Report of the
SPECIAL TOWN MEETING
June 20 , 1994
The Moderator , Stephen L . Doyle , announced that in the absence of a quorum
the Special Town Meeting would be held Tuesday , June 21 , 1994 at 7 : 00 p . m .
In accordance with the Warrant , the Special Town Meeting was held in the
Brewster Elementary School Cafetorium , Tuesday , June 21 , 1994 .
The meeting was called to order at 7 : 45 p . m . by the Moderator , Stephen L .
Doyle . The tellers were June Gallant , Ruth Hanlon , Althea E . Alling , Eleanor
H . Nielsen , and William S . Nielsen . The checkers were Helen Allen , Doris
Alm , Lois Curcio , Catherine Flaherty , Elizabeth Hardy , Dorothy Leone , Sharon
Morgan , Sherry Ryder , and Mildred Unger .
A quorum was present .
The Special Town Meeting Warrant with the return of the warrant was read by
Town Clerk , Joan K . Cole . There being no objection , the Moderator dispensed
with the reading of all the articles .
ARTICLE 1 . COMPENSATING BALANCE AGREEMENTS
ARTICLE 1 . Totosee if the Town will vote authorize the Town
Treasurer / Collector , with the approval of the Board of Selectmen , to enter
into compensating balance agreements , as permitted by Section 53F of Chapter
44 of the General Laws , or to take any other action relative thereto .

MOTION : I move that the Town vote to approve Article 1 as printed in the
warrant .
ACTION : ADOPTED UNANIMOUSLY
ARTICLE 2 . CHAPTER 90 ROAD MAINTENANCE FUNDING
ARTICLE 2 . To see if the Town will vote to accept a sum of money pursuant
to Chapter 15 of the Acts of 1988 , as amended by Chapter 33 of the Acts of
1991 , as provided under the Chapter 90 local road and highway money from the
1994 - 1995 Transportation Bond Bill , said funds and their earned interest
shall be expended to repair and resurface certain Town roads and their
appurtenances under the direction of the Board of Selectmen , or to take any
other action relative thereto .

MOTION : I move that the Town vote to approve Article 2 as printed in the
warrant .

ARTICLE 3 . LEE WAY BETTERMENT
ARTICLE 3 . To see if the Town will vote to transfer the sum of Four
Thousand and 00 / 100 ( $ 4 , 000 . 00 ) Dollars from the Water Betterment Receipts
Reserved for Appropriation Account and to add this sum to the initial amount
appropriated under Article no . 2 ( Lee ' s Way Betterment ) , which was voted at
the November , 1993 , Fall Yearly Town Meeting , in order to fund the total cost
of construction for the water betterment on Lee Way , and to add this amount
to the sum to be recovered through the assessment of betterments , or to take
any other action relative thereto .

MOTION : I move that the Town vote to approve Article 3 as printed in the
warrant and to transfer the sum of $ 4 , 000 . 00 from the Water Betterment
Receipts Reserved for Appropriation Account .
ACTION : ADOPTED UNANIMOUSLY
ARTICLE 4 . SIGN REPLACEMENT / TOWN LANDINGS
ARTICLE 4 . To see if the Town will vote to transfer from available funds _
the sum of Five Thousand and 00 / 100 ( $ 5 , 000 . 00 ) Dollars for the purpose of
replacing regulatory signs at Town Landings and properties with new
consolidated and coordinated signs of higher quality and durability to reduce
visual obstruction and improve the appearance of these areas , and to
authorize the Town Administrator to solicit bids , enter into contracts ,
dispose of surplus property and expend said funds for this purpose , or to
take any other action relative thereto .

MOTION : I move that the Town vote to approve Article 4 as printed in the
Warrant and to transfer the sum of $ 5 , 000 . 00 from Free Cash for this purpose .

ARTICLE 5 . SEIU COLLECTIVE BARGAINING
ARTICLE 5 . To see if the Town will vote to raise and appropriate and / or
transfer from available funds a sum of money to be used to meet the terms and
conditions of the proposed Collective Bargaining Agreement , effective July 1 ,
1994 , between the Town of Brewster and the Service Employee ' s International
Union , Local 254 , or to take any other action relative thereto .

MOTION : I move that the Town vote to indefinitely postpone consideration of
Articles 5 , 61 7 , and 8 .
ACTION : ADOPTED UNANIMOUSLY TO INDEFINITELY POSTPONE

transfer from available funds a sum of money to fund wage and salary
adjustments , for eligible employees covered by the Personnel Bylaw and other
non-union employees , effective July 1 , 1994 , or to take any other action
relative thereto .

ARTICLE 9 . To see if the Town will vote to raise and appropriate , and or
transfer from available funds the sum of Two Thousand and 00 / 100 ( $ 2 , 000 . 00 )
Dollars to pay for a portion of Brewster ' s expenses associated with our
participation in the Nauset Youth Hockey Program , held at the Charles Moore
Arena in Orleans , MA , and to authorize the Recreation Commission to enter
into a contract or contracts with Nauset Youth Hockey in order to provide
this services for residents of the Town of Brewster , or to take any other
action relative thereto .

ARTICLE 10 . LAND ACQUISITION
ARTICLE 10 . To see if the Town will vote to authorize the Board of
Selectmen to purchase for municipal purposes a parcel of land , identified as
Lot No . 10 on Map No . 26 of the Board of Assessor ' s Maps , to be used to
provide access from Underpass Road to the existing Elementary School
property , where the Town is planning to construct a new elementary school
building , and to raise and appropriate and / or transfer from available funds
the sum of One Hundred Fifty Five Thousand and 00 / 100 ( $ 155 , 000 . 00 ) Dollars
for this purpose , or to take any other action relative thereto .

MOTION : I move that the Town vote to indefinitely postpone consideration of
Article 10 .

ARTICLE 11 . NAUSET INTERMUNICIPAL AGREEMENT AMENDMENT
ARTICLE 11 . To see if the Town will vote to accept the proposal of the
Nauset Regional District Committee passed on May 18 , 1994 , to amend the
agreement establishing the Nauset Regional School District ;
a ) by providing that as of July 1 , 1995 , the Committee shall
consist of eighteen elected members : five from Orleans ,
seven from Brewster ; and , three from Eastham and three
from Wellfleet ;
b ) by providing that the district will assume jurisdiction
over all grades from kindergarten to grade twelve as of
July 1 , 1994 , and that all existing Elementary schools
within the district will be leased to the district
for nominal consideration by the member towns to become
district elementary schools ;

C ) by providing that capital costs and operating costs for
each elementary school shall be paid by the town in which
it is located ;
d ) by providing that capital costs and operating costs for
schools other than elementary schools shall be apportioned
on the basis of total enrollments in such other schools ;
e ) by making technical changes incidental to the foregoing
amendments .

MOTION : I move that the Town vote to approve Article 11 as printed in the
Warrant .

ARTICLE 12 . NAL'SET HIGH SCHOOL DESIGN FUNDING
ARTICLE 12 . To see if the Town will vote to approve the indebtedness to be
authorized by the School Committee of the Nauset Regional School District at
the Special Town Meeting in the amount of Five Hundred Eighty Two Thousand
Seven Hundred and Fifty 00 / 100 ( $ 582 , 750 . 00 ) Dollars , for the purpose of
preparing architectural and engineering plans for remodeling , reconstruction
and making extraordinary repairs to the High School and for construction ,
originally equipping and furnishing an addition thereto , and to further raise
and appropriate and / or transfer from available funds the sum of Nine Thousand
Six Hundred and Sixty 00 / 100 ( $ 9 , 660 . 00 ) Dollars to pay interest on the sums
of money borrowed by the Nauset Regional School District for this purpose , os
to take any other action relative thereto .

MOTION : I move that the Town vote to approve Article 12 as printed in the
Warrant and to transfer the sum of $ 9 , 660 . 00 from Free Cash for this purpose .

ARTICLE 13 . ELEMENTARY SCHOOL BUILDING COMMITTEE
ARTICLE 13 . To see if the Town will vote to amend the May , 1988 Annual
Town Meeting vote on Article No . 91 , which originally established the
Elementary School Building Committee , to change the reference to the
Committee ' s membership from the current language " a member of the Elementary
School Committee " to " a member of the Brewster School Committee or it ' s
designee " , or to take any other action relative thereto .

MOTION : I move that the Town vote to approve Article 13 as printed in the
warrant with the following amendment : delete " a member of the Brewster
School Committee or its designee " and substitute " a Brewster School Committee
member or designee .

ARTICLE 14 . ELEMENTARY SCHOOL BUILDING COMMITTEE
ARTICLE 14 . To see if the Town will vote to amend the May , 1988 Annual
Town Meeting vote on Article No . 91 , which originally established the
Elementary School Building Committee , to add two ( 2 ) additional members , to
be appointed by the Board of Selectmen , or to take any other action relative
thereto .

MOTION : I move that the Town vote to amend its vote under Article 91 of the
May 1988 Annual Town Meeting to add after the clause " three ( 3 ) voters of the
Town selected by the Moderator " the words " and two ( 2 ) additional members to
be appointed by the Board of Selectmen " .

ARTICLE 15 , STABILIZATION FUND
ARTICLE 15 . To see if the Town will vote to add a sum of money to the
Stabilization Fund and to raise and appropriate and / or transfer from
available funds a sum of money for this purpose , or to take any other action
relative thereto .

MOTION : I move that the Town vote to transfer the sum of $ 200 , 000 . 00 from
Free Cash to the Stabilization Fund .

meeting .
