CITY COUNCIL
MINUTES
NOVEMBER 15, 1977
INITIATION:
1. CALL TO ORDER:
Mayor Merritt called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, November 15, 1977, in the Council
Chamber of the City Hall.
2. The invocation was given by Reverend Joseph Parriott, Christian
Center, 9319 N. Halifax Road.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4.. ROLL CALL:
Present:. Councilmen- Atkins, Dennis, Greenberg, Tyrell, Merritt
Absent: Councilmen -None.
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Biel, Planning Director Dragicevich,
Parks and Recreation Director Kobett
APPROVAL OF MINUTES:
On motion by Councilman Dennis, Item No. 5 of the November. 1, 1977
minutes of the City Council, were clarified to reflect Mr. Dick
Taylor, Manager of Temple City branch of Automobile Club of Southern
California made a presentation of Pedestrian Safety Award for 1976
when no pedestrian deaths occurred which was a 657 reduction over
their recorded information for 1975. Councilman Dennis moved to
approve the minutes, as amended, seconded by Councilman Atkins and
carried.
UNFINISHED BUSINESS:
6. PUBLIC HEARING: 7:30 p. m. STREET LIGHTING ZONE BOUNDARIES -
ANNEXATION FROM ZONE B TO ZONE A
City Manager Koski presented background information, stating the
City Council, at their regular meeting held October 18, 1977 adopted
Resolution No. 77 -1682 setting public hearing for November 15, 1977
relating to adjustment of zone boundaries of the lighting district.
Legal notices were published and posted pursuant to the Street
Lighting Act of 1919 for four areas: a) Green Street, Glickman to
easterly terminus; b) 9028 Rancho Real Road (Tract No. 32392);
c) 5422 -32 McCulloch Avenue (Tract No. 31886); and d) portion of
land on Kauffman Avenue, north of Lower Azusa Road (Tract No. 31181).
Notices were filed with the State Resources Agency that full Environ-
mental Impact Reports were prepared for the three tracts; a negative
declaration was prepared for Green Street.
Mayor Merritt declared the public hearing open and invited anyone
wishing to speak to the matter to come forward. There being no one
wishing to speak, Councilman Atkins moved to close the public hearing,
seconded by Councilman Greenberg and carried.
Councilman Atkins moved that the City Council certify that the
Environmental Impact Reports have been completed in conformance
with the California Environmental Quality Act and the state guide-
lines and that the City Council has reviewed and considered the
information contained in the reports; and that any adverse environ-
mental impact contained in the reports is overruled and counter-
balanced by economic and social objectives and concerns in providing
this community with private or public improvements of municipal
import as set forth in the findings, seconded by Councilman Greenberg
and carried.

Councilman Greenberg moved to adopt Resolution No. 77 -1690 A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING
AN ADJUSTMENT OF THE ZONE BOUNDARIES OF THE STREET LIGHTING DIS-
TRICT WITHIN THE CITY, seconded by Councilman Atkins and carried.
7. PUBLIC HEARING: 7:30 p.m. TENTATIVE TRACT 33632, 5817 -21 N. OAK AVENUE
(APARTMENT /CONDOMINIUM CONVERSION)
City Manager Koski presented background information, stating the
Planning Commission, at their regular meeting held October 25, 1977
adopted a resolution recommending approval of Tentative Tract
No. 33632. The subject property, located at 5817 -21 N. Oak Avenue, .
is currently zone R -3 and consists of a 6 -unit apartment complex
which is proposed to be converted to a condominium: Planning Com-
mission recommended certain additional conditions which are not, in
general, applicable to the construction of apartment buildings.
Planning Commission is also considering establishing standards for
condominium development with respect to planning and design criteria.
The proposed conversion is categorically exempt from the California,
Environmental Quality Act of 1970. City Council, at their regular
meeting held November 1, 1977, set public hearing on this matter
for November 15, 1977.
Mayor Merritt declared the public hearing open and invited anyone .
wishing to speak to the issue to come forward. There being no one .
come forward to speak, Councilman Dennis moved to close public hearing,
seconded. by Councilman Atkins and carried.
Councilman Atkins moved to include the Planning Commission a part of
the record, seconded by Councilman Greenberg and carried.
Councilman Dennis moved to certify the categorical exemption of
Environmental Impact Report, seconded by Councilman Greenberg and
carried.
In answer to Councilman Greenberg's question, Planning Director
Dragicevich advised there are two covered parking spaces for each
unit, plus two extra parking spaces.
Councilman Atkins stated he felt the Planning Commission had been
very thorough in their deliberations and concurs with their findings.
Councilman Greenberg stated he is concerned about the conversion of
apartments to condominiums; that many of the apartments in Temple
City are occupied by elderly people and they could have a difficult
time finding comparable housing in the community. He concurred the
Planning Commission needs to study this matter and felt perhaps a.
moratorium on conversions would be in order.
Councilman Tyrell stated he agrees this type of conversion can be
a social problem, however, Council should not interfere with the
rights of property owners to convert their investment.
City Attorney Martin advised the Planning Commission considered all
aspects of conversion; the owner's rights, the tenants rights, the
appropriate mix of housing in the community, and concluded this
particular conversion would have no impact.
Councilman Atkins moved to approve Tentative Tract No. 33632 as
set forth in Planning Commission Resolution No. 77- 772PC, seconded
by Councilman Greenberg and carried.
8. ACCEPTANCE OF BID: SLURRY SEAL PROJECT: FY 1977 -78 -
MAINTENANCE AREA 3A
City Manager Koski presented background information, stating the
City Council, at their regular meeting held October 18, 1977, approved
plans and specifications for the annual slurry seal project and
authorized advertising and receiving of bids. A total of four bids
were received with the apparent low bidder being Ted R. Jenkins in

the amount of $20,350.00. There will be additional costs for
restriping of the public parking lots; the two banking and the
savings and loan institutions have been contacted as to their
cooperation in participating in the costs for the improvement
of their private lots,' the' cost to - be:based upon the square footage
at the long ton unit price of the bid.
Councilman Tyrell moved to accept the low bid from Ted R. Jenkins .
in the amount of $20,350 and authorize the Mayor and City Clerk
to sign, seconded by Councilman Greenberg and carried.
NEW BUSINESS:
9. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of November 2, 1977
GIDLEY STREET, SOUTH SIDE, ADDITIONAL REGULATIONS
City Manager Koski advised the Traffic Commission has recommended
the placement of a commercial loading zone in front of the Natter
Company, as well as the placement of a one hour time limit sign, .
to conform with the hours of parking signs located elsewhere in the
immediate vicinity to relieve the congestion for traffic moving
through this section of Gidley Street and provide for customer
parking.
Councilman Tyrell moved to approve Traffic Commission recommendation
as set forth in memo dated November 3, 1977 on file in the City Clerk's
office, seconded. by Councilman Greenberg and carried.
10. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of November 8, 1977
A. SET PUBLIC HEARING TO AMEND ZONING CODE RELATING TO CORNER
AND SUBSTANDARD LOT FRONT SETBACKS
City Manager Koski advised the Planning Commission, at their regular
meeting held November 8, 1977, held public hearing and adopted a
resolution recommending to the City Council an amendment to the
Temple City Zoning Code relating to front yard setbacks for a) corner
lots and lots with double frontage on a public street; b) substandard
lots having no frontage on a public street but with access by private
easements; and c) lots having less than 35 ft. frontage on a public
street. A referral of such cases to the Minor Zoning Modification
Committee will provide enough flexibility to handle the cases. The.
Planning Commission approved filing a negative declaration of Environ-
mental Impact.
Councilman Greenberg moved to set public hearing on Planning Com-
mission recommendation December. 6, 1977, seconded by Councilman
Tyrell and carried.
B. SET PUBLIC HEARING TO AMEND ZONING CODE RE PROPERTY MAINTENANCE,
OF VACANT COMMERCIAL PROPERTIES
City Manager Koski advised the Planning Commission, at their regular
meeting held November 8, 1977, held public hearing and adopted a
resolution recommending to the City Council an amendment to the
Zoning Code relating to property maintenance of vacant commercial
properties; specifically, removal of signs for conforming and non-
conforming businesses, and installation of barricades to prevent
access to abandoned parking areas. The Planning Commission approved
a negative declaration of Environmental Impact.
Councilman Atkins moved to set public hearing on Planning Commission
recommendation December 6, 1977, seconded by Councilman Greenberg
and carried.
C. CLARIFICATION OF AMBIGUITY RE SIGN ORDINANCE
City Manager Koski advised the Planning Commission, at their regular
meeting held November 8, 1977, adopted resolution clarifying an
ambiguity presently existing in the Temple City Zoning Code relative
to prohibition against outdoor advertising structures in the G -2
and C -3 zones.

Councilman Dennis moved to concur with Planning Commission reso-
lution and refer back to Planning Commission for public hearing on
amendment to the Zoning Code, seconded by Councilman Atkins and
carried.
11. STREET IMPROVEMENTS - FARAGO AVENUE, FREER TO GRAND (Installation
of Street Lights)
City Manager Koski presented background information, stating petiti
for street lights within subject limits were received; the request -
for five 7,000 lumen lights on existing wood poles on the east side
of the street only; petition represents 817 of the front footage of
the block. The project comes under a categorical exemption as de-
fined in the Environmental Quality Act of 1970 as amended.
Councilman Dennis moved to accept the petition, concur with filing .
of categorical exemption, set public hearing December 6, 1977
pursuant to Chapter 27, Improvement Act of 191.1, and instruct the
Superintendent of Streets to notify the affected property owners,
seconded by Councilman Atkins and carried.
12. RESOLUTION NO. 77 -1691: EMPLOYMENT OF PERSONNEL
Councilman Tyrell moved to adopt Resolution No. 77 -1691 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL,
seconded by Councilman Dennis and carried.
13. RESOLUTION NO. 77- 1692:. WARRANTS & DEMANDS, DEMAND NOS. 7909 THRU
8023 IN THE AMOUNT OF $108,481.76
Councilman. Atkins moved to adopt Resolution No. 77-1692 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND
DEMANDS IN THE SUM OF $108,481.76, DEMAND NOS. 7909 ;THRU 8023, secon
by Councilman Tyrell and carried,, Councilman Greenberg noting his no
participation with regard to check number 7930.
14. COMMUNICATIONS
A. Kiwanis Club re: Request to conduct Annual Line of Dimes,
January 2.7, 1978 .
City Manager Koski presented communication from Kiwanis Club of
Temple City requesting permission to conduct their annual Line of
Dimes Campaign from 11:30 a.m. to 5 :30 p.m. on January 27, 1978;.
and Mother's March to be held February 11, 1978 from 6.p.m..through
8:30 p.m.
Councilman Tyrell moved to approve request from Kiwanis Club of
Temple City as set forth in their letter dated November 3, 1977,
subject to certificate of insurance naming the City additionally
insured and placing cones and barricades for protection of the
volunteer workers, seconded by Councilman Dennis and carried.
B. Community Redevelopment "Agency re: Parking Lot Lease Agreement,
dated December 1, 1974, Rental Payment
City Manager Koski presented communication from the :Community
Redevelopment Agency advising rental obligation for the period
October 15, 1977 to April 15, 1978 is $155,477.50 of which $3,530.97
has been collected by the City from the operators of the parking
facilities.
Councilman Greenberg moved the City request the Agency to make a
deficiency payment in the amount of $151,946.33 pursuant to the
Reimbursement Agreement, seconded by Councilman Atkins and carried.
C. Claim for Damages - R. Stepp, 9405 La Rosa
City Manager presented claim for damages on behalf of R. Stepp,
9405 La Rosa Drive for damages alleged to have occurred on or about
October 10, 1977 on Cloverly Avenue.
Councilman Tyrell moved to deny claim and refer to City's insurance
carrier, seconded by Councilman Dennis and carried.

.15. TIME FOR THOSE. IN THE AUDIENCE WHO WISH TO SPEAK:
James Law, 9521 Wedgewood Avenue, requested the status of his
request regarding local ordinance which would permit Bingo.
City Manager Koski advised Mr. Law the matter was on the agenda
under Matters from City Officials and staff's recommendation
would be to refer the matter to staff for a comprehensive report.
Mr. Hector Seguin, 5012 Halifax, stated he had read in the newspaper
the City received $1,500,000.00 for sidewalks and wanted to know
why his area could not get curbs and gutters. City Manager Koski
advised the City had submitted an application and received approxi-
mately $400,000 specifically for sidewalks which was accomplished.
pursuant to.Traffic Commission recommendation for priorities based
on traffic and pedestrian need. City Council has always had a
policy of a cooperative program for installation of curbs and gutters
and if the 5000 block of Halifax wishes to petition for curbs and
gutters, City Council will consider their request.
Mr. Seguin also expressed concern regarding a traffic hazard at the
intersection of Halifax and Key West. and suggested a stop. sign at
that location may be a means to control traffic.- Mr. Seguin was
informed the matter will be placed on the Traffic Commission agenda
December 7, 1977 for their consideration.
Mrs. Grace Vett, 5476 Temple City Boulevard, inquired what Council .
intended to do about the hazard she feels exists at the ingress and
egress to her driveway. Mrs. Vett was informed . the insurance
investigator has advised that, in their opinion, it is incumbent
upon the driver to be cautious exiting the driveway and, further,
it is a matter between the property owners.. Therefore, in'the
opinion of the Sheriff's Department, the Traffic Engineer, and the .
insurance carrier, the City has no basis to require the wall to be
removed.
RECESS TO CRA:
The City Council recessed at 8:15 p.m. to meet as the Community Redevelop -
ment Agency, all members being present; approved the minutes of the regular
meeting held November 1, 1977; held public hearing and approved quitclaim
of Agency interest in Flood Control property acquired by the Agency;
approved deficiency payment to City for rent obligation; approved Christmas
tree sales in parcel "B" of the Redevelopment Project; approved resolution
for warrants and demands, and approved revised Tentative Parcel Map 6146.
The minutes are set forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:
16. ACTION ON REQUEST BY CRA:
There was no action to be taken.
17. MATTERS FROM CITY OFFICIALS`:
A. Sight Obstruction, 5400 block, Temple City Boulevard
City Council received and filed a communication from Christ and Spang
concerning a possible sight obstruction in the 5400 block of Temple
City Boulevard, stating the property owners involved should work
out a solution.
B. Surplus Property
Councilman Greenberg moved to declare surplus items left at 9217
Pentland Avenue being acquired by the City and authorize solici-
tation of bids, seconded by Councilman Atkins and carried.
C. Student and the Law Agreement - between City and Temple City
Unified School District
City Council receive.. request from the Temple City Unified School
District recommending, :icreases to the program which would increase
the total budget to 5x1,000, City's additional share to he $500.

Councilman Atkins moved to approve increase to the program,
appropriate an additional $500 and amend the adopted budget
accordingly, seconded by Councilman Dennis and carried.
D. Councilman Greenberg reminded Council the meeting of the
San Gabriel Valley Association of Cities will be held Thursday,
November 17, 1977, at which time they will be taking action re-
garding the proposed change in by -laws. Also speaker for the
evening will be Charles Martin.
18. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Atkins, .
meeting adjourned at 8:40 p.m. Next regular meeting of the City
Council will be held Tuesday, December 6,1977, 7:30 p.m. in the
Council Chamber of the City Hall.
