HomeMy Public PortalAbout2022-62 Confirming a Declaration of a State of Emergency due to Hurricane Ian and related ExpendituresRESOLUTION NO. 2022-62 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, CONFIRMING A DECLARATION OF A STATE OF EMERGENCY DUE TO HURRICANE IAN AND RELATED EXPENDITURES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 23, 2022, a State of Emergency was declared by Florida Governor Ron DeSantis, Executive Order 22-218, as amended by Executive Order 22-219, and by Miami -Dade County Mayor Daniella Levine Cava relating to Hurricane Ian; and WHEREAS, the National Hurricane Center forecasted that Hurricane Ian would continue to strengthen and that South Florida would experience heavy rain and possible tropical storm winds, along with a King Tide, which would be exacerbated by storm conditions; and WHEREAS, Hurricane Ian posed a severe threat to the Village of Key Biscayne ("the "Village") and required timely precautions to be taken to protect the community, critical infrastructure, and general welfare of the Village; and WHEREAS, on September 27, 2022, the Village Manager issued a Declaration of State of Emergency due to Hurricane Ian (the "Declaration"); and WHEREAS, on October 19, 2022, the Village Manager terminated the State of Emergency, as conditions causing the emergency no longer existed and the Village's agencies and departments were able to manage the situation without extraordinary assistance; and WHEREAS, the Village Council desires to confirm the Village Manager's Declaration of State of Emergency due to Hurricane Ian and related expenditures; and WHEREAS, the Village Council finds that this Resolution is in the best interest and welfare of the residents of the Village. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Page 1 of 2 Section 1. Recitals. That each of the above -stated recitals are hereby adopted, confirmed, and incorporated herein. Section 2. Confirmation. That, in accordance with Section 9-5 of the Village Code, the Village Council hereby confirms the Village Manager's Declaration of State of Emergency due to Hurricane Ian and related expenditures, as further provided in the Village Manager's staff report. Section 3. Effective Date. That this Resolution shall be effective immediately upon adoption. PASSED and ADOPTED this 29th day of November, 2022. ATTEST: JOC YN B.
