HomeMy Public PortalAbout1984-02849e ,., Member and moved its adoption: introduced the following resolution CITY OF MEDINA p RESOLUTION NO. 74- ';? o RESOLUTION GRANTING A VARIANCE TO LARRY GROTH TO PERMIT CONSTRUCTION OF A STORAGE GARAGE/OFFICE AT 775 TOWER DRIVE WHEREAS, LARRY GROTH, ("applicant") has applied for a variance to the provisions of Section 635.3 of the Medina Zoning Ordinance to construct a storage garage/office; and WHEREAS, a variance to Section 635.3 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: The lot was a previously platted small lot and strict enforcement of ordinance would significantly restrict use of the lot. and WHEREAS, the granting of the variance requested will not confer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on April 10, 1984, and before the Medina City Council on May 1, 1984. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, that a 20 foot front yard setback and 15 foot side yard and rear setback variances to the provisions of Section 635.3 of the Medina Zoning Ordinance are hereby granted subject to the following terms and conditions: (1) Said construction shall be in accordance with plans submitted to the City of Medina on property legally described as: Lot 3, Block 2, Medina Industrial Addition. (2) The applicant shall comply with all provisions of the Medina Zoning Ordinance. (3) The applicant will enter into the Development Contract attached hereto, said Development Contract to govern the terms and conditions of the construction. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance.
