CITY OF MEDINA
RESOLUTION NO. 83-56
RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR
ALPANA ALUMINUM PRODUCTS, INC.
WHEREAS, the applicant, Alpana Aluminum Products, Inc.
has requested approval of a manufacturing plant and office
building as set forth on its Site Sketch, plan sheet A-1,
dated 12/09/83; and
WHEREAS, a public hearing was held by the Planning Com-
mission pursuant to all statutory and ordinance requirements
and a report was made to the City Council; and
WHEREAS, due to the accelerated hearing schedule requested
by the applicant, much of the required technical information,
such as landscape plans, drainage plans, topographical studies,
lighting plans, and the like, could not be supplied at the time
of the hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina that a conditional use permit is approved for
the project subject to the following conditions:
1. The project shall be constructed in accordance
with the plans submitted and in accordance with
plans as submitted in the future and approved
by the City staff or the Planning Commission
or the City Council, as further detailed herein;
2. Except as otherwise detailed herein, or approved
in the future by the City Council, the project
shall conform in all respects to the ordinances
and regulations of the City of Medina and the
Statutes of the State of Minnesota and the ap-
plicable provisions of the Elm Creek Watershed
District;
3. The project shall be constructed in accordance
with landscaping plans submitted and approved
by the City staff with a provision for adequate
screening of all properties either zoned or
developed for residential purposes;
4. The project shall be constructed in accordance
with drainage plans and topographical plans sub-
mitted and approved by the City staff, including
provision for the protection of all surrounding
properties from adverse affects of storm water
runoff;
5. The project shall be constructed in accordance
with lighting plans submitted and approved by
the City staff which are consistent with city
ordinances and regulations, including the pre-
vention of light spillage onto any adjoining
properties;
6. The project shall be constructed in accordance
with a parking plan submitted and approved by
the City staff which is consistent with well
engineered traffic circulation patterns and all
city ordinances;
7. The project may be operated without limitation
on the hours of operation;
8. A setback shall be provided, as defined in the
Medina Zoning Ordinance, of 50 feet from all
property lines which abut property which is
either zoned or used for residential purposes;
9. Outdoor storage of products or materials related
to the manufacturing process shall be permitted
in an area not exceeding 100 feet by 120 feet
as shown on the approved Site Sketch, the stor-
age of said product not to exceed six feet in
height. Provided, however, that after all tech-
nical plans have been sumitted, questions relat-
ing to the screening of the exterior storage
shall be submitted to and approved by the City
Council;
10. The location, configuration, curb cuts, and ex-
tent of the proposed street shall be subject to
the approval of the city engineer and shall be
such that it serve all properties presently
owned or controlled by the applicant;
11. The project shall be constructed in accordance
with the principles set forth on Exhibits A-1
and A-2, which are attached hereto and made a
part hereof by reference;
12. In the event that any dispute arise between the
City staff and the applicant regarding the in-
terpretation, application, suitability, or the

conformance of the proposed plans with any of
the conditions set forth herein, such dispute
shall be brought before the City Council for
Resolution;
13. The applicant shall enter into a Development
Contract approved by the City Attorney and the
City Council and shall post appropriate finan-
cial guarantees to insure the construction of
the project in accordance with the plans ap-
proved;
14. The applicant shall reimburse the City for all
engineering, legal, planning and other adminis-
trative expenses incurred by the City in con-
nection with the processing of the application
and the construction of the project.

The motion for the adoption of the foregoing Resolution was
duly seconded by member Heideman and upon vote being taken
thereof, the following voted in favor thereof: Reiser, Heideman,
Anderson, Scherer and the following voted against
same: None
Whereupon said Resolution was declared duly passed and adopted.

505.1 Criteria for Granting Conditional Use Permits
In granting a conditional use permit, the Medina City Council
shall consider the advice and recommendations of the Planning
Commission and the effect of the proposed use upon the health,
safety, morals, and general welfare of occupants or surrounding
lands. Among other things, the City Council shall consider the
following:
(1) That the conditional use will not be injurious to the use
and enjoyment of other property in the immediate vicinity
for the purposes already permitted, nor substantially dimin-
ish and impair property values within the immediate vicin-
ity
(2) That the establishment of the conditional use will not
impede the normal and orderly development of surrounding
vacant property for uses predominant in the area.
(3) That adequate utilities, access roads, drainage and other
necessary facilities have been or are being provided.
(4) That adequate measures have been or will be taken to provide
sufficient off-street parking and loading space to serve the
proposed use.
(5) That adequate measures have been or will he taken to prevent
or control offensive odor, fumes, dust, noise and vibration,
so that none of these will constitute a nuisance, and to
control lighted signs and other lights in such a manner that
no disturbance to neighborhing properties will result.
(6) The use, in the opinion of the City Council, is reasonably
related to the overall needs of the City and to the existing
land use.
(7) The use is consistent with the purposes of the zoning code
and the purposes of the zoning district in which the appli-
cant intends to locate the proposed use.
(8) The use is not in conflict with the policies plan of the
City
(9) The use will not cause traffic hazard or congestion.
(10) Existing businesses nearby will not be adversely affected
because of curtailment of customer trade brought about by
intrusion of noise, glare or general unsightliness.
(11) The developer shall submit a time schedule for completion of
the project.
(12) The developer shall provide proof of ownership of the prop-
erty' to the Zonning Officer.

505.2 Additional Conditions
In permitting a new conditional use or the alteration of an
existing conditional use, the City Council may impose, in addi-
tion to those standards and requirements expressly specified in
this Ordinance, additional conditions which the City Council
considers necessary to protect the best interests of the sur-
rounding area or the community as a whole. These conditions may
include, but are not limited to the following:
(1) Increasing the required lot size or yard dimensions.
(2) Limiting the height, size or location of buildings.
(3) Controlling the location and number of vehicle access
points.
(4) Increasing the street width.
(5) Increasing the number of required off-street parking spaces.
(6) Limiting the number, size, location or lighting of signs.
(7) Required diking, fencing, screening, landscaping or other
facilities to protect adjacent or nearby property.
(8) Designating sites for open space. Any change involving
structural alterations, enlargement, intensification of use,
or similar change not specifically permitted by the condi-
tional use permit issued shall require an amended condi-
tional use permit and all procedures shall apply as if a new
permit were being issued. The Zoning Administrator shall
maintain a record of all conditional use permits issued
including information on the use, location, and conditions
imposed by the City Council; time limits, review dates, and
such other information as may be appropriate.
