RESOLUTION APPROVING THE PEABODY SUBDIVISION WHEREAS, Phyllis and Arthur Peabody have requested the subdivi- sion of approximately sixty-six (66) acres of land which is described on Exhibit A which is attached hereto and made a part hereof by ref- erence; and WHEREAS, the legal descriptions of the six (6) proposed lots are attached hereto and made a part hereof by reference as Exhibits A-1 through A-6 inclusive; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that the proposed subdivision is hereby approved subject to the following conditions: 1. All lots which front on a cul de sac shall have no less than 110 feet of frontage on the cul de sac; 2. That the applicants convey an easement to the City of Medina for street and utilities purposes over the westerly 30 feet of the property which abuts Tamarac Drive; 3. That the applicant enter into a private roadway agreement in the standard form used by the City, together with any neces- sary modifications, to provide access to proposed Lots 1, 2, 5 and 6; 4. That the applicants and other affected property owners enter into a private roadway agreement in the standard form used by the City, together with the necessary modifications, to pro- vide access to Lots 3 and 4, and adjacent properties as re- quired; 5. That the applicants provide to the City Attorney an abstract continued to the present date, together with any agreements, easements or other documentation relating to the private road which abuts the subject property on the south; 6. That the barn located on Lot No. cp shall not be treated as a nonconforming use as defined in the Medina Zoning Code.
