A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, ADOPTING
WORKFORCE HOUSING LEGISLATIVE FINDINGS
PURSUANT TO MIAMI-DADE COUNTY CODE SECTION
33-193.7; PROVIDING FOR TRANSMITTAL; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on December 20, 2016, Miami -Dade County adopted an ordinance requiring
incorporated municipalities within its jurisdiction to address the need for workforce housing (the "County
Code"); and
WHEREAS, the Village of Key Biscayne ("Village") Council supports the need for workforce
housing within Miami Dade County; and
WHEREAS, the Village desires to support and promotes access to affordable and workforce
housing; and
WHEREAS, the Village Master Plan's goals, objectives, and policies provide a duty to monitor
and address affordable and workforce housing when feasible; and
WHEREAS, the Village is located on a built out barrier island making the cost of vacant and
redevelopment land within the Village very high; and
WHEREAS, Section 4.15 of the Village Charter would require a referendum in order to permit a
density bonus, including for a workforce housing bonus as contemplated by the County Code; and
WHEREAS, Section 33-193.7 ofthe County Code provides that it shall not be construed to require
a violation of a municipal Charter; and
WHEREAS. due to the issue of high value vacant and redevelopment land and the Village Charter
it is impractical for the Village to provide for workforce housing within its jurisdiction; and
WHEREAS, pursuant to the Village's Master Plan, the Village will continue to review and
implement affordable and workforce housing provisions if, and when, the provisions become feasible; and
WHEREAS, the Village Council finds that this Resolution is in the best interests and welfare of
the members oldie Village.

NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. That above recitals are true and correct and are incorporated herein by
reference.
Section 2. Legislative Findings. The Village Council hereby declares that providing for
workforce housing within its territorial jurisdiction is currently impractical due to the high value of vacant
and redevelopment land and the requirements of the Village Charter.
Section 3. Transmittal. The Village Clerk is hereby authorized to transmit this Resolution to
the Director of Miami -Dade County Department of Regulatory and Economic Resources and Clerk of the
Miami -Dade County Board of County Commissioners
Section 4. Effective Date. This Resolution shall take effect immediately upon adoption.
