Subject: Resolution Regarding Liquor License Special Legislation
As indicated in the attached minutes,the joint sub committees of Economic Development
and Planning, Rules and Ordinances, and Public Safety, met on December 2 and December
18, 2014 to discuss requesting special legislation to expand the number of liquor licenses
available in Watertown. A number of issues were addressed,including how to distribute
the licenses, mapping of areas,value of existing licenses, fees, and draft legislative
language.
Also attached are the minutes of the March 10, 2015 meeting of the Honorable Town
Council,where a motion was approved to forward a request for special legislation to our
delegation that would allow for the granting of 15 additional liquor licenses. As is noted in
the attached resolution R-2015-7A,the Honorable Town Council specified that the General
Court may make clerical or editorial changes of form only, unless approved by the Town
Council prior to enactment.
The General Court has made changes to the Special Act,as indicated in the attachments.
The attachments include a draft resolution for Town Council consideration,which includes
both the original and proposed language (the form as specified by the General Court) and a
redline version of the changes made.
I don't believe any of these changes are substantive and maintain the legislative intent of
the Honorable Town Council. I would also be happy to respond to any particular questions
that may arise.
Therefore, I would request favorable action by the Town Council on this resolution,which
will then be forwarded to our delegation for their final action.

Excerpt from March 10, 2015 Town Council Minutes
Joint subcommittees of Rules and Ordinances; Public Safety; and Economic Development and
Planning report; and action on special legislation; Map Request Area; Map Site Specific—
Kenneth Woodland, Susan Falkoff and Stephen Corbett, Chairs. Vice President Corbett read the
committee report.
Councilor Lenk moved to accept the report, seconded by Councilor Woodland.
Councilor Falkoff asked to amend the report to note that the discussion was postponed from
January 13th until tonight.
The report was adopted by unanimous voice vote as amended with Councilors Aaron Dushku,
Susan G. Falkoff, Anthony Palomba, Angeline B. Kounelis, Cecilia Lenk, Vincent J. Piccirilli,
Jr., Kenneth M. Woodland,Vice President Stephen P, Corbett and Council President Mark S.
Sideris voting in the affirmative.
Councilor Piccirilli recused himself from the vote and left the room as he stated that he is
serving as a board member on an entity that may benefit from this vote.
Mr. Magoon reviewed the special legislation.
Councilor Woodland stated that the goal of the committee was to maintain the value and equity
of the current licenses that are available and to make sure that the accidental market that was
created by the post 1930 environment didn't hurt business owners.
Councilor Dushku spoke in support of Bring Your Own Bottles and clarified a misunderstanding
around that. Samples ordinances will be discussed on April 21st.
Councilor Dushku proposed an amendment to the language; to take the license for 311 Arsenal
Street and put it in another category.
Mr. Magoon suggested to list 4 for specific purposes and make 11 licenses for economic
development purposes instead of 10.
Councilor Lenk stated that she would like to see the 11 licenses be unspecified.
Councilor Dushku moved the special act to state legislature as amended, seconded by Councilor
Woodland and adopted by unanimous roll call vote with Councilors Aaron Dushku, Susan G.
Falkoff,Anthony Palomba, Angeline B. Kounelis, Cecilia Lenk, Kenneth M. Woodland,Vice
President Stephen P. Corbett and Council President Mark S. Sideris voting in the affirmative. It
is noted that Councilor Piccirilli had left the room and recused himself from participation
and the vote.10

I. December 2, 2014
Attending were Committee members Stephen P.Corbett,Aaron Dushku, Susan Falkoff,and
Vincent Piccirilli, Also present were Attorney Doneski ofKopelman&Paige, Council President
Sideris; Councilor Palomba; Planning Director Steve Magoon; Sgt Grady of the Watertown
Police,Donna Doucette,Licensing Board Chair,Donna Gill,Licensing Board Clerk, George
Newman,Licensing Board member,and Mike Athanamsorius from The W Pizza.
The purpose of the meeting was to continue discussing the possibility of petitioning the state
legislature for additional liquor licenses. Councilor Corbett chaired the meeting and began by
summarizing the October 27 meeting of these committees.
He listed the following unresolved issues. The outcome of each issue is noted in bold type.
1. How will additional licenses be distributed?The option of a lottery was taken off the
table and a decision was made to recommend that the distribution method be
determined through Rules established after a Home Rule petition is approved by the
Council and then the Legislature. The potential role of the Licensing Board in
distribution was discussed.
2. What would be the amount of the fee,and who determines this? Attorney Donesk said
that Town Council could be empowered to set the fee but the legislation should
reference the criteria that will be used to determine the amount.The Committee
discussed creating a mechanism that would equate the cost of a current license and
the average life span of a restaurant in Watertown. Ms Doucette said that the value
of current licenses is between ten thousand and seventy-five thousand dollars.
3. How will the fee be used? Attorney Doneski suggested the legislature would look
favorably on the creation of a special fund for neighborhood development.If the use
is not specified,the money automatically goes to the General Fund.Although new
development will add additional burden to the General Fund, (police,health
inspections,etc.),these costs would presumably be covered by the additional
revenue from economic development.
4. Are the boundaries of"Watertown Square"and the"Coolidge Square Business District'
sufficiently well-defined? Likewise,are the boundaries of the five economic
development areas clear enough? Would it be better not to list them by name but only
keep the reference to the Strategic Framework?Steve Magoon will work on defining
the boundaries with accuracy.
5. What about the Watertown Mall? Would it be better to replace the"Mall Project'with
"The 1-1 District?"Since the I-1 district includes both malls,this wording was
preferred,and Mr.Magoon will provide mapping for the next discussion.
Ms Doucette provided the committees with information about how the Licensing Board makes
decisions. They consider
• Site suitability. This would not be relevant to the licenses that are designated for
particular sites.
• Whether the intended use is in the Public Good. By making the request of the legislature,
the Council would have already identified the additional licenses as a benefit to the
community.
• The applicant's character and fiscal stability. This would be the main consideration with
the new licenses.
The committees expressed the wish to make the new license granting system fair to existing
license-holders. Ms. Doucette stated her belief that there would be no way to create a system that
would maintain the full value of existing licenses since a large part of their value resides in the
fact that the number is limited. She also noted that due to population decrease,we have one more
license than we are allowed and if a current license is turned back to the town,it will be lost.
Mr. Magoon will work with Attorney Doneski to further refine the language in the Draft Home
Rule Petition with associated maps.
Councilor Dushku again mentioned a Bring Your Own(BYO)option. Ms. Doucette said that she
thinks BYO regulations are"an enforcement headache." The committees decided to table this
issue for a future discussion once we have had an opportunity to review some sample rules or
ordinances from other communities.
II. December 18, 2014
The committees reconvened. The attendees were Committee members Steven Corbett,Aaron
Dushku, Susan Falkoff, Vincent Piccirilli and Kenneth Woodland; Council President Sideris,
Councilor Palomba,Planning Director Steven Magoon,Licensing Board Clerk Donna Gill, Sgt
Grady of the Watertown Police Department,Attorney Doneski,and Charlie Breitrose of the
Watertown News.
The committees reviewed two maps, one with the specific addresses that have been approved and
a second showing the target areas. The committee members recommended that both be included
with the Home Rule Petition. The committee members also reviewed changes to the draft
Petition that were submitted by Attorney Doneski,and suggested some minor revisions to further
clarify that these licenses cannot be sold,that they will be for All Alcohol,and additional
language related to the addresses of the approved sites.The attorney will make these changes and
a Draft Final will be presented to the Town Council at the March 101 meeting.

1 for premises located at 311 Arsenal Street and known as"Arsenal on the Charles,"for a restaurant use
within the complex.
The following 10 licenses for economic development purposes,as follows:
A maximum of 2 licenses for premises located within the Watertown Square or Coolidge Square area,
the boundaries of which shall be as shown on a map entitled"Watertown Proposed Liquor License Area
Locations,'dated December,2014,a copy of which is on file in the office of the Watertown town clerk;
A minimum of least 1 license for premises located within the West End Riverfront area of Pleasant
Street,as defined by the Strategic Framework for Economic Development adopted by the Watertown
Town Council in August of 2011,and also shown on a map entitled "Watertown Proposed Liquor License
Area Locations,"dated December, 2014, a copy of which is on file in the office of the Watertown town
clerk;
The other licenses for premises located within the areas of the Arsenal Mall and the Watertown Mall,
the boundaries of which shall be as shown on said map entitled "Watertown Proposed Liquor License
Area Locations,"and the five economic development target areas defined by said Strategic Framework
for Economic Development,and also shown on said map.
(b) Once a license is granted pursuant to this act,the licensing authority shall not approve the transfer
of such license to any other location, but it may grant the license to a new applicant at the same location
if the applicant files with the licensing authority a letter from the department of revenue indicating that
the license is in good standing with the department and that all applicable taxes have been paid. No
license granted hereunder may be sold or otherwise transferred for financial consideration;and the
granting of a license to a new applicant,as provided for herein,shall be the sole method by which a
license holder may be changed.
(c) Notwithstanding said section 12 of said chapter 138,the licenses authorized by this act shall be
subject to a supplemental annual fee,to be set by the town council, in addition to the annual fee for
existing alcoholic beverage licenses in the Town of Watertown, but not to exceed two times the amount
payable for such an existing license for the applicable license year. The additional revenue from these

fees shall be deposited into an economic development account in the Town of Watertown and be
expended consistent with the purposes of that account.
(d) If a license granted under this act is cancelled, revoked or no longer in use, it shall be returned
physically,with all legal rights, privileges and restrictions pertaining thereto,to"the licensing authority
and the licensing authority may then grant the license to a new applicant under the same conditions as
specified under this act.
SECTION 2.This act shall take effect upon its passage.

changes of form only to the proposed special act, unless the Town Council approves
amendments prior to enactment by the General Court.

grant the license to a new applicant under the same conditions as specified under
this act.
SECTION 2. This act shall take effect upon its passage.
AND WHEREAS,the General Court offered an amended version of the special act
authorized by the Town Council of the City known as the Town of Watertown, as
follows:
SECTION 1. (a) For purposes of this act,the word"map" shall refer to the map
entitled"Watertown Proposed Liquor License Area Locations,"dated December,
2014, a copy of which is on file in the office of the town clerk.
(b)Notwithstanding section 17 of chapter 138 of the General Laws or any other
general or special law to the contrary, the licensing authority of the town of
Watertown may grant 15 additional licenses for the sale of all alcoholic beverages
to be drunk on the premises under section 12 of said chapter 138, subject to the
following conditions:
(1) One license may be granted to each of the following 4 locations:
(a)the premises located at 321 Arsenal street, currently the Arsenal Center for the
Arts;
(b)the approved project located at 202 Arsenal street, for restaurant use;
(c)the approved project located at 570 Arsenal street, for hotel use;
(d) for the approved project located at 60 Howard street, for restaurant use.
(2)No more than 2 licenses may be granted to establishments located within the
Watertown square or Coolidge square area, the boundaries of which are shown on
the map.
(3) One or more licenses may be granted to establishments located within the West
End Riverfront area, the boundaries of which are shown on the map.
(4)No more than 8 licenses may be granted to establishments located within the
Arsenal Corridor Regional Malls area, the South Square area, the Union Market
area,the Arsenal North area, and the Coolidge Hill area, the boundaries of which
are shown on the map.
(c) The licenses issued pursuant to subsection (b) shall be subject to all of said
chapter 138 except said section 17.
SECTION 2. (a)No license granted pursuant to this act may be sold or otherwise
transferred for financial consideration.
(b) If a license granted under this act is cancelled,revoked or no longer in use, it
shall be returned physically, with all legal rights, privileges and restrictions
pertaining thereto, to the licensing authority and the licensing authority may then
grant the license to a new applicant under the same conditions as specified under
this act provided that the applicant files with the licensing authority a letter from
the department of revenue and a letter from the department of unemployment
assistance indicating that the license is in good standing with those departments
and that all applicable taxes, fees and contributions have been paid. The granting of
a license to a new applicant pursuant to this subsection shall be the sole method by
which a holder of a license granted pursuant to section 1 may be changed.
SECTION 3.Notwithstanding said section 12 of said chapter 138, the licenses
authorized by this act shall be subject to a supplemental annual fee, to be set by the
town council, in addition to the annual fee for existing alcoholic beverage licenses
in the town of Watertown,but not to exceed 2 times the amount payable for such
an existing license for the applicable license year. The additional revenue from
these fees shall be deposited into an economic development account in the town of
Watertown and be expended consistent with the put-poses of that account.
SECTION 4, This act shall take effect upon its passage.
NOW THEREFORE BE IT RESOLVED that the Town Council of the City known
as the Town of Watertown approves the special act as amended by the General Court.

b)Notwithstanding section 17 of chapter 138 of the General Laws or any other general
or special law to the contrary, the licensing authority of the Tow town of Watertown may grant
15 additional licenses for the sale of all alcoholic beverages to be drunk on the premises under
section 12 of said chapter 138, subject to the following conditions set forth this act

Ebj Once SECTION 2. (a No license is-granted pursuant to this act;may be sold or
otherwise transferred for financial consideration.

fbl If a license granted under this act is cancelled, revoked or no longer in use, it shall be
returned plrvsically, with all legal rights, privileges and restrictions pertaining thereto, to the
licensing authority shell not approve the transfer of such nee„se tee ether leeatie., but it
mayand the licensing authority may then grant the license to a new applicant atunder the same
1oe�n if the conditions as specified under this act provided that the applicant files with the
licensing authority a letter from the department of revenue and a letter from the denartment of
unemolovment assistance indicating that the license is in good standing with the department
those departments and that all applicable taxes, fees and contributions have been paid. -No

($)-SECTION 3. Notwithstanding said section 12 of said chapter 138,the licenses
authorized by this act shall be subject to a supplemental annual fee, to be set by the town council,
in addition to the annual fee for existing alcoholic beverage licenses in the Tow town of
Watertown, but not to exceed two2 times the amount payable for such an existing license for the
applicable license year.-The additional revenue from these fees shall be deposited into an
economic development account in the Tewntown of Watertown and be expended consistent with
the purposes of that account._
