BOARD OF HEALTH MEETING
WEDNESDAY AUGUST 2 , 2017 AT 7 : OOPM
TOWN HALL, ROOM A
Board members present : Carmen Scherzo, DVM , Chairman ; James Gallagher, Vice Chairman ; Mary Chaffee, RN , PhD;
Joe Ford and Annette Graczewski . MT ( ASCP )

1 . Chairman' s announcements
On July 27P 2017, Dr . Scherzo spoke with George Heufelder, who informed him that the Barnstable county loan program
had expanded and will now include phosphorus removal technology installations .
2 . J . M . O' Reilly & Associates, Inc . — 71 Pine View Drive — variance request from the Leaching Facility Setback
regulation
John O ' Reilly, Engineer and Craig Scanzio, Real Estate Agent were present . This system was designed / installed in 1997
and inspected in July 2017 . The inspection conditionally passed because it was only 235 feet from pond . The system is
down gradient of the pond . There are wells in area and couldn 't move the sas any further away due to the proximity of
the well on the property .
Dr . Scherzo spoke about age of system , and that the lot was grandfathered to 3 bedroom because of the year,
Motion : Finding that the system cannot be relocated because of the well and the groundwater flow is down gradient,
approve the 65 foot variance request for 71 Pine View Drive .
Motion : Mary Chaffee Second : Joe Ford Vote : 5 -0-0 Action : Motion carried
3 . Clark Engineering — request for approval of an I /A system at 0 Long Pond Road
David Clark was present . The owner is seeking to construct a fitness facility . They need to show that nitrogen won' t
exceed 5ppm and in order to do that an I/A system is needed . 100 % in compliance with Title 5 Groundwater Protection
regulations . A Septi -tech system is proposed . What is not shown on plan is that they are going to provide 2 2 " lines for a
reserve in case a carbon source is needed . Alkalinity treatment is also included . This will be installed under a general
use permit .
Dr . Scherzo asked if a vent will be added to plan . Mr . Clark will add it to the plan and submit it to the Health Department
Dr . Scherzo spoke about the WQRC bylaw . No new altered or new spaces in the DCPC area should exceed 5ppm .
Dr . Chaffee asked what the perc rate was . Mr . Clark stated that it was less than 2 inches per minute . i

Mrs . Graczewski spoke about flow and asked what keeps this project out of the regular Title 5 gymnasium flow . Mr .
Clark stated that in his experience with fitness clubs, they don't really follow the gymnasium flow . He did call Brian
Dudley and his suggestion was to go with the country club flow . Mrs . Ice agreed with that . Mr . Clark stated that he
would be monitoring the water usage . Every 3 years proof of meeting 5ppm will be needed for WQRC .
Dr. Chaffee asked if based on the design flow, the system will be monitored 2 times a year. Mr. Clark stated that DEP
requires 4 times per year and after a certain time, the BOH can reduce that .
Motion : Approve the request for use of a Septi Tech system at 0 Long Pond Road as it meets the 5PPM standard

4 . Continued discussion on letter to Representative Sarah Peake re : Septic System Tax Credit for nitrogen
limiting technology (July 19, 2017 )
Mrs . Graczewski asked Dr . Scherzo if the intent of this letter was to give people credit for using an I /A system and if so,
why .
Dr . Scherzo stated that was the intent and the reason why is because it is a much larger expense and people are
reluctant to do the change . With this, people may do it sooner if they know they are getting a tax credit . It could be for
people who are putting in limiting phosphorus systems also .
Mrs . Graczewski stated that she is still not comfortable with this without looking into this more .
Dr. Chaffee stated that on cape there are 2 things available for people who have failed systems . The County program
and the tax credit . She asked Dr . Scherzo if what he wanted to do was broaden the scope for non -failed systems .
Mrs . Graczewski stated that the credit only applies to primary home in Brewster, so anyone that has a second home
wouldn 't be qualified for it .
Dr . Chaffee stated that while the intent is good , a better approach would be to request a meeting with Representatives
Peake and Whalen and bring a 1 page summary of the problem , and the solution . Provide a snapshot to them .
Mr . Gallagher stated that he was supportive of the concept and also of reaching out to the representatives .
Motion : Move to further explore the options for incenting property owners to improve the treatment of their systems .
Before going to representatives, check with other states/townsto see how they are handling this type of things . 5 yes .

This will be brought back before the Board at their work meeting in September .
5 . Discuss Septic Preservation Services past due inspection/sample compliance reports for 78 Old Red Top Road
and 65 Pells Fishing Road
Mrs . Ice wanted to bring this issue to the attention of the BOH . She would like to order them to comply . If they don 't,
fines or court action could be taken . The Board agreed with what Mrs . Ice would like to do .

6 . Discuss All Cape Environmental Inc. past due inspection/sample compliance report for 160 Old Red Top Road
Same request as #5
7 . Review and approve 6/21/ 17 minutes
There were a few minor changes .
Motion : Approve minutes as amended .
Motion : James Gallagher Second : Mary Chaffee Vote : 5 -0-0 Action : Motion carried
8 . Topics the Chairman did not anticipate
David Bennett was present looking for an extension for a previously issues variance at 298 Robbins Hill Road . Ben
Zhender, Attorney for homeowner was also present . They are requesting the extension be for 1 year for the system to
be completed . The installer has ordered the equipment and is ready to proceed but will not be done by the time the
permit expires .
Dr. Chaffee asked if there were any changes to construction plans . Mr. Bennett stated that he didn ' t believe so and that
any changes would have to be approved by CC . Mrs . Ice stated that the plans submitted to Health Department were the
same as before .
Dr. Chaffee asked what the expected construction start date was . Mr . Bennett stated that construction has really
already started with the demolition of house . Start of regular work would be after Labor Day .
Motion : grant a second 1 year extension of the variance approval
Motion : James Gallagher Second : Annette Graczewski Vote : 5 -0-0 Action : Motion carried
Mr . Gallagher informed the Board that he had taken a job as the Town of Brewster Assessor and resigned from Board .
This will be effective August 4 , 2017
