HomeMy Public PortalAbout1978-02-28 MeetingGOUNCIL MINUTES February 28, 1978 The Council of Bal Harbour Village met Tuesday, February 28, 1978 at 9:30 A.M. in the Village Hall. Present: Messrs. Beatty, Davis, Krez, Pri.ntup and Taplin Also present were Fred W. Maley, Village Manager; Mary T, Wetterer, Village Clerk; and Alan Gold, Village Attorney. Mr. Reeves, Village Engineer, explainedthe proposal of Fitzgerald Engineering Company to, conduct a television inspection and cleaning of storm sewers in the Residential District so that bids cound be taken to do the exten- sion work this summer. It was moved by Mr. Davis, seconded by Mr. Taplin and voted that up to S8,000.00 be allowed for this survey. On motion of Mr. Davis, seconded by Mr.. 'Krez and voted the agenda item concerning business permitted in the Ocean Front District was deferred unt.i.l. March 14, 1978 at the request of the attorneys from Longevity Center and Americana Hotel. Mr. Max Feldman, Councilman of Bay Harbor Islands requested that any negotiations undertaken with the City of Miami Beach be done only after a conference with the officials of the Towns concerned. Mr. Maley and Mr. Gold reported the status of the Business District zoning review covering the Barton-Aschman Report and the need for additional information. Mr. Gold said that revisions are necessary to update the regul- ations which should give the maximum limits of set backs, heights, etc. He also recommended that the regulations provide for a site plan review board, which should be done under contract with the Dade County Developmental Impact. Committee. Mr. Maley said it is his recommendation that all the reports we have to date be given to another specialist for final recommendations to council. Mr. Weyersberg presented reports from the Bal Harbour Environmental Protective Association Inc, regarding traffic and polution in the area, which was made a part of the record. Several letters were read from residents of the Village objecting to the proposed shopping center expansion. Col. Norris and Mr. Hoberman from Surfsi.de asked the council to also consider the impact, of expansion on neighboring communities. It was moved by Mr. Davis, seconded by Mr. Beatty and voted that Mr. Maley be granted the right to proceed with acquiring the service of an expert for a final review of the business district zoning and that Mr. Gold should consult with Dade County to see if they would be willing to contract with the Village for use of their Developmental Impact Committee. On motion of Mr. Davis, seconded by Mr. Taplin and voted the minutes of the previous meetings of January 31, 1978 and February 14, 1978 were approved as submitted. ORDINANCE NO. 199 granting the Southern Bell Telephone and Telegraph Company a thirty year franchise was read and on motion of Mr. Davis, seconded by Mr. Beatty and voted was adopted. - 2 - Mr. Gold read Ordinance No. 200, establishing rules and regulations for use of the public beach. On motion by Mr. Davis, seconded by Mr. Taplin and voted the Ordinance was passed on first reading. Discussion followed on the possible closing of the beach at night. Mr. Maley was asked to contact the hotels for their opinion on this matter. (Mr. Beatty was not present for the discussion following the vote) Mr. Whitman explained his offer to plant trees on Park Drive on the north side of his wall (Mr. Beatty returned at this point) and read letters from the Bal Harbour Club declining his offer. He also presented a petition from property owners requesting the trees be planted. Mr. Maley explained the Vober and Barton- Aschman landscaping recommendations. Mr. Weistead said he would go back to the Club Board of Directors after all other landscape recommendations have been met. Mr. McNaughton told the council that Phase 1 of the 96th Street improve- ments will be done this year with actual construction taking about six weeks after the schedule is approved by Surfside and Bal Harbour. The entire project will extend through the 1979 season. Mr. Dan Paul, attorney for the Bal Harbour Shops asked the council if the streets in the Residential District were public or private streets. The question of the closing of the access known as "Camden Drive extended" was also discussed and Mr. Gold said he would examine these issues. Miss bletterer explained that monies received under. the Federal Antirecession program must be encumbered within six months. After discussion, on motion of Mr. Davis, seconded by Mr. Taplin it was voted that all Federal Antirecession funds received during this fiscal year would be used for vacation replacement and temp- orary office personnel. Mr. Davis reported that as the Bal Harbour representative to the Dade County League of Cities, he had voted against supporting the rapid transit issue. Mr. Maley explained that Bay Harbor Islands needed formal assistance on their request to the Coast Guard for a change in the bridge closing hours. It was moved by Mr. Davis, seconded by Mr. Beatty, and voted that Mr. Maley send the Coast Guard a letter giving Bal Harbour's endorsement to the proposed bridge closing hours. Mr. Maley said action on the contract with the State for beach landscaping funds had been postponed until March 7th. He said he would like to issue a Purchase Order against the beach landscaping contract with Gaston Landscaping Company to start the test beds. On motion of Mr. Taplin, seconded by Mr. Davis and voted, Mr. Maley was authorized to issue the Purchase Order. On motion of Mr. Davis, seconded by Mr.. Xrez, the meeting was adjourned at 12:05 P.M.
