ESOLUTION GRANTING A VARIANCE TO
BERNARD ROSKOP TO PERMIT DEVELOPMENT
AT 3082 HIGHWAY 55
WHEREAS, Bernard Roskop, ("applicant") has applied for
a variance to the provisions of Section XVI of the Medina
Individual Sewage Treatment and Disposal Systems Code to
permit development of his property; and
WHEREAS, a variance to Section XVI of the Medina
Individual Sewage Treatment and Disposal Systems Code may
be issued to the applicant because the ordinance imposes
the following undue hardship to the applicant in the use
of the land:
1. The shape and location of the lot prohibits
acquiring additional property with suitable soils.
and
WHEREAS, the granting of the variance requested will not
confer on the applicant any special privilege that is denied
to owners of other lands, the variance will not be materially
detrimental to the purposes of the ordinance or neighboring
property, and the variance requested is the minimum variance
which will alleviate the hardship; and
WHEREAS, the applicant appeared at public hearings before
the Medina Planning Commission on March 13, 1984, and before
the Medina City Council on April 3, 1984.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Medina, that a variance to the provisions of
Sections XVI of the Medina Individual Sewage Treatment and
Disposal Systems Code is hereby granted subject to the
following terms and conditions:
(1.) Said development shall be in accordance with plans
submitted to the City of Medina on property legally
described as:
That part of Government Lot 1, Section 4.
Township 118 North Range 23 West of the
Fifth Principal Meridian, lying North of
the Northerly right of way line of State
Highway No. 55, EXCEPT that part of the
East 380 feet of the West 778 feet of
said Government Lot 1, lying South of the
North 300 feet of said Government Lot 1
and lying North of said Northerly right
of way line.
(2) The applicant shall comply with all provisions
of the Medina Zoning Ordinance.
BE IT FURTHER RESOLVED by the City Council of the City
of Medina that the violation of any of the foregoing conditions
is declared to be a violation of the Medina Zoning Ordinance
in accordance with Section 801.1 of the Zoning Ordinance.
