HomeMy Public PortalAbout1984-020Member a t-n5 b y moved its adoption: introduced the following resolution and CITY OF MEDINA RESOLUTION NO. !r4-,.719 ADDITIONAL VARIANCES AT DOCKSIDE WHEREAS, John M. Spaeth has requested approval of the addi- tion of second -story decks, 14 x 16 feet in size, on the town- houses constructed, or to be constructed, on lots 4, 5, 6 and 7, Dockside; and WHEREAS, the said decks would fall within the lakeshore setback on Lots 6 and 7; and WHEREAS, construction of the said decks would require amend- ments to the site and construction plans approved by the City Council on lots 4, 5, 6 and 7. NOW, THEREFORE, be it resolved by the City Council of the City of Medina as follows: 1. The City Council makes the following findings: a. In its approval of the Dockside the City approved 10 variances from various provisions of the Medina Zoning Ordinances. b. The said variance approvals were conditioned upon the development of the property in accordance with the site and building plans approved by the City, the plat approved by the City and the rezoning ap- proved by the City. c. The variances previously granted alleviated any hardship which may have existed. d. The applicant has not demonstrated changed circum- stances which would justify amendments to the con- ditions on which the original variances were granted or upon which additional variances are justified, or which justify amendments to the site and building plans. e. The applicant has not demonstrated that the build- ings and improvements, either existing or proposed, are unusable if constructed in accordance with the plans approved. f. The applicant states that the proposed decks may enhance the sale of the property, a fact which, if true, would not meet the standards for variance. 2. The concerns of the City Council expressed in many hearings and resolutions of the Planning Commission and City Council in 1980 and 1981, which include inter alia, density of popu- lation, mass and bulk of buildings, internal traffic, boats and storage, storm water runoff, lake setbacks, and compati- bility with single family dwelling neighborhoods, remain valid concerns today and the proposed amendments to the site and building plans offer no compensating reduction in inten- sity of use. BE IT FURTHER RESOLVED that the requested variances and amendment to the site and building plans are hereby denied.
