HomeMy Public PortalAbout2002.013 (01-31-02)RESOLUTION NO. ~nn~,013 ~~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY~OF LYNWOOD APPOINTING AN ELECTIONS OFFICIAL FOR RECALL MATTERS WHEREAS, Sections 320 and 11002 (b) of the California Elections Code, define an "elections official" as "any person who is charged with the duty of ~' conducting an election; 1 ~ ~ ` ~.~ WHEREAS, the duty to perform the services of an election. official is not mandated by the general. law of the State of California; WHEREAS, the City Council may delegate such duties and responsibilities to any person or entity specified by ordinance or resolution, • WHEREAS, the City Council has been advised that a Notice of Intent to Recall has been filed against a Member of the City Council; _ WHEREAS, the City Council determines that the City would be best served by a qualified and experienced Elections Official to conduct all matters { relating to the pending recall and any other related; matters in the City; and WHEREAS, the City Council may, by resolution, appoint an Elections Official to render specified services in a municipal election NOW THEREFORE, THE CITY COUNCIL FOR THE CITY OF LYNWOOD ADOPTS THE FOLLOWING RESOLUTION: , ~ i ~ 'Section 1 Appointment of Elections Official for Recall Elections. The # j City Council hereby appoints. Faustin Gonzalez, City Manager, as the -- Elections Officer for the City Section 2. Duties of the Elections Official for Recall Matters The duties of the Elections Official for Recall Matters shall include, but shall not be limited to the following (a) Conduct and monitor any and all regular or special municipal elections held in the City for the purpose of recalling elected public officials of the City (b) May, but need not be the City Clerk. (c) Choose to appoint a Deputy Elections Official, a consultant or another employee to assist or to conduct and monitor such municipal election. t ~ per ote of the Cit CCo Heil ~ eso~ut~on was resc~nde~ as of . ~ march 18, 2003 ..(d) Shall be any person or entity that is charged with the duty of conducting an election (e) Shali supervise all regular or special .municipal' elections in the City and may prescribe rules and regulations for the conduct of such elections that. are .not in conflict with the provision of this chapter or constitution and general laws of the state. (f) In addition to the other duties required for the Elections Official in connection with recall elections matters, the Election Official shall i _ j {1~) SuppJy appropriate forms and manuals prescribed by the ~ California Fair Political Practices Commission. These forms and manuals shall be furnished 'to all candidates and - committees and. to all other .persons required to file reports,.
