Mr. Sullivan requested to hold an informal discussion with the three assembled members of the
Commission regarding the current status of his Request for Certificate of Compliance application.
The Commission members stated that a quorum was not present, a public meeting had not been
called to order and that they could not act to make any decisions as a Commission. Mr. Sullivan
stated that he understood and an informal discussion was held regarding the Request for
Certificate of Compliance application.

Mr. Stickney requested to hold an informal discussion with the three assembled members of the
Commission regarding the current status of his Request for Certificate of Compliance application.
The Commission members stated that a quorum was not present, a public meeting had not been
called to order and that they could not act to make any decisions as a Commission. Mr. Stickney
stated that he understood and an informal discussion was held regarding the Request for
Certificate of Compliance application.

Mr. Zieff requested to hold an informal discussion with the three assembled members of the
Commission regarding the potential installation of an underground gas utility line by NSTAR Gas
within a portion of the East Main Street right-of-way. The Commission members stated that a
quorum was not present, a public meeting had not been called to order and that they could not act
to make any decisions as a Commission. Mr. Zieff stated that he understood and an informal
discussion was held regarding the potential installation of an underground gas utility line.

Mr. Pyne requested to hold an informal discussion with the three assembled members of the
Commission regarding a potential three lot family subdivision. The Commission members stated
that a quorum was not present, a public meeting had not been called to order and that they could
not act to make any decisions as a Commission. Mr. Pyne stated that he understood and an
informal discussion was held regarding the potential three lot family subdivision.

The Commission reviewed a memo from David Crossman, B&C Associates Inc., dated 10
August 2012. The Commission determined that any Order of Conditions issued shall condition
the recording of a deed restriction as subject to 310 CMR 10.58(4)(c)2.b.vi.
Ms. Recos made a motion to close the hearing and issue an Order of Conditions with the standard
and noted special conditions. The motion was seconded by Mr. D’Urso and it passed
unanimously.

Mr. Pickart submitted and provided an overview of the Vanasse Hangen Brustlin, Inc. memo
dated 13 August 2012.
The Commission determined that they need engineer peer review comments from Fay, Spofford
& Thorndike regarding stormwater and stream crossing standards.
The hearing was continued to 27 August 2012
9:30 PM Commission Business
An informal discussion was held with Mr. Steven Zieff regarding the memo from Lucas
Environmental dated 09 August 2012 for DEP File No. 188-1469.
An informal discussion was held with Mr. Steven Zieff regarding the proposed installation of
an underground gas utility line by NSTAR Gas within a portion of the East Main Street right-
of-way. The Commission noted that if any of the proposed work was located within the
Commission’s jurisdiction then a Request for Determination of Applicability would need to
be submitted for review.
The Commission signed the following documents:
- Gedutis, 57 Fruit St – Determination of Applicability (RDA 2012-10)
Mr. D’Urso made a motion to approve the Requests for Payment dated 13 August 2012. The
motion was seconded by Mr. Griben and it passed unanimously.
Mr. D’Urso made a motion to approve the minutes of 16 July 2012. The motion was
seconded by Ms. Recos and it passed unanimously.
A discussion was held regarding the status of the Request for Certificate of Compliance
application for Sullivan, 1 Tammer Lane (DEP File No. 188-1296). It was noted that during
the site inspection an unapproved putting green was observed installed within the approved
limit of lawn. The Commission determined that such an accessory structure would have been
reviewable under an application filing. Ms. Recos made a motion to approve the issuance of
a Certificate of Compliance, subject to the submittal of a revised as-built plan which
documents all currently existing site conditions. The motion was seconded by Mr. D’Urso
and it passed unanimously. The Commission signed the subject Certificate of Compliance
document.

A discussion was held regarding the status of the Request for Certificate of Compliance
application for Stickney, 126 Fruit Street (DEP File No. 188-305). It was noted that there are
no records which indicate an after-the-fact Notice of Intent (NOI) was submitted for the
detached garage as constructed in response to the Determination of Applicability on file for
the property (HCC File No. RDA 1992-4). The Commission determined that since the
previous Commission was seeking the submittal of an NOI for the detached garage it can now
be documented on an as-built plan under the Certificate of Compliance. The Commission
determined that a revised as-built plan must be submitted which identifies the square feet
(s.f.) of 100-year flood plain zone area and cubic yards (c.y.) of storage volume that were
actually disturbed by the site construction, how much s.f. of 100-year flood plain zone area
and c.y. of storage volume was actually constructed, the existing limit of the 100-year flood
plain elevation as constructed and the location of the septic system and well as installed. It
was noted that during the site inspection the slopes south of the driveway and the detached
garage were observed to be unstable and causing erosion into the buffer zone and adjacent
wetland. Ms. Recos made a motion to issue an Enforcement Order to condition the necessary
site work for permanently stabilizing the slopes. The motion was seconded by Mr. D’Urso
and it passed unanimously.
Mr. D’Urso made a motion to renew the Conservation Scientist agreement with Lucas
Environmental LLC for fiscal year 2013 as discussed. The motion was seconded by Mr.
Griben and it passed unanimously.
