HomeMy Public PortalAbout1977-11-17 Special Meeting...19 NOVEMBER 17, 1977 A Special Meeting of the Bal Harbour Village Council was held Thursday, November 17, 1977 at 9:30 A.M. for the purpose of discussing the proposed Business District rezoning. Present: Messrs. Beatty, Davis, Krez, Pri.ntup and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan Gold, Village Attorney. Due to the large number present the meeting was recessed and reconvened in the auditorium of the Church By The Sea at 9:50 A.M. with the same officials present. Mr. Maley reviewed the Business District zoning from the incorporation of the village to the present, detailing the shopping center and other properties as they now stand. He also explained the parking requirements and what could be built under the present zoning ordinance; the 1962 variance for a one deck parking structure; the Kober study for the parking structure; and the hiring if Barton-Aschman Associates for a review of the entire Business District. Mr. Weyersburg introduced Mr. Allan Glasser, attorney, who represented the Bal Harbour Environmental Protective Association, Inc. Mr. Gold explained the building moratorium that was now in effect while the Business District is being studied by the consultants. After comments from the audience regarding the shopping center, Mr. John Lockner of Barton-Aschman discussed their report and recommendations explaining uses, site coverage, lot size for frontage, building heights, parking, landscape regulations, and floor area ratio or amount of gross floor area permitted in any one parcel. He explained that they were recommending controls over the land use not only .for today, but for the future. Mr. Kevin McNaughton of the Dade County Traffic Department explained to those present the plans for improvements to 96th. Street. After further discussion with interested parties present Mr. Paul, attorney for Bal Harbour Shops, asked if the council was going to recess for lunch inasmuch as Mr. Whitman had experts here to discuss the shopping center and their presentation would last about two hours. After objections from Mr. Glasser, Mr. Gold advised that it would be proper for the council to recess and hear Mr. Whitman's group after lunch as this was a public hearing on a legislative matter. It was moved by Mr. Davis, seconded by Mr. Krez and voted that the meeting be recessed until 2:00 P.M. The recessed meeting was called to order at 2:05 P.M. Present: Messrs. Davis, Krez, and Printup, Ms. Wetterer and Mr. Gold. Mr. Beatty arrived at the meeting at 2:20 P.M. and Mr. Maley at 2:10 P.M. Mr. Stanley Whitman explained that he wishes to complete the Shopping Center by increasing the Mall buildings which are now in existance to three stories, with the exception of a new structure behind building "B" and to add two more levels of parking above the existing deck. Presentations regarding the Bal Harbour Shops property were given by Mr. James Yarbourough on traffic impact; Mr. Herbert Johnson, regarding architectural plans; Mr. Kevin McNaughton on 96th Street traffic plans; Mr. Arnold Ramos on the overall traffic in Bal Harbour; Dr. Harold Garrish on air polution; Mr. Rick Miller regarding noise levels; Mr. Lovelace on the original plans for Bal Harbour and the Center; Mr. Howard Branston on lighting the garage and screening the cars in the garage; Mr. Bill Bozas on the landscaping of the Center; Mr. Red Langston on the structural foundations for the Center and garage. The above were questioned by the council and those present. Mr. Paul said Mr. Whitman had arranged for the parking staff to lock off the Park Drive portion of the garage at night and thanked the council for hearing the experts. Mr. Glasser asked if his clients would be heard at the November 29th council meeting, which the council agreed upon. Mr. Whitman said Mr. Glasser could have copies of any reports made for the Center that he wanted. Mr. Davis suggested that the Taxpayers Association should advise the council in writing as to their suggestions for the rezoning. Mr. Gold ordered a transcript of the meeting from one of the reporters present and said copies would be available to the interested parties, and become part of these minutes. There being no further business on motion of Mr. Davis, seconded by Mr. Krez, and voted the meeting was adjourned at 4:50 P.M.
