CITY OF MEDINA
RESOLUTION NO. 0 V - 44
RESOLUTION GRANTING A VARIANCE TO
ARTHUR AND CHRISTINE HUAR TO PERMIT CONSTRUCTION OF RESIDENCE
AT 282 HAMEL ROAD
WHEREAS, Arthur and Christine Huar ("applicants") have applied
for a variance to the provisions of Section 625.3 of the
Medina Zoning Ordinance to permit construction of a residence; and
WHEREAS, a variance to Section 625.3 of the Medina
Zoning Ordinance may be issued to the applicants because the
ordinance imposes the following undue hardship to the -applicants
in the use of the land:
1. Stict adherence to the zoning ordinance would not
permit construction of a residence in a location so
as to be aligned with the residence at 282 Hamel Road.
and
WHEREAS, the granting of the variance requested will not
confer on the applicants any special privilege that is denied to
owners of other lands, the variance will not be materially detrimental
to the purposes of the ordinance or neighboring property, and the
variance requested is the minimum variance which will alleviate
the hardship; and
WHEREAS, the applicants appeared at public hearings before
the Medina Planning Commission on May 8, 1984, and before the
Medina City Council on June 5, 1984.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Medina, that a fifteen (15) foot front yard variance to
the provisions of Section 625.3 of the Medina Zoning Ordinance
is hereby granted subject to the following terms and conditions:
(1) Said construction shall be in accordance with plans
submitted to the City of Medina on the western parcel
of property legally described as: See legal attached.
(2) The applicant shall comply with all provisions of the
Medina Zoning Ordinance.
BE IT FURTHER RESOLVED by the city Council of the City of
Medina that the violation of any of the foregoing conditions is
declared to be a violation of the Medina Zoning Ordinance in
accordance with Section 801.1 of the Zoning Ordinance.
