Cherry, Christian Center, 5319 N Halifax Road.. 3. The Pledge of-Allegiance to the Flag was led by Mayor Merritt. 4 ROLL" CALL : Present: Councilmen- Atkins, Dennis, Greenberg, Tyrell, Merritt Absent-: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Planning. Director Dragicevich, Parks and Recreation Director Kobett, and Marie Evitt, Temple City Times 5, -APPROVAL OF MINUTES: Councilman Greenberg moved to approve the minutes of the regular City Council meeting held Tuesday March 21,:1978,.as written, seconded by Councilman Dennis and carried, Councilman. Tyrell abstaining. UNFINISHED BUSINESS: 6. ORDINANCE NO:r 78-463: AUTHORIZING BINGO :WITHIN CITY BOUNDARIES City Attorney Martin presented-Ordinance No.." 78 -463" AN ORDINANCE OF THE CITY OF TEMPLE CITY AUTHORI. ZING CERTAiN'BINGO GAMES WITHIN THE CITY BOUNDARIES for first reading. -by-title-only, Councilman Tyrell requested that. Section :4161 (j) provide an accounting be provided to the City upon - .requests; subsection (p) be corrected to add the words "be used to "; and subsections (f), (g), and (h) should have the word "or" inserted between non-profit and-charitable. Councilman Greenberg requested Subsection (k). have the sentence "The term of any such license shall .• be-for one year only" added. Councilman Greenberg stated the propostion on the-state ballot was not a vote allowing bingo but-rather it was to allow for local option whether to enact an ordinance allowing _:- bingo... Councilman Tyrell moved to waive further- reading:.- of._:Ordinance No, 78 -463 seconded by Councilman Atkins ...and-carried,-Councilman Greenberg having no objection to first reading by title only, and reserving the right to vote no on adoption of the ordinance, 7. PUBLIC HEARING .7:30 p.m_ •STREET.IMPROVEMENTS- FARAGO AVENUE _5300 BLOCK ..(Installation of Street Lights pursuant to Chapter 27, Improvement Act of-1911, Streets and Highways Code). Council Minutes, April 4, 1978 -Page 2 City Manager Koski. presented ,background information stating the City Council, at their regular .meeti.ng . he.id March. 7, 1978, set a public. hearing .this. evening .on petitions from property owners for th.e..i.ns.tallation._of_ .two 1,000 lumen lights on existing wood poles on ,the ea.st.:side..of Farago.Avenue,. 5300 block. The petition .represents ..7.3% of. the. front footage. of the..block; subsequent. to .the .setting...p.ublic.- hearing one absentee owner signed the petition whieh._now.. reflects 82% of the property owners All property owners have been notified of the public hearing pursuant to Chapter.27, The. Improvement. Act of 1911, There being no further staff report, Mayor Merritt declared the public hearing open and invited anyone wishing to speak to come forward. Roland Lanzi, 5316 Farago, spoke. in favor of lights on Farago, stating the street is very dark and unsafe. Mark Kaiser, 5529 Farago, stated he is in favor of the proposed lights; that there Is no lighting on the cul -de -sac and lights are needed for vehicle and pedestrian safety,. Wing Lee, 5330 Far.ago,st.ated he is in favor of the proposed lights in the 5300. block .of Farago, and also presented a letter from his neighbor.favoring_lightso Councilman Tyrell moved to make the letter a part of the records, seconded by Councilman..Greenberg and carried. There being no one else .come forward to speak, Councilman Tyrell moved to close the hearing, seconded by Councilman Atkins and carried. Councilman Atkins. moved.to certify a Categorical Exemption of Environmental Impact, seconded by Councilman Tyrell and carried. Councilman Dennis moved to.find the project to be in.the best public interest and .instruct the Superintendent. of Streets to cause the work to be accomplished, seconded by Councilman. Greenberg and carried. NEW BUSINESS 8. RECOMMENDATION FROM PLANNING..COMMI.SSION- Meeting of March 28, 1978 .AMENDMENT TO ZONING .CODE RELATING TO DEVELOPMENT STANDARDS FOR R -1 AND .R- 2:ZONED PROPERTIES. City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held March 28, 1978 adopted resolution.recouuuending.to the.City Council an amendment to the.Zoning.Code.r_eiati.n.g.to. development st.andards.in R -1 and R -.2 .zones_. At the present time the Zoning Code has a minimum floor area for new R -3 dwellings built. in R -1 and R72-zones. Councilman Tyrell moved to set public hearing May 2, 1978 to consider. Planning Commission recommendation, seconded by Councilman Greenberg and carried. 9 . RENEWAL OF RENTAL AGREEMENT: DAYTON I.NTERIORS, 5843 Temple City Blvd, City Manager Koski. presented proposed renewal rental agreement which reflects preliminary negotiations with.. the tenants at 5843 Temple . City. Boulevard,. .Modifications include an increase from. $300 to $400 per month, lease term to be for a period of three years, and the City to notify the lessee six months prior to the termination of the lease of its intention not II10. RESOLUTION N0, 78 -1720: ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION TO BE HELD APRIL 11, 1978 TO BE MADE BY THE CITY CLERK. Council Minutes, April 4; 1978 -Page to renegotiate Councilman Tyrell felt the City should -riot give notification of its intent not to renegotiate.the lease as a part of the agreement. City Attorney advised that was inconsistentwitb paragraph. Nine which provides for month to month tenancy for possession after the date of expiration, Councilman Tyrell moved to approve renewal of rental agreement with Dayton Interiors, with rental at $400 per month and lease term to be for a period of three years, seconded by Councilman Dennis and carried. Councilman Tyrell moved to adopt. Resolution No. 78 -1720 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ORDERING .THE CANVASS OF THE GENERAL MUNICIPAL ELECTLON TO BE HELD ON.THE'l1TH DAY OF APRIL, 1978,T0 BE MADE BY THE CITY CLERK OF THE CITY OF TEMPLE CITY, seconded by Councilman Atkins and carried. 11, RESOLUTION NO 78 -1721: WARRANTS & DEMANDS NOS. 8950 THRU 9060 IN THE AMOUNT OF $73,436.35 Councilman Atkins moved to' adopt Resolution No. 78 -1721 A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $73,436,35, DEMAND NOS. 8950 THRU 9060, seconded by Councilman Dennis: and carried, Councilman Greenberg noting his nonparticipation regarding check number' 9041. .12. COMMUNICATIONS A. San Gabriel Valley Humane Society Re: Terini.nation of Agreement City Manager Koski presented communication from San Gabriel Valley Humane Society formally notifying the City that the existing contract for Poundmaster services will be,term.nated as of April 30, 1978. Mr. Koski advised that a number of cities are meeting April 5 to discuss alternatives to pound services and a full report will be made to City Council, 13, TIME FOR THOSE IN THE AUDIENCE.WHO WISH TO SPEAK.: There was no one come forward to speak. RECESS TO CRA: The City Council recessed at 7:58 p.m., to meet as the Community Redevelop ment Agency, all members being present, and approved the minutes of the regular meeting.held March 21, 1978. Request for Authorization to Recruit. for Summer Recreation Program Council Minute.s,Apri.1 4, 1978- Page 4 City Manager Koski presented request, from the Parks and Recreation Director for authorization.to_begin recruiting for the summer recreation program prior to the appDpriati.on of the necessary funds as apart. of the 1978-79 budget. Councilman Tyrell moved to authorize recruitment for necessary personnel to conduct the Summer Recreation Program based on the Department's need to recruit competent part -time staff, seconded by Councilman Greenberg and. carried, B. Approval. of Agreement between American Little League Baseball of Temple City and City of Temple City - Athletic Field Lighting_.._ City Manager Koski. advised :.that .City Council, at their regular .meeting: held .. Don McGinnis,. 5812.Alessandro, one of the signators on the petition submitted, felt that .eliminating the. driveway onto Alessandro and constructing.a-'driveway onto Las.Tunas Drive. would.-alleviate the•.problema_ Mr. McGinnis stated.. the•problem is,wor.se during the summer months and some alternatives should be"- looked into now. F, Purchase of County Surplus Truck. City Manager. Koski advi.s.ed._the_Coun.ty has a surplus vehicle available which would be suitable for City needs. The vehicle is a 1967 11/2 ton. Ford stake bed truck. with. a 1/8" diamond plate bed and an 8 ton h.ydraulic.h.oist and purchase price is $1,500, Councilman_At.kins moved to authorize staff to purchase subject vehicle in the amount, of $1,.500, appropriate additional funds and amend the adopted budget, seconded by Councilman Dennis and carried. Go Temporary Salary Adjustment.. City Manager Koski advised that .Mrs. Marilyn Spoon has worked many hours. and has.shown.a.great.deai.of dedicated effort to keep the City's daily finance operation functioning during Joan Downey's illness, and recommended an interim salary. adjustment, Councilman Atkins moved to approve salary adjustment. for Marilyn Spoon, seconded by Councilman Tvrell and carried_ H. Councilman Greenberg presented_ a. copy of the proposed changes in by -laws which the .S.an.Gabriei .Valley Association of Cities will _. consider .April .20,- .1978,....In. Section 3 the word "initial" as it. pertains .to.. the - goals _.and_objections . of the association have been striken, _ and under-Section 3(a) . has . been added. "and to constantly review and monitor county government operation, representation and. philosophy . toward constructive reform thereof." I... Councilman Dennis reported. the League of California Cities, Los Angeles Division, will discuss Proposition 13 at their meeting .to.be. held .April_6, 1978, Councilman Dennis also commented on the excellent presentation on government paper work made _by.the City Manager. J. Councilman Tvrell suggested that some of the material received recently from WeTIP be disseminated to the residents through the newsletter.. K.. Mayor Merritt publicly thanked the Temple City JayCees for•conducting the Candidates Forum held April 3, 1978, 16, ADJOURNMENT On motion by Councilman Tyrell,.seconded by Councilman Dennis and carried, meeting adjourned at 8.30 p,m.
