YV-3 ,2, RESOLUTION GRANTING A VARIANCE TO HARRY SIPE TO PERMIT CONSTRUCTION OF A BARN AT 3985 COUNTY ROAD 19 WHEREAS, Harry Sipe ("applicant") has applied for a variance to the provisions of Section 605.5 of the Medina Zoning Ordinance to construct a barn; and WHEREAS, a variance to Section 605.5 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: 1. Said barn would be a replacement for a barn destroyed by a storm. 2. Placement of said barn in accordance with plans submitted to the City is consistent with the location of other structures in the surrounding area. 3. The barn cannot be built to the south of the proposed location because of the slope of the property. and WHEREAS, the granting of the variance requested will not confer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on January 10, 1984, and before the Medina City Council on February 7, 1984. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, that a 60 foot setback variance to the provisions of Section 605.5 of the Medina Zoning Ordinance is hereby granted subject to the following terms and conditions: (1) Said construction shall be in accordance with plans submitted to the City of Medina on property legally described as: (See legal attached). (2) The applicant shall comply with all provisions of the Medina Zoning Ordinance. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance.
