A RESOLUTION OF THE CITY OF LYNWOOD EXTENDING THE TERM OF A
FRANCHISE WITH AMERICAN CABLESYSTEMS OF CALIFORNIA, INC., AT&T
BROADBAND ON A MONTH-TO-MONTH BASIS PENDING COMPLETION OF
NEGOTIATIONS FOR A FRANCHISE RENEWAL
WHEREAS, MediaOne of Los Angeles, Inc. ("Franchisee") is the
duly authorized holder of a franchise, as amended, granted by the City of
Lynwood (the "City"), authorizing franchisee to operate, and maintain a
'~, cable television system wrthm the City; and
WHEREAS, the existing cable franchise is schedule to expire on
April.l6, 2002; and
WHEREAS, additional time is needed to complete informal
negotiations for renewal of the franchise; and
WHEREAS, during the negotiation period the City desires to
secure certain benefits and protections provided for in the franchise
agreement by extending the term of that agreement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF LYNWOOD, CALIFORNIA, DOES RESOLVE, DETERMINE
AND ORDER AS FOLLOWS:
SECTON 1. The Council finds that additional time is needed to
negotiate renewal of the cable franchise.
SECTION 2. The term of the franchise agreement between
Franchisee and the City is extended to until such time as a renewed cable
t.,_ franchise agreement is effective, or until either party sends a thirty day
written notice to the other of its intent to terminate the extension.
SECTION 3. Both the City and Franchisee continue to reserve all
rights under the formal franchise renewal procedures set forth in 47
U.S.C.A. § 546, and do not waive any rights related thereto.
SECTION 4. This Resolution shall be in full force and effect
upon adoption.
