J i 3 .y RESOLUTION GRANTING CONDITIONAL USE PERMIT AND VARIANCE TO JACK MACULA WHEREAS, Jack Macula ("Applicant") has applied for a conditional use permit and variance to construct a building to house his auto machine shop and a rental unit at 3566 Pinto Drive; and WHEREAS, a conditional use permit is required by the Medina Zoning Ordinance for the construction of said building; and WHEREAS, a variance to Section 635.3 of the Medina Zoning Ordinance may be issued to the applicant because the ordinance imposes the following undue hardship to the applicant in the use of the land: 1. The variance will permit the proposed building to align with an adjacent building on neighboring property. 2. The lot was created prior to the enactment of the Medina Zoning Code and was a previously small lot. WHEREAS, the construction of said building will not impede the normal and orderly development of the property in the area and the granting of the variance will not confer on the applicant any special privilege that is denied to owners of other lands, will not be materially detrimental to the purposes of the ordinance or neighboring property, and the variance is the minimum variance which will alleviate the hardship. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, that a conditional use permit and a variance to the provisions of Section 635.3 of the Medina Zoning ordinance is hereby granted subject to the following terms and conditions: 1. That Lot 4 and 5, Block 2, Medina Industrial Addition be combined for development purposes. 2. That said construction shall conform in all respects to plans submitted to the City of Medina, to the minutes of the City Council at which the application for a conditional use and variance was considered, and to the Medina Zoning Ordinance on property legally described as: Lots 4 and 5, Block 2, Medina Industrial Addition. 3. That the variance to Section 635.3 of the Medina Zoning Ordinance shall permit construction no closer than 30 feet from the front lot line and no closer than 15 feet from the rear lot line. 4. That the applicant will enter into the Development Contract attached hereto, said Development Contract to govern the terms and conditions of the construction. 5. That the driveway access to Pinto Drive from the property will be located in accordance with plans submitted to and approved by the City Engineer. 6. The applicant will grant to the City of Medina a perpetual easement over the west seven feet of Lots 4 and 5, Block 2, Medina Industrial Addition for road and utility purposes on Pinto Drive. 7. That no outside storage of auto parts or other business machinery will be allowed. The hours of operation for said building shall be limited to 7:30 a.m. to 6;00 p.m., six days per week, Monday through Saturday. 8. The applicant will landscape said property in a manner in accordance with plans submitted to and approved by the City of Medina. ` Dated: 9 Lille .5 , 19 �T.
