A WARDING CONTRACT FOR THE 2007-2009 AN:r-.'UAL SEWER EMERGENCY
SERVICE CONTRACT
WHEREAS, the Borough of Cafteret ("Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the 2007-2009
Anllual Se\ver Emergency Service Contract; and
'VHEREAS,B & ,V Construction submitted the lowest bid for said work as evidence by the
response on file with the Borough's Purchasing Department; and
WHEREAS, the Borough Engineer has reviewed the above referenced bid proposal and has
recommended an award of a contract for said work to B & W Construction; and
'VHEREAS, the Borough's Chief Financial Officer has certified that funds are or will be
available for the award of a contract for said work.
NO'" THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. 111at the Borough hereby awards the bid for- the 2007-2008 Annual Sewer
Emergency Service Contract to B & \V Construction in the amount not to exceed
$286,662.00 for the first year.
2. That the Borough hereby reserves the right to extend said contract for the 2008-
2009 period in an amount not to exceed $298,687.00
3. That the appropriate Borough Officials are here!?y authorized and directed to
enter into a contract with B & "\V Construction in accordance in all respects with
the request for proposals and bid on the same.
4. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department, the Borough's Director of Engineering and B & \V Construction.
Adopted this 23m day of August, 2007
and certified as a true copy of the
original on August 24, 2007.

THE CONTRACTOR does hereby agree to perform the following:
AWARD OF BID FOR 2007-2009 SEWER EMERGENCY SERVICE
NOT TO EXCEED $75,636.51 FOR 2007
$298,687.00 FOR 2008&2009
According to the terms set forth in the Resolution & Bid.
THE BOROUGH does hereby agree to pay the Contractor the sum set forth in
Resolution.
