HomeMy Public PortalAbout1984-072I -7 Member S a ekreA' introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. -„/ RESOLUTION GRANTING A FRONT YARD SETBACK VARIANCE TO WILLIAM AND SANDRA SLECK FOR CONSTRUCTION OF A DWELLING AT 1382 MAPLEWOOD WHEREAS, William and Sandra Sleck, hereinafter called the applicants, have requested a variance from Section 610.5 of the Medina Zoning Ordinance in order to construct a dwelling thirty (30) feet from the front lot line at 1382 Maplewood; WHEREAS, the alleged hardship involves the topography of the lot, the need to align the front of the dwelling with existing dwellings in the area, and the configuration of the front lot line; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA: 1. The granting of the variance will not give the applicant any special privilege that is denied to other owners of land in the area, the variance will not be detrimental to the purpose of the ordinance or neighboring property, and the variance re- quested is a minimum variance which will alleviate the hard- ship. BE IT FURTHER RESOLVED that the City Council of the City of Medina hereby grants a twenty -foot (20) front yard variance to the provisions of Section 610.5 of the Medina Zoning Ordinance subject to the following conditions: 1. The construction of the dwelling shall be in accordance with the plans submitted to the City Council applicable to Lot 1, Block 1, Medina Morningside Second Addition, Hennepin County; 2. The variance shall expire if the dwelling has not been substan- tially completed within one year (1) from the date of this resolution; 3. The applicant shall comply with all other provisions of the Medina Zoning Ordinance; 4. The said dwelling shall be constructed no less than thirty (30) feet from that part of the front lot line which lies northerly of the southerly sixteen (16) feet of the front lot line. IT IS FURTHER RESOLVED that a violation of any of the fore- going conditions is hereby declared to be in violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance. BE IT FURTHER RESOLVED that the approval of the variance is furhter conditioned upon the removal of the structure on the south property line on or before October 1, 1985.
