HomeMy Public PortalAbout1984-026Member. �PiS�{ introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. gl/' -26 RESOLUTION GRANTING A VARIANCE TO THOMAS DARNELL TO PERMIT CONSTRUCTION OF A GARAGE AT 705 HAMEL ROAD WHEREAS, Thomas Darnell ("applicant") has applied for a variance to the provisions of Section 605.5 of the Medina Zoning Ordinance to construct a barn; and WHEREAS, a variance to Section 605.5 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: Barn cannot be built to the rear of the property because of the steep slope of the property and WHEREAS, the granting of the variance requested will not confer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on April 10, 1984, and before the Medina City Council on May 1, 1984. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, that a 10 foot setback variance to the provisions of Section 605.5 of the Medina Zoning Ordinance is hereby granted subject to the following terms and conditions: (1) Said construction shall be in accordance with plans submitted to the City of Medina on property legally described as: That part of Lot 9, Auditor's Subdivision No. 241, Hennepin. County, Minnesota, described as follows: Beginning at a point where the east line of said Lot 9 intersects the centerline of County Road No. 9, (Hamel Road), said point being 1091.5 feet north from the Southeast corner of said Lot 9; thence southwesterly 125.0 feet along the centerline of said road; thence south parallel with the east line of said Lot 9 distant 348.5 feet; thence northeasterly parallel with the centerline of said County Road No. 9, distant 125.0 feet to the east line of said Lot 9; thence north to the point of beginning. (2) The applicant shall comply with all provisions of the Medina Zoning Ordinance. (3) Grading must be performed at site to accomodate water running off Hamel Road. Grading must meet the requirements of the City Engineer. BE IT FURTHER RESOLVED by the C.i.ty Council of the City of Medina that the violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance.
