HomeMy Public PortalAbout2002.108 (08-07-02)\ RESOLUTION NO. 2002. i os ~' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING THf LYNWOOD GENERAL PLAN LAND USE DESIGNATION MAP, PURSUANT TO GENERAL PLAN AMENDMENT NO. 2002-03, FROM MULTI-FAMILY RESIDENTIAL TO COMMERCIAL FOR PROPERTY LOCATED AT 11007 LINDEN STREET FOR A WINCHELL'S DONUT HOUSE, THE SUB7ECT PROPERTY IS FURTHER DESCRIBED AS ACCESSOR PARCEL NUMBER 6193-005- 009, TRACT 9337, LOTS 1 AND 2, CITY OF LYNWOOD, CALIFORNIA. WHEREAS, the Planning Commission of the City of Lynwood, on July 9, 2002, pursuant to law, held a public hearing and approved General Plan Amendment No. 2002-03; and WHEREAS, the Lynwood City Council, on August 6, 2002, pursuant to law, held a public hearing on General Plan Amendment No. 2002-03; and , WHEREAS, the Lynwood City Council has carefully considered all pertinent testimony offered at the public hearing; and WHEREAS, the Lynwood City Council has determined that a Commercial business would be the best land use of the subject property and would be consistent with the goals and policies of the General Plan; and , WHEREAS, the Lynwood City Council has determined that the project would not be detrimental and would not negatively impact the public health, safety or general welfare; and WHEREAS, the Community Development Department has determined that the proposal is categorically exempt from the California Environmental Qualify Act (CEQA), as amended; and Section 1. The City Council of the City of Lynwood hereby finds and determines as follows: A. A commercial land use designation of this property would be compatible with surrounding land uses and developments in the vicinity. B. The project could satisfy all required development standards and code requirements based on the project layout. C. The General Plan Amendment would be consistent with~ the goals and policies of the Lynwood General Plan. ~ D. The General Plan Amendment will not be detrimental to the properties surrounding the site and would not negatively impact the public health, safety, or general welfare. The City Council of the City of Lynwood based upon the aforementioned findings and determinations, hereby approves General Plan Amendment No. 2002-03 changing the General Plan land use map designation for this property from Multi-Family Residential to Commercial for the development of a Winchell's Donut House subject to the following conditions of approval. CONDITIONS OF APPROVAL COMMUNITY DEVELOPMENT 1. The applicant or his/her representative shall sign a Statement of Acceptance stating that he/she has read, understands and agrees to all conditions of this resolution prior to submitting for building plan check. 2. The development shall comply with all applicable regulations of the Lynwood Municipal Code, California Building Code, Los Angeles County Fire Code, and Los Angeles County Health and Safety Code. 3. The project shall be developed in compliance with the approved plans on file in the Planning Division, Community Development Department. 4. Any proposed subsequent modification of the subject site or structures thereon shall be first reported to the Community Development Department, Planning Division for review. 5. Approval to construct the Winchell's Donut House shall become null and void one hundred eighty (180) days after the use has been abandoned or ceases to be actively exercised, unless extended. Building plan check must be submitted within 180 days. An extension of ninety (90) days may be approved, provided such request is submitted in writing to the Planning Division prior to the expiration date. PLANNING DIVISION 6. The applicant shall submit a project sample board consisting of building and roofing samples to include types of materials and colors. 7. A minimum of seven percent (7%) of the gross lot area shall be landscaped. The applicant shall submit complete and detailed landscaping and permanent irrigation plans for review and approval by the Planning Division. 8. The project shall provide a minimum of eighteen parking stalls. (one (1) parking stall for each one hundred (100) square feet of gross building area) One (1) parking stall shall be handicap. All vehicle parking stalls and access ways shall be permanently paved and maintained. All parking stalls shall be delineated and r~ have bumper guards. i 9. No outside storage of materials or supplies is permitted once a certificate of occupancy is issued. 10. A trash storage area shall be provided and consist of three solid block walls, a minimum of five feet (5~ in height with a solid sight-obscuring door. 11. Prior to installing signs, plans and a sign permit shall be applied for and approved by the Planning Division, Community Development Department. -2- 12. The property owner shall maintain a. pro-active approach to the elimination of , graffiti on a daily basis. BUILDING AND SAFETY 13. All construction shall meet or exceed the minimum building standards that are referenced in the following codes; ~ ~ The Uniform Building Code:- 1998 Edition; ' The Uniform Plumbing Code - 1998 Edition; ~ The Uniform Mechanicaf Code - 1998 Edition; The National Electric Code -1996 Edition; The Los Angeles County Fire Code-1999 edition . All as amended by fhe California Building Code of 1998. In case where the provision of the California Building Code, the City of Lynwood Municipal Code, or the plan or specification in these plans may conflict, the more restrictive provisions shall govern. ` , ~ PUBLIC WORKS/ENGINEERING ~_ 14. Submission and recordation of a parcel map is required. Building perm'its will not " . be issued prior to the recordation of a subdivision map. 15. Submit a grading plan prepared and signed .by a~ registered Civit Engineer. Grading plan will be checked by Public Works Department. No building permits will-be issued prior to the appr.oval of grading plan by City Engineer. - 16. Reconstruct damaged and substandard sidewalk, curb and gutter along Imperial .~ Highway and Linden Avenue. 17.~ Close existing drive approaches and construct proposed drive approaches per APWA standards on Imperial Highway and Linden Avenue. 18. Construct two (2) wheelchair ramps at the alley south of the property. 19. Connect to public sewer. Each building shalf be connected separately. Construct laterals as necessary. When connecting to an existing lateral, contractor shall verify the size of such lateral and provide proof of its integrity. Minimum size r.equired is six inches (6'~. 20. Install five (5) 24" box street trees per City of Lynwood standards along Imperial 4 Highway and Linden Avenue. ~ ~ . ~ ~ ~ ~ ~ ' 21. Construct tree ~ well covers per City of Lynwood standards for existing and , proposed street trees. ~ 22. Regrade parkway and landscape with grass. ` 23. Provide and install one (1) marbelite street pole with light fixture, underground services and conduits on Linden Avenue at alley entrance. ' 24. Underground all utilities. All required water meters, meter service changes and/or fire protection fines shall be installed by the developer. The work shall be performed' by a licensed contractor hired by the developer. The contractor must obtain a permit from the Public Works/Engineering Division prior to performing any work. 27. Resubmit site plan with scaled parking lot layout. This development may be subject to the City`s Standard Urban Stormwater Mitigation Plan' Ordinance. Determination shall be made upon submittal of revised site plan. LOS ANGELES COUNTY FIRE DEPARTMENT 28. The applicant shall comply with all code requirements and conditions set forth by the Los Angeles County Fire Department, Fire Prevention ~Division, 5823 Rickenbacker Road, Commerce, CA .90040, (323) 890-4243.
