MEMORANDUM OF UNDERSTANDING
This MEMORANDUM OF UNDERSTANDING (the “MOU”) is made and entered into this ___
day of _____, 2017 in order to memorialize the terms of agreement between Grand Park
(hereinafter “Grand Park”) and The Town of Fraser, by and through its Fraser Board of
Trustees (hereinafter “Town”).
RECITALS:
WHEREAS, Grand Park is currently developing certain areas served by Old Victory
Road and Grand Park Drive; and
WHEREAS, such new development does not currently necessitate the need for public
improvements to Grand Park Drive and Old Victory Road; and
WHEREAS, the Town is providing public transit service via an intergovernmental
agreement with the Town of Winter Park and as part of such service desires to operate a route
along Old Victory Road and Grand Park Drive (see Exhibit A) to better serve the community.
NOW THEREFORE BE IT AGREED AS FOLLOWS:
RIGHTS AND OBLIGATIONS OF THE PARTIES:
1. Grand Park agrees to construct the roads identified by Exhibit A consistent with Grand
County unpaved street standards. This work will be completed prior to September 30,
2017.
2. Grand Park hereby provides the Town and its transit provider with access to operate on
the roads identified by Exhibit A.
3. The Town agrees to maintain the roads identified in Exhibit A in a passable condition.
This includes snow management and basic surface maintenance. Grand Park agrees to
repair any roadway failure or construction defect within ___ days.
4. The Town intends to provide transit service along this route, but makes no guarantee of
transit service as such relies on sufficient sales tax revenues and the Town currently
lacks an intergovernmental agreement with the Town of Winter Park (operator of the
system).
