J74 - 0Z RESOLUTION GRANTING A VARIANCE TO GEORGE GRUENWALD FOR A SUBSTANDARD LOT WHEREAS, George Gruenwald ("applicant") has applied for a variance to the provisions of Section 403 of the Medina Zoning Ordinance to recognize Lots 6 and 7, Tally Ho Farms as separate lots; and WHEREAS, a variance to Section 403 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: Lot 6 and Lot 7, Tally Ho Farms were owned by George Gruenwald at the time the Zoning Ordinance was enacted and George Gruenwald now desires to sell such Lot 6. Lot 6 has acceptable soil for a conventional septic system, has frontage on a public street, and is over one acre in size; and WHEREAS, the granting of the variance requested will not confer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on January 10, 1984 and before the Medina City Council on February 7, 1984. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, that a variance to the provisions of Section 403 of the Medina Zoning Ordinance is hereby granted subject to the following terms and conditions: (1) Said recognition of separate lots shall be in accordance with plans submitted to the City of Medina on property legally described as: Lots 6 and 7, Tally Ho Farms. (2) The applicant shall comply with all provisions of the Medina Zoning Ordinance. (3) All setback requirements must be satisfied. (4) Vixen Road must be used for access to the property. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance.
