CALL TO ORDER: Mayor Merritt called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, December 20, 1977, in the Council Chamber of the City Hall. 2. The invocation was given by Mayor Merritt. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Greenberg, Tyrell, Merritt Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Biel, Parks and Recreation Director Kobett, Traffic Engineer Envall 5. APPROVAL OF MINUTES: Councilman Dennis stated that paragraph 4 of item 7 should read "to substitute 30 days for 60 days ". Councilman Atkins moved to approve the minutes of the regular meeting of the City Council held December 6, 1977, as corrected, seconded by Councilman Greenberg and carried. UNFINISHED BUSINESS: 1 6. ORDINANCE NO. 77 -455: 2nd read. AMENDING ZONING CODE RE PROPERTY MAINTENANCE OF VACANT COMMERCIAL PROPERTIES City Manager Koski presented background information stating that the Planning Commission, at their regular meeting of December 13, 1977, reviewed the changes and additions made to their original recommendations on the subject item in Resolution No. 77- 774PC. and concurred with City Council findings to modify Subsection A(2) from 60 to 30 days, and the addition of Subsection C, which reads "All buildings shall be secured immediately upon vacation so as to prevent ingress ". City Attorney Martin read Ordinance No. 77 -455 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING A NEW SECTION 9279 TO THE TEMPLE CITY ZONING CODE RELATING TO VACATED BUSINESSES by title only. Council- man Tyrell moved to waive further reading and adopt, seconded by Councilman Atkins and carried. NEW BUSINESS: 7. RESOLUTION NO. 77 -1697: Calling for General Municipal Election on April 11, 1978. Councilman Greenberg moved to adopt Resolution. No. 77 -1697 A RESOLU- TION OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 11TH DAY OF APRIL, 1978, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE CHARTER OF THE CITY OF TEMPLE CITY, seconded by Councilman Atkins and carried. Council Minutes, December 20, 1977 -- Page 2 8. RESOLUTION NO, 77 -1698, Requesting the Board of Supervisors to Permit the Registrar of Voters to render services to the City for the. General Municipal Election on April 11, 1978. Councilman Atkins moved to adopt Resolution No, 77 -1698 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO PERMIT THE REGISTRAR OF VOTERS OF SAID COUNTY TO RENDER SPECIFIED SERVICES TO THE CITY OF TEMPLE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 11, 1978, seconded by Councilman Greenberg and carried. 9. RESOLUTION NO. 77 -1699; EMPLOYMENT OF PERSONNEL Councilman Tyreil moved to adopt Resolution 77 -1699 A RESOLUTION OF THE CITY COUNCIL APPOINTING PERSONNEL, seconded by Councilman Dennis and carried, 10. RESOLUTION NO. 77 -1700: WARRANTS & DEMANDS, DEMAND NOS. 8135 THRU 8247 IN THE AMOUNT OF $87,876.57. Councilman Dennis moved to adopt Resolution No. 77 -1700 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $87,876.57, DEMAND NOS. 8135 THRU 8247, seconded by Councilman Atkins and carried, Councilman Greenberg noting his non-participation with regard to check number 8223. 11. COMMUNICATIONS: There were no communications. 12. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: The City Council recessed at 7 :38 p.m. to meet as the Community Redevelop- ment Agency, all members being present; approved the minutes of the regular meeting held December 6, as corrected; approved Recognition Agreement with K -mart Corporation subject to guarantee of obligations; and adopted resolution approving warrants and demands. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL. 13. MATTERS FROM CITY OFFICIALS: A. Recognition Agreement City Manager Koski stated that K- -mart, in connection with obtaining permanent. financing for their Temple City store, has requested the City to enter into a Recognition Agreement whereby K -mart Enterprises would assume the obligations of the operator under the agreement with. the City, and that the Agency recognize K -mart Enter- prises for purposes of the Option, Maintenance and Management Agreement covenants as amended. Under the Agreement, K -mart Enterprises would assume all obligations under both the City and Agency agreements for operation of the parking facilities so long as the K -mart lease is in effect. Councilman Greenberg moved to approve the Recognition Agreement with K -mart Enterprises subject to a guarantee of obligations of K -mart Corporation, seconded by Councilman Atkins and carried. B. Communications Equipment. City Manager Koski presented background information stating that in the 1977 -78 budget, City Council authorized $6,593 for the pur- chase of new radio equipment on the high band range to replace radios purchased when the radio system was originally. installed.. Staff solicited proposals from two major manufacturers, Motorola. and General Electric, 1 Council Minutes.,, December 20, L977 Page 3 Motorola's unit cost for a 45 -watt radio is $766; General Electric's unit cost for a 35 -watt. radio is $811.50. Additionally, a base station will be extended to the Pentland Yard facility and requires installation. of a remote. radio desk set. Motorola's quote for this item is $326, Councilman Atkins moved to authorize the purchase of six 45 -watt radios and one desk. set from Motorola in the amount of $4,922, seconded by Councilman Tyrell and carried, C. Disposition of Surplus Property The Council received and filed a memo regarding the disposition of surplus property at Pentland Yard. D. Local Transportation System City Council received staff memo dated December 19, 1977 regarding a local transportation system and referred the matter to a future Study Session, E. Councilman Tyrell directed Council's attention to a communica- tion received from Citizens for Effective Death Penalty... The letter listed crimes for which the death penalty was not imposed and for which the commi.tt.e.e felt it should be imposed.. F. Councilman. Dennis distributed copies of a memo regarding expansion of legislation to allow preservation of open spaces for non - profit organizations. G. Mayor Merritt stated he had received a letter from Supervisor Schabarum regarding the installation of a traffic signal at the intersection of Temple City Boulevard and Camino Real. The County is agreeable to the cooperative project with an estimated cost of $30,000 to be shared equally between the City and the County. City Council approved Temple City's participation in this project and requested the Mayor to communicate Council's desire to Super- visor Schabarum. 14. ADJOURNMENT: On motion by Councilman Tyrell, seconded by Councilman Greenberg, meeting adjourned at 7055 p.m. Next regular meeting of the City Council will be held Tuesday, January 3, 1978, 7 :30 p.m. in the Council Chamber of the City Hall.
