GOV BOARD OF HEALTH MEETING WEDNESDAY JULY 19, 2017 AT 7 : OOPM TOWN HALL ROOM A Board members present : Carmen Scherzo, DVM , Chairman ; James Gallagher, Vice Chairman ; Joe Ford and Annette Graczewski, MT (ASCP ) Board members absent : Mary Chaffee, RN, PhD Others present : Nancy Ellis Ice, MPH, CHO, RS Health Director 1 . Chairman's announcements The VNA in conjunction with the Brewster Board of Health will be holding a Blood Pressure, Glucose and Cholesterol screening at the Brewster Ladies Library on July 25, 2017 from 10Am-2 : 00PM . The VNA is accepting appointments for the Shingles vaccination if you are 50 or older . Residents can call 508-957-7423 to request an appointment. Governor Baker has declared July 16-22 as Hurricane Preparedness Week . Dr . Scherzo spoke about making a plan for an emergency and about the shelters that are available . He also spoke about knowing which flood zone you are in . Cape Cod Health Care has restored the tick testing program for Barnstable County residents . O' Reilly & Assoc., Inc. — 27 George Darby Cartway — variance request from the Leaching Facility Setback regulation John O' Reilly and homeowner Murphy were present . Mr . O' Reilly stated that a septic inspection was done in June of 2017 and was in good working order with the exception of the SAS which is 178' from Upper Mill Pond . This is a 4 bedroom home on 40, 000 square feet that is for sale . There is a 7 . 7' separation from the bottom of the SAS to the adjusted groundwater . Groundwater flow is from Upper Mill pond to Lower Mill and Mr. O' Reilly believes that it goes in Northwest direction . Dr. Scherzo asked when the system was installed and if the home was seasonal or year round . Mr. O' Reilly stated it was installed in 1980 and the homeowner stated that it had been seasonal except for the last 2 years . Dr . Scherzo voiced his concern with the groundwater flow. He believes that it flows towards Upper Mill pond ( according to the Horsley Witten map) . He also stated that he believes there is a lot of phosphorus going into the pond and Upper Mill already has high phosphorus levels . Mr . Gallagher voiced his concern with the age of the system and the fact that it has a leaching pit and not a leaching field . He stated that the separation from the bottom of the SAS and groundwater is also a concern . Mr. Ford stated that he believed if they could move the system to another part of the lot that they should do that . Mrs . Graczewski also stated that she is concerned with the age of the system . Mr. O' Reilly stated that it appears that the home is no longer for sale and asked if a denial of this variance request would mean an automatic upgrade or could it wait until the sale of the property . The current system is also under the driveway. Dr. Scherzo spoke about the 319 grant and told the owner that it may be able to help him with the cost of a new system . Mr. O' Reilly requested to withdraw the variance request without prejudice . The Board accepted . 3 . J . M . O' Reilly & Assoc., Inc . — 8 Pine Pond Road — variance request from the Leaching Facility Setback regulation John O' Reilly was present . The property is currently for sale . The septic inspection showed that the system was in good working order with the exception of the SAS being 240' from Pine Pond . This is a shallow system . Groundwater is flowing from Pine Pond to Walkers Pond (which is 490' away ) . The SAS is 20-25' above the water table . This is a 3 bedroom home . Mr. Gallagher asked what the direction of the groundwater was . Mr. O' Reilly stated that it is Southeast from Pine Pond to Walkers Pond . Dr. Scherzo stated that the system was installed in 1992 and the drain field is smaller than what is allowed today . Mr . Gallagher stated he was supportive of this request because it is a leaching field, the lot size is limited and moving it would not really gain much . Motion : Finding that the groundwater flows away from Pine Pond and the septic inspection shows it in good working order, approve the variance request . Motion : Joe Ford Second : James Gallagher Vote : 4-0-0 Action : Motion carried 4. Peter & Ellen Marie Guidry — failure to renew Operation & Maintenance contract for 34 Captain Connolly Road = Mrs . Ice told the Board that the O & M contract had not been renewed . She stated that she did speak to the owners in November and they had stated that no one was living in the house but that they would be renewing the contract within 2 weeks . At this point the Health office has not received a copy of the contract. Mr . Gallagher asked if the fine part of the regulation that the Board has been working on was approved yet . Mrs . Ice stated that she was still waiting on Town Counsels review . Motion : Based on the non-compliance for greater than 6 months, issue an order the Guidry' s bring the system into compliance by contracting with a maintenance company or court action will be taken . Motion : Annette Graczewski Second : Joe Ford Vote : 4-0-0 Action : Motion carried 5 . Continued discussion on the proposed Small Wastewater Treatment Facilities regulation A list of the current small wastewater treatments facilities with their daily flow was given to the Board to look at so they could decide if they want to require the larger ones to still submit a yearly report to them before finalizing the regulation . Motion : Reach out to Town Counsel with the Board' s additional thoughts regarding their desire to provide oversight to systems that are over 10, 000 gallons and incorporate something in to the regulation about the Boards authority to still get reports for systems over 10, 000 gallons . Discuss Planning Board application for 420 Cranview Road It was explained that this is going to be a 60 X 100 agricultural building with an apartment on the second floor . Dr. Scherzo stated that the property was 23 acres Mr. Gallagher asked if there were bogs nearby . Dr. Scherzo stated that there are but on the other side of the road . Dr . Scherzo stated that if this truly is an agricultural building, Mass Agricultural can require a Nutrient Management Plan , Mrs . Ice stated that there will be a septic plan coming into the Health Department at some point and she will review and approve it . The Board would like to request that a Nutrient Management Plan be done . Mrs . Ice will relay this comment to the Planning Board , 7 . Discuss Planning Board application for Ocean Edge Dr. Scherzo spoke about this project and explained to the Board that the proposal includes using a system that was installed in 1986 but never used . It was installed in anticipation of future development. It is a 9000 gallon per day system . Mr. Gallagher asked if the plan was to re- use the system that is in the ground without any modifications . Dr. Scherzo stated that it was . Mr. O' Reilly was present and explained to the Board that this proposal if for work force housing for 84 individuals . The units that are going to be used are trailer shaped and they will be put on pillars on the property. The intent is to move them at some point to another location, so they will be temporary at this location . The anticipated usage will be about 4200 gallons per day . Mr. O' Reilly stated that in talking with DEP, they are asking them to discuss a possible ACO with the intent to become a Waste Water Treatment Facility. He stated that right now, in the eyes of the State, this is a temporary project . Mrs . Ice stated that the septic system would need to be inspected . Mr. O' Reilly stated that he is in the process of doing that now . Dr. Scherzo spoke about the potential for changes to the Small Waste Water Treatment Facilities regulation and how it would effect this project. Mr. Gallagher asked if this would have to come before the Board for approve and Mrs . Ice stated that it wouldn' t. Mr. O' Reilly stated that DEP is extending its reach with this project . Mr. Gallagher expressed concern with the amount of flow that will be going into this old of a system . Mrs . Ice stated that the system has never been used and is designed for 9000 gallons per day and should be fine . Mr. Gallagher stated that he would like to be in the loop with what DEP is doing with regards to this project. Mr. O' Reilly stated that the Board could ask DEP to allow their input before the ACO is finalized . Motion : The Board of Health requests that they see a draft of the ACO and will reserve their comments until they see it . If a draft isn' t possible, the Board would like to see the final copy before they comment (with regards to flow and treatment) prior to offering comments to the Planning Board for their issuance of a Special permit. The Board will also want to see a copy of the septic inspection report . Motion : Annette Graczewski Second : Joe Ford Vote : 4-0-0 Action : Motion carried BOH 7/19/2017 Minutes Page 4 8 . Discuss letter to Representative Sarah Peake re; Septic System Tax Credit for nitrogen limiting technology Dr. Scherzo spoke about how this came about. He spoke with Sean O' Brien from the County Health Department about expanding the tax credit for nitrogen removal technology system . Mr. O' Brien advised him to get in touch with Representative Sarah Peake , The Planning Board suggested that if the Board of Health was going to recommend this to send it to them and they may be on Board with it also . They also suggested copying the letter to Representative Tim Whalen also . Mrs . Graczewski voiced her concern with this , She is not sure that this is something that should be coming from the Board of Health . The Board agreed to table this discussion until the August 2"d meeting so the Board has time to digest the information . 9. Topics the Chairman did not anticipate Mr . Ford expressed his frustration about the lack of information to be prepared for the meetings . He spoke about the amount of emails that are forwarded . Mrs , Ice spoke about the Town's desire to go digital and that is why she emails things . She stated that if the Board wants hard copies, she would do that. Mrs. Graczewski suggested putting dates on the agenda of when emails were sent. Mr. Gallagher asked that plans are always copied and distributed to the Board . Informational items were noted .
