ANNUAL TORN WARRANT
Barnstable, ss.
To Roland W. Bassett, Constable of the Town of Brewster
Greetings:
In the name of the Commonwealth of Massachusetts you are
hereby directed to notify and warn the inhabitants of Brewster
qualified to vote in Town affairs to meet at the Brewster School
Auditorium on Monday, the second day of ?:arch next at seven o'clock
in the evening, then and there to act on the following articles:
ARTICLE 1 . To act on the annual report of the Selectmen
and other Town Officers.
ARTICLE 2. To see if the Town will vote to authorize the
Town Treasurer, with the approval of the Selectmen,to borrow=
money from time to time in anticipation of the revenue of the
financial year beginning January 1 , 1971 and to issue a note or
notes, therefore, payable within one year, and to renew any note
or notes as may be given for a period of less than one year in
accordance with Section 17 of Chapter 44, General Laws as amended.
kRTICLE 3. To see if the Town will vote to appropriate a sutta
of money to the Reserve Fund.
ARTICLE 4. To hear the report of any special committee.
ARTICLE 5. To see if the Town will vote to fix the salary and
compensation of all elective officers of the Town as provided by
Section 108, Chapter 41 , General Laws as amended, for the year 1970,
to be effective January 1 , 1970.
ARTICLE 6. To see if the Town will vote to raise and approp-
riate such sums of money as may be deemed necessary to defray Town
charges and expenses for the year 1970.
ARTICLE 7. To see if the Town will vote to raise and approp-
riate or transfer from, unappropriated available funds in the treasury,
a sum of money for Chapter 81 , Highways.
ARTICLE 8. To see if the Town will vote to raise and approp-
riate or transfer from unappropriated available funds in the treasury,
a sum of money for Chapter 90, Highways.
ARTICLE 9. To see if the Town will vote to appropriate from
the Road Machinery Genera. Fund, the sawn of Thirty Five Hundred
Dollars ($3,500.00) to be used for the purchase, maintenance and
operation of Road Ea.chinery.
ARTICLE 10. To see if the Town will vote to transfer the sum
of Three Thousand Three Hundred Twenty Four Dollars and Twenty Five
Cents 4(3,324.25) from the Rands provided by Section 4, Chapter 768
of the Acts of 1969 to be used for resurfacing a portion of Long
Pond Road.
ARTICLE 11 . To see if the Town will assume liability in the
manner provided by Section 29 of Chapter 91 of the General Laves, as
amended by Chapter 516 and 524, Acts of 1950 for all damages that may
be incurred by wort to be performed by the Department of Public works
of Massachusetts for the improvement, development, maintenance and
protection_ of tidal and non-tidal rivers and streams, harbors, tide-
waters, foreshores and shores along a public beach outside Boston
Harbor, including the Merrimack and Connecticut Rivers, in accordance
with Section 11 of Chapter 91 of the General Saws, and authorize the
Selectmen to execute and deliver a bond of indemnity therefore to the
Commonwealth.
AaTICLE 12. To see if the Town will vote to transfer Nine
Thousand Dollars ($9,000.00) appropriated under Article 22 of the
1969 Annual Town Meeting,to be used to construct a new parking area
at the town owned beach at the end of Robbins Hill Rd. and adjacent
to the land of the Estate of Fannie E. Dugan and Gardiner W. Bassett
and to constr=ict a new section of Robbins Hill Rd, to said parking
area.
ARTICLE 13. To see if the Town will vote to authorize and
instruct the Town_ Treasurer to pay the Dog Tax returns from the
assessments of 1969 to the Brewster Ladies' Library Association in
accordance with Chapter 110, Section ?2.
ARTICLE 14. To see if the Town will vote to transfer from
available funds in the Treasury, the sum. of Five Hundred Dollars
($500.00). to the Brewster Ladies' Library Association.
ARTICLE 15. To see if the Town will vote to instruct the
Selectmen to contract for one year for Ambulance Service with the
Brewster, Orleans, Eastham. Ambulance association, Inc., and raise
and appropriate the sum of 'Three Thousand Five Hundred Dollars
(13,500.00) for this purpose.
ARTICLE 16. To see if the Torn will vote to raise and app-
ropriate the sum of Two Hundred Six and 801100 ($206.80) under the
provisions of Chapter 388, Acts of 1954 amended by Chapter 433 of 1955,
control of Greenhead Fly, and authorize the Town Treasurer to pay
said appropriation into the State Treasury.
ARTICLE 17. To see if the Town will vote to authorize the
Selectmen to purchase, take by eminent domain or otherwise acquire
an area of land adJacent to Freemans Way as shown on a plan entitled
"Plan of Lands in Brewster, Nass. as surveyed and mapped for the
Town of Brewster February 1970 Nickerson & Berger, Eastham, hSass.,€T
now on file with the Town} Clerk, said parcel containing 103.39 acres,
and raise and appropriate the sum of Seventy Four Thousand Sever.
Hundred Dollars ($?4,700.00) for such purpose and to determine
whether such appropriation shall be raised by taxation, by transfer
of available funds, by borrowing or otherwise and take any action
relative thereto.
AR'T'ICLE 18. To see if the Town will vote to amend the building
code by-law as follows: Section 9 - Requirements For All Buildings -
Paragraph 7, add the f olloNing sentence: Precast metal chimneys and
fireplaces may be used together as a unit if the unit and method of
installation is approved by the Building Inspector.
ARTICLE 19. To see if the Town will vote to amend the building
code by-law as follows: Section 3, Application For Building Permit,
add new paragraph 14 - No building permit shall be issued for con-
struction of any building if determination is made by the Building
inspector that flooding of any part of the building will occur
either from the underground water table or from the surface runoff
from streets and roads or from the overflowing of bogs, ponds, or
streams.
ARTICLE 20. To see if the Town will vote to amend the building
code by-lair as follows: Under Section 3 - Application for Building
Permit, add a paragraph as follows: Prior to the approval of the
Building Inspector for the excavation of a building site in the
vicinity of an operable cranberry bog, a percolation test shall be
made to determine whether the flooding of such bog will raise the
ground water level at the site above the basement level of the pro-
posed building. Issuance of a building permit shall be contingent
upon a negatiNs outcome of such a test.
ARTICLE 21 . To see if the Town will vote to raise and app-
ropriate the sum of One Thousand Dollars ($1 ,000.00) for repairs
and decorating the front stair area of the Town Hall.
ARTICLE 22. To see if the Town will vote to raise and
appropriate the sura of Five Hundred Twelve Dollars ($512-00) to
refinish the floor on the second floor auditorium of the Town Hall.

ARTICLE 23. To see if the Town will vote to establish a comm-
ittee to be known as the Municipal Water System Co mttee, to be app-
ointed by the Moderator and to consist of seven (7) members including
one each from Board of Selectmen, Planning Board and Board of Health,
said committee to be authorized to bring in warrant acticies for
either a special town meeting or the next annual town meeting, which-
ever is deemed most advantageous, to the Town and to raise and app-
ropriate the sure of Two Hundred Dollars ($200.00) for committee
ex o ens e s.
ARTICLE 24. To see if the Town will vote to install and
maintain a street light on pole No. 3 at Sheep gond Landing.
ARTICLE 25. To see if the Town will vote to raise and app-
ropriate the sum. of Eleven Hundred Dollars 01100.00) for a public
recreation program to be expended by the Board of Selectmen.
ARTICLE 26. To see if the Town will vote to raise and app-
ropriate a sum of money to purchase and equip a second Police
Cruiser.
ARTICLE 27. To see if the Town will vote to raise and app-
ropriate the sum of Eight Hundred and Fifty Dollars 0850.001
for the purchase of a two (2) band radio for the second Police
Cruiser.
ARTICLE 28. To see if the Town will vote to raise and app-
ropriate the sum of One Thousand Dollars ($1 ,000.00) for adver-
tising the advantages of the Token in accordance with the provisions
of Chapter 475, Acts of 1969.
ARTICLE 29. To see if the Town will vote to raise and app-
ropriate the sum of Two Thousand Dollars ($2000.00) to install a
drainage system at the junction of Alden Drive and Tubman Road.
ARTICLE 30. To see if the Town will raise and appropriate
the sum of Seven Thousand Five Hundred Dollars ($7500.00) for the
purpose of putting fluorescent lighting in the Brewster Elementary
School.
ARTICLE 31 . To see if the Town will vote to raise and app-
ropriate the sum. of Two Hundred Twelve Dollars ($212.00) to be
paid to the Cape Cod Mental Health Association under the direction
of the School Committee for services rendered or to be rendered to
citizens of the Town of Brewster at the dental Health Center under
_the provisions of Massachusetts General Laws, Chapter 40, Section
5, (40c).
ARTICLE 32. To see if the Town, will vote to raise and app-
ropriate, or expend from available funds the sum of Six Hundred
Dollars ($600.00) in accordance with the provisions of Chapter 114
of the General Laws for the maintenance and care of the following
so called Ancient Cemeteries. Dillingham Burying Ground, Lincoln
Foster Cemetery, Red. Top Graveyard, Sears Burying Ground and the
Old Burial Ground (north of the First Parish Church), funds to be
expended under the direction of the Superintendent of Public Works.
ARTICU 33. To see if the Town will vote to raise and app-
ropriate the stun of One Thousand Dollars ($1,000.00) to be used for
the propagation of shellfish, said money to be spent under the
direction of the Shellfish Constable and the Board of Selectmen.
ART!= 34. To see if the Town will vote to return the
following unexpended balance from Road Machinery Expense to the
Road Machinery Fund: Two Hundred Eighty Eight Dollars and 75/100
($288.75).
ARTICLE 35 . To see if Town will vote to raise and app-
ropriate a sum of money for meeting bills of prior year on the
unpaid bills .
RTICLE 36 . To see if the Town will vote to instruct the
Mderator to appoint a committee of five ( 5 ) to investigate the
possibilities of constructing a combination Fire-Police building ,
said committee shall include a member of the Board of Selectmen ,
the Fire Chief , Police Chief , and two ( 2 ) members at large , and
raise and appropriate the sum. of Two Hundred Dollars ( $200 . 00 ) to
cover expenses incurred by the committee .
ARTICLE 37 . To see if the Town will vote to request the -
Selectmen to layout the following roads : Red Top Road between.
Setucket and Slough Roads , Underpass Road and A . Percie Newcomb
Road between .Money Brook Road and Setucket Road and raise and
appropriate the sum of Four `11housand Eight Hundred Dollars ( 4500 . 00 )
for engineering purposes ,
ARTICLE 3 $ . To secs if the Town will vote to transfer the
