HomeMy Public PortalAbout20070910 specialSPECIAL COUNCIL MEETING SEPTEMBER 10, 2007 1 CALL TO ORDER The Special Council Meeting of September 10, 2007, was convened at 5:30 P.M. by Mayor John Landwehr. Prayer was offered by Councilman Ron Medin, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for the roll call: Present: Brown, Crane, Ferguson, Harvey, Klindt, Layton, Koon, Medin, and Penfold, and Smith Absent: None A quorum was declared present. Mayor John Landwehr stated although the item does not appear on the agenda, he believes the Council would like to allow citizens to make presentations from the gallery on the issue being considered tonight. He asked anyone who had not already signed up to indicate if they would like to be added to the list to speak. Councilman Brian Crane asked for an explanation of the reason for this special meeting. Mayor John Landwehr indicated that the Charter requires that if three Council Members request a Special Council meeting, the Mayor is obligated to comply by calling a meeting, but that there is no requirement that a reason for the meeting be given. He stated that four Council Members had requested this meeting. He stated that he may understand the reason is that the time frames established for the resolution of the Bassmann House issue would not have allowed sufficient time for the full process of any Mayoral vetoes and the subsequent opportunity for the Council to vote to override said veto if a special meeting had not occurred. PRESENTATIONS FROM THE GALLERY Mr. Glen Costales, 1904 Vieth Drive, stated he did not want to see $200,000 of taxpayers' money given away by allowing any of the three proposers to receive the property. Mr. Richard S. Groner, 1301 E. High Street, stated he is appearing as a citizen of the First Ward to ask his two Council representatives, Councilmen Ferguson and Harvey, to vote against giving away the Bassmann House property. Mr. Leonard Steinman, 110 N. Lincoln, stated he believes the Bassmann House should be preserved as an "oddity" that would attract tourists. SPECIAL COUNCIL MEETING SEPTEMBER 10, 2007 2 Mr. Mark Dudenhoeffer, 317 Manila Street, stated he believes the Historic City of Jefferson could do a good job preserving the house and he endorses their proposed plan to do so. Ms. Carrie Carroll, 916 Topaz Court, stated she wants to see something to buffer the parking garage in that area, and encouraged the Council to consider the overall issue of economic development of the downtown area. INFORMAL CALENDAR Bill 2007 -73, sponsored by Councilman Medin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH HISTORIC CITY OF JEFFERSON INC. Councilman Ron Medin requested that Bill 2007 -73 be removed from the Informal Calendar at this time. A motion was made by Councilman Ron Medin to accept the Substitute Bill 2007 -73 which had been distributed earlier this evening, seconded by Councilman Jim Penfold. Councilman Brian Crane asked if accepting a substitute would be allowed by previously enacted Ordinance 14230 pertaining to this issue. City Counselor Nathan Nickolaus stated that ordinance 14230 as written does not expressly prohibit a substitute. Mayor John Landwehr asked Mr. Nickolaus to explain the differences contained in this substitute from previous versions which have been distributed. Following Mr. Nickolaus's explanation, Councilman Kevin Brown asked him for his opinion regarding what he believes may be a personal financial interest in the case of two Council Members. City Counselor Nathan Nickolaus stated at this point in time, there is no conflict regarding the issue of a loan for the project as no loan agreement has been distributed. He further stated he believed that serving on the Board of the Historic City of Jefferson would not necessarily represent a financial benefit to anyone. At the conclusion of discussion, the motion to accept the substitute was passed by the following roll -call vote: Aye: Ferguson, Klindt, Koon, Layton, Medin, Penfold, and Smith Nay: Brown, Crane, and Harvey Councilman Brian Crane then made a motion to amend the Substitute Bill 2007 -73 by increasing the sum paid by the Historic Jefferson City from $1.00 per month to $8,000.00 per month, seconded by Councilman Mike Harvey. The motion was defeated by the following roll -call vote: Aye: Crane, Harvey, and Klindt Nay: Brown, Ferguson, Koon, Layton, Medin, Penfold, and Smith Following further discussion, Councilman Jim Penfold called for the question, seconded by Councilman Rich Koon, and approved unanimously. Bill 2007 -73 was then passed, as SPECIAL COUNCIL MEETING SEPTEMBER 10, 2007 3 substituted, by the following roll -call vote as Ordinance 14252: Aye: Ferguson, Koon, Layton, Medin, Penfold, and Smith Nay: Brown, Crane, Harvey, and Klindt Bill 2007 -74, sponsored by Councilman Medin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH RICHARD S. GRONER. Councilman Ron Medin requested that Bill 2007 -74 remain on the Informal Calendar at this time. Bill 2007 -75, sponsored by Councilman Medin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MARK DUDENHOEFFER. Councilman Ron Medin requested that Bill 2007 -75 remain on the Informal Calendar at this time. A motion was made by Councilman Brian Crane to remove Bill 2007 -75 from the Informal Calendar, seconded by Councilman Mike Harvey, and defeated by the following roll -call vote: Aye: Brown, Crane, Harvey, and Klindt Nay: Ferguson, Koon, Layton, Medin, Penfold, and Smith ADJOURNMENT There being no further business to come before the Council at this time, a motion was made by Councilman Jim Penfold for adjournment, seconded by Councilman Rich Koon, and approved unanimously at 6:30 P.M.
