MINUTES OF THE SPECIAL MEETING OF
JANUARY 210 1980
The Brewster Planning Board held a special meeting on January 219 1980 at 7 : 30 PM
in the Planning Board office in Brewster Town Hall with Chairman Reed , Mesdames
Ellis and Gage and Messrs . Lazarus , Harwood and Farber present . Board of Health
Agent Majewski and Inspector of Buildings Thyng also attended . Mr . Majewski dis-
cussed the proposed Water Resource District By-Law that the Brewster Watershed
Committee wished to submit as a Zoning By-Law Amendment Article in the Annual Town
Meeting Warrant . He described procedure , the purposes and imput obtained from the
Water Commissionersq Board of Health and the Industrial Zoning Authority . The Board
reacted favorably . The Health Agent went on to say that at a recent meeting of the
Cape Cod Planning and Economic Development Commission it was suggested that Philip
Herr and Associates be consulted in drafting the By-Law . Time elements for sub-
mission of advertising proposed amendments for a public hearing was discussed and
Mr . Majewski said that the Town of Bourne is shortly adopting such a By-Law and he
offered to obtain a copy for consideration . The Board was in favor of this sugg -
estion .
Mr . Thyng joined Mr . Majewski in a discussion of the problems involved since the
acceptance of Chapter 808 which resulted in a change in By-Law use regulations
under Agriculture whereby the raising and keeping of livestockv horses and poultry
was eliminated in the R- R and R•L zones . Mr . Thyng suggested amending the use reg -
ulation_ #4 to the former restriction in whichever zones satisfactory and suggested
a minimum of two or two and one half acresobe considered but retaining the res -
striction on the keeping of swine . It was agreed that Messrs . Thyng and Majewski
draft such an amendment . Mr . Farber suggested that the Use Regulations under Ag-
riculture #3 be amended to include the R-M zone .
The secretary told of the Conservation Commission submitting a notice that Town
Counsel wished a different wording of the proposed amendment to rescind the Wet-
lands Section of the Zoning By-Law and the Commission will resubmit it shortly .
It was also agreed that within Section X , Special Regulationsp Item C , an amend -
ment shall be made so that fees will be paid when the plan of a Planned Unit
Development is finally approved and that Section IVB of the Planning Board
Rules and Regulations will be changed accordingly .
The Board then entered into a discussion of the plans and proposals submitted
by Vice President John Drew of Corcoran , Mullins and Jennision regarding use
of the LaSalette property at the January 16th Planning Board meeting . Taken
under consideration was the higher density requestedt the motel units * con-
ference center and restaurant contemplated which are not permissive under the
current By-Law and the amount of open space desired by the prospective developers .

Also discussed were the best interests of the Town for the use of the property ;
the difference between the original and present By-Law and the fact that the
developers consider the plan conditionally approved 2 %4 ,/75 valid and preferable
to proceeding under the current By-Law .
It was felt that the location of buildings is' not too essential to this Board and
that the Board of Health and Conservation Commission should have authority over
the Wetlands .
Modification powers and procedures to be adhered to under Chapter 41 , Section 81W
of the Mass . General Laws were reviewed and the advantages of initiationg such
proceedings were discussed . Mrs . Gage moved and Mr . Lazarus seconded that the
Board proceed with an advertised hearing to modify , amend or rescind approval of
the subdivision plan of land made for LaSalette Seminary Corp . , owner , and con-
ditionally approved by the Brewster Planning Board on February 4 , 1975 under
Chapter 41 , Section Mo of the Mass . General Laws and that we so inform Town
Counsel of this action and ask his advice about procedure . All were in favor
of this action and the vote was affirmative unanimously .
The Chairman then asked the Board to agree on what they would consider an accept"
able solution to the Zoning By-Law-Density problem . After discussion it was
roughly agreed the following concession would have to be made by the developers :
1 . They would agree to present Zoning By-Laws and Rules and Regulations
in all respects except density .
2 . They would agree not to build more than 95 condominium and 40 motel
units as part of the conference center setup .
3 . They would agree to pay filing fees as outlined .
The meeting adjourned at 10 : 55 PM .
