed project change plans submitted by Osgood, 27 West Elm Street (188-1499). The sketch plans identified the proposed installation of a 3-foot high retaining wall associated with the installation of a Title V septic system. Mr. Nation made a motion to approve the proposed retaining wall as an insignificant project change, subject to the submittal of a copy of the final site plans approved by the Board of Health. The motion was seconded by Ms. Recos and it passed unanimously.  A discussion was held with Mr. Kerry Kunst, Golden Pond, regarding the proposed project change submitted by Golden Pond, 50, 58, 60 West Main Street (188-1436). Mr. Waldron made a motion to approve, as an insignificant project change, the proposed installation of a foundation drain line for the above referenced filing as noted in the letter dated 13 July 2012 and indicated on the revised utilities plan dated 12 July 2012. The motion was seconded by Mr. Griben and it passed unanimously. 7:45 PM Corbett Family Trust, 29 South Mill Street DEP File No. 188-1506 Notice of Intent-continuation Pat Corbett, Corbett Family Trust Mr. Corbett provided an overview of the Approval Not Required Subdivision Plan dated 27 June 2012 endorsed by the Planning Board and a memo from David Crossman, B&C Associates Inc., regarding the riverfront delineation dated 15 July 2012. Mr. Ingram stated that he would contact Mr. Crossman for further confirmation on the riverfront delineation. A discussion was held regarding the extent of the proposed restoration and alteration as allowed under The Rivers Protection Act Regulations 310 CMR 10.58(5). The Commission determined further clarification of the alteration to restoration ratio as noted under 310 CMR 10.58(5)(f) was required to be submitted for review. The hearing was continued to 30 July 2012. 8:00 PM Hayden Rowe Realty Trust, HCC File No. RDA 2012-7 149 Hayden Rowe Street Request for Determination of Applicability-continuation No representative attended the hearing An email request was submitted on 15 July 2012 to continue the public hearing. The hearing was continued to 30 July 2012. 8:00 PM Esthimer, HCC File No. RDA 2012-9 118 Hayward Street Request for Determination of Applicability Cynthia Esthimer, applicant/owner, Elizabeth Whittemore, owner Ms. Esthimer and Ms. Whittemore provided an overview of the Request for Determination of Applicability application and the site plans dated 06 May 2012. A discussion was held regarding the proposed addition and porch. Conservation Commission Meeting 16 July 2012 Page 3 of 4 Mr. Nation made a motion to close the hearing and issue a negative Determination of Applicability with the standard and noted special conditions. The motion was seconded by Mr. Griben and it passed unanimously. 8:10 PM Legacy Farms, LLC, DEP File No. 188-1505 14 Parcels North of East Main Street Notice of Intent David Pickart, Vanasse Hangen Brustlin, Inc.; Roy MacDowell, Todd MacDowell, Legacy Farms, LLC Mr. Pickart provided an overview of the Notice of Intent, Stormwater Report dated June 2012, site plans entitled “Definitive Subdivision Plan Legacy Farms Road North & Frankland Road Relocation in Hopkinton, Massachusetts (Middlesex County)” Sheets C-1 through C-39, dated 25 May 2012 with a latest revision date of 25 June 2012. It was noted that there is already an existing roadway from the previous nursery operation and that improvements will be made to the roadway under the Notice of Intent filing. Mr. Pickart provided an overview of the areas of wetlands that will be directly impacted from the roadway improvements. Mr. Harold Schmidt, 49 Frankland Road, submitted photos of the wetlands adjacent to the roadway on Frankland Road and provided an overview of drainage issues associated with the area. A discussion was held regarding the proposed mitigation measures. A discussion was held regarding the proposed stormwater low impact development best management practices. It was noted that Fay, Spofford & Thorndike required more time to peer review the stormwater management report. Mr. Ingram provided an overview of his comments to the Planning Board dated 02 July 2012 and stated that further time was needed to complete his review of the Notice of Intent information. Mr. D’Urso entered the meeting. The hearing was continued to 30 July 2012. 8:40 PM Olson, DEP File No. 188-1508 0 Spring Street Notice of Intent Ralph Maloon, RIM Engineering Co., Inc. Mr. Maloon provided an overview of the Notice of Intent, Stormwater Report dated 06 June 2012, plans entitled “Reservoir View A Residential Subdivision in Hopkinton, MA” Sheets 1 through 4 of 4, dated 06 June 2012. Conservation Commission Meeting 16 July 2012 Page 4 of 4 It was noted that the subdivision plans and stormwater report have not been submitted to the Planning Board for review to date. The Commission determined that the subdivision plans and stormwater report was required to be submitted to the Planning Board for their review and approval. It was determined that a copy of the Notice of Intent was required to be submitted to the Massachusetts Natural Heritage and Endangered Species Program for their review and comments. Mr. Ingram provided an overview of his memo dated 12 July 2012. The hearing was continued to 13 August 2012. 9:05 PM Commission Business  The Commission reviewed proposed project change plans submitted by MacDonald, 62 Pine Island Road (188-1484). The sketch plans identified the proposed removal of 8 healthy trees adjacent to existing structures and 4 diseased trees. The Commission determined to have Conservation Staff review the site and inquire if the applicant is proposing any mitigation for the removal of the healthy vegetation for continued soil stability of the lot which slopes towards the lake and for wildlife values.
