The Council of Bad Harbour Village met Tuesday, March 14, 1978 at
9:30 A.M.; in the Village Hall.
Present: Messrs. Beatty, Davis, Krez and Printup
Absent: Mr. Taplin
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan Gold, Village Attorney.
Mr. Gold explained that under Bat. Harbour Village Code, Section 6-9a
(7a) the council, after hearing from all parties concerned, must consider
whether the Longevity Center operating at the Americana Hotel is a permitted
business activity in the oceanfront district. If not, they could consider
an amendment to permit this type of operation or decide what other action
they wish to take. He reviewed previous actions of the council regarding
business operations in the oceanfront district. Mr. James Sabatino, attorney
for the ,Americana Hotel, said that the Americana Hotel had not intended to
violate any ordinances. Mr. Joseph Weil, attorney for Dr. Wagner, spoke on
behalf of his client who claimed he had tried to locate his cardiac center
in Bal Harbour and was told by the hotels that this was not a permitted use.
Mr. Shepard Broad, attorney for the Longevity Center, and Mr. Arthur Breakstone,
owner of the Center, explained how the Center operates. After hearing from Dr.
Wagner who reviewed his attempts to locate in Bat. Harbour, Mr. `sold said each
case should be judged on its own merit. Dr. Lehr, explained the Priti.kin system,
which is being; used at this Longevity Center as opposed to the one which was
formerly operated in Orlando. It was moved by Mr. Davis, seconded by Mr. Beatty
and voted, (Mr.. Printup abstained due to a conflict of interest) that, the
Longevity Center could continue to operate pending receipt of the contracts
between the Center and the Americana Hotel and the Center's franchise from Mr.
Priti_ki.n for the council to study before a final decision is made at the March
28th meeting.
Mr. Maley said he had proposals from five firms to review the Business
District zoning. Presentations were made in person .for the firms of McHarg
Roberts and Todd, and James Duncan & Associates. Mr. Maley read proposals
from Charles Kober Associates and Reynolds, Smith and Hills. He noted that
the firm of Charles E. Cawthra did not have a staff sufficient for our needs.
After discussion, Mr, Maley told the council he was not ready to make a
recommendation, but would do so at the next meeting.
Mr. Gold suggested the council hold a special meeting to extend the
building moratorium inasmuch as the present resolution will expire on March
28th. It was moved by Mr. Davis, seconded by Mr. Beatty and voted that a
special meeting be held at 9:30 A.M., March 21sti 1978 for the purpose of con—
sidering an extension of the building moratorium in the Business District.
Mr. Maley said the Governor's Cabinet had approved the contract with
Bad Harbour for beach landscaping and asked for authority to execute the con—
tract with Gaston Landscaping Company.
It was moved by Mr. Davis, seconded b;; Mr. Krez and voted that thn proper
authorities be authorized to sign the contract.
On motion of Mr. Davis, seconded by Mr. Beatty, the meeting was adjourned
at 12:0 P.M.

A Special Meeting of the Bal Harbour Village Council was held Tuesday,
Marsha, 1978 at 9:30 A.M. in the Village Hall.
Present: Messrs. Davis, Krez, Printup and Taplin
Absent: Mr. Beatty
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and William Berger, representing the Village Attorney.
Mayor Printup said the purpose of this meeting was to consider an
extension of the building moratorium in the Business District. Mr. Maley
explained that the first moratorium began May 31, 1977 and had been extended
for professional review. This review is not complete or adequate in his and
Mr. Gold's opinion. Tt is on this basis that the manager is certifying to
the council that the need exists for an additional 120 day moratorium. Mr.
Maley then read

extending the moratorium for 120 days. Mr. Berger read Mr. Gold's legal
opinion and recommendation concerning an extension of the moratorium. Mr.
Veyersberg and Mrs. Rowe of the Bal Harbour Enviromental Protective Assoc—
iation requested that the moratorium be extended for 360 days to conduct an
polution study.
