HomeMy Public PortalAbout1984-003C Member sc h elt B- and moved its adoption: introduced the following resolution CITY OF MEDINA RESOLUTION NO. 8-V- 3 RESOLUTION GRANTING A VARIANCE TO GAYLE DAVIS TO PERMIT CONSTRUCTION AT 1052 OAK CIRCLE WHEREAS, Gayle Davis ("applicant"), had applied for a sixteen foot side yard variance and a fourteen foot side yard variance to the provisions of Section 605.5 of the Medina Zoning Ordinance to permit construction of an addition to the dining room of his existing house and to permit construction of a sun deck; and WHEREAS, a variance to Section 605.5 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: 1. The construction of the sun deck will be situated on the property at the only location that is not shaded by trees. 2. The lot is surrounded on three sides by roads and other locations are not permissible for the deck. 3. The property drops off considerably to the north making the location for the construction impractical. WHEREAS, the granting of the variance requested will not confer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on November 8, 1983, and before the Medina City Council on November 15, 1983. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina that a sixteen foot side yard variance and a fourteen foot side yard variance to the provisions of Section 605.5 of the Medina Zoning Ordinance is hereby granted to Gayle Davis to permit construction of an addition to the dining room of his house and to permit construction of a sun deck subject to the following terms and conditions: (1) Said construction shall be in accordance with plans submitted to the City of Medina on property legally described as: Lot 1, Block 2, Medina Manor First Addition, Hennepin County, Minnesota (2) The variance shall expire if the action requested by the variance has not been completed or installed within one year after the date of this resolution. (3) The applicant shall comply with all provisions of the Medina Zoning Ordinance. /,)vr (4) The deck shall not be enclosed and must have solid floors. BE IT FURTHER RESOLVED, by the City Council of the City of Medina that a violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance. 404 ec, DATED: January 6 , 1984.
