,~~~~`~ A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD DENYING A .SPECIAL.
~" PERMIT FOR A DANCE HALL, NIGHTCLUB, AND
ENTERTAINMENT FOR PUPUSERIA LA RUMBA
RESTAURANT AT 3539 .MARTIN LUTHER KING
JR.- BOULEVARD, LN THE, CB-1 (CONTROLLED
BUSLNESS) ZONE, LYNWOOD, CALIFORNIA
WHEREAS, the Lynwood City Council, pursuant to law, bn March 5, 2002
conducted a hearing and denied the subject. application; and
WHEREAS, the Lynwood City Council, .pursuant to law on April 16, 2001.
conducted a hearing to consider a special permit .request for a dance hall and
entertainment; and
WHEREAS, the Lynwood City Council considered .all pertinent testimony offered
at such hearing; and
WHEREAS, Lynwood Municipal Code Section 4-8.8(d) requires that dance halls
-;; "'~~ and dancing clubs obtain a special permit to be approved by the City Council.; and
WHEREAS, Lynwood Municipal Code Section 4-19.2 requires establishments
that provide `live entertainment obtain a special permit to be approved tay the City
Council..
Section 1. The Lynwood City Council hereby finds and determines as follows
A. The applicant has violated provisions of°the Lynwood Municipal Code and
the California Building Code,, and is still in violation of such codes,.
B'. The applicant began improvements to the structure and operating the
business without authorization of licenses.
C. The proposed dance hall/nightclub- and entertainment are intense land
uses that may have significant negative impacts on properties in the
vicinity to include but not be limited to parking, traffic circulation, noise,
light, glare,. and public services.
D The dancing and entertainment permits held by Vasilio's Restaurant were
nonconforming and pursuant to .Lynwood Municipal Code Section 25-14
may not expand or be significantly altered.
._i E. An existing dance hall and. nightclub operates within Lynwood .Plaza. Two
(2) places of public assembly would not be compatible and intensify
existing negative impacts:
F. 'The City Council approved Zoning Ordinance Amendment No. 2002-01 to
permit dance halls, nightclubs and other places of public-assembly subject
to a conditional use permit and development standards. This application
does not comply with all development standards. '
G. The applicant previously had a restaurant/nightclub in the City of
Montebello. Montebello .planning staff did not. provide a positive .report..

and determinations, hereby denies a Special Permit for a dance hall and entertainment
