P/ 7 RESOLUTION GRANTING A VARIANCE TO REX GREGOR TO PERMIT A SIDE YARD SETBACK VARIANCE AT 2592 HOLY NAME DRIVE WHEREAS, Rex Gregor ("applicant') has applied for a variance to the provisions of Section of the Medina Zoning Ordinance to permit a side yard setback. WHEREAS, a variance to Section of the Medina Zoning Ordinance may be issued to the applicant because the ordinance im- poses the following undue hardship to the applicant in the use of the land: 1. The lot is long and narrow. WHEREAS, the granting of the variance requested will not con- fer on the applicant any special privilege that is denied to owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or neighboring property, and the var- iances requested is the minimum variance which will alleviate the hardship. WHEREAS, the applicant appeared at public hearings before the Medina Planning Commission on and before the Medina City Council on NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that a variance to the provisions of Section of the Medina Zoning Ordinance is hereby granted subject to the following terms and conditions: 1. The said construction of a garage shall be no less than thirteen (13) feet from the side yard property line and shall be in accordance with the plan sub- mitted to the City of Medina. 2. The variance shall expire if the action requested by the variance has not been completed or instal- led within one year after the date of this Resolution. 3. The applicant shall comply with all provisions of the Medina Zoning Ordinance. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the violation of any of the foregoing conditions is declared to be a violation of the Medina Zoning Ordinance in accordance with Section 801.1 of the Zoning Ordinance.
