HomeMy Public PortalAboutORD 15/03ORDINANCE NO. 15/3 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING THE DATE OF THE 2016 MUNICIPAL ELECTION FROM MARCH 8, 2016 TO MARCH 15,2016; PROVIDING A DATE FOR QUALIFYING FOR SUCH ELECTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Palm Beach County Supervisor of Elections has requested that all municipalities within Palm Beach County move the date of their municipal elections to March 15, 2016, the date of the Presidential primary, pursuant to a bill signed by Governor Scott on March 19, 2014; and WHEREAS, the Town of Gulf Stream Charter provides at Section 5.05, Elections, that Town elections shall be held on the second Tuesday in March, which would be March 8, 2016; and WHEREAS, it is necessary, in order to conform to the March 15, 2016 Presidential primary date as requested by the Supervisor of Elections, to amend, by ordinance, the date of the election in 2016; and WHEREAS, Florida Statute provides: "Notwithstanding any provision of local law or municipal charter, the governing body of a municipality may, by ordinance, move the date of any municipal election to a date concurrent with any statewide or countywide election. The dates for qualifying for the election moved by the passage of such ordinance shall be specifically provided for in the ordinance." NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS Section 1. The date of the Town's municipal election for March 2016 shall be amended to coincide with the date of the Presidential Primary which has been set for March 15, 2016. Candidates for the office of Town Commission shall be nominated for such office by the filing of a written notice of candidacy with the designated Town official no later than December 8 2015. 1 Section 2. All provisions of the Town Charter and the Town Code of Ordinances not in conflict with this ordinance shall remain in effect as set forth in the Town Charter and Town Code of Ordinances. Section 3. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 4. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 5. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 6. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
