RESOLUTION NO.
RESOLUTION FOR A VARIANCE IN THE NAME OF REX GREGOR
TO PERMIT CONSTRUCTION OF AN ACCESSORY BUILDING
ON VACANT PROPERTY ADJACENT TO 2592 HOLY NAME DRIVE
WHEREAS, Rex Gregor ("applicant") has applied for a variance
to the provisions of Section of the Medina Zoning Ordi-
nance to construction an accessory building on property which does
not have a primary structure;
WHEREAS, a variance to Section of the Medina Zon-
ing Ordinance may be issued to the applicant because the ordinance
imposes the following undue hardship to the applicant in the use
of the land:
1. The primary use of the property is agriculture which
cannot be carried on without a storage building.
WHEREAS, the granting of the variance requested will not con-
fer on the applicant any special privilege that is denied to owners
of other lands, the variance will not be materially detrimental to
the purposes of the ordinance or neighboring property, and the var-
iances requested is the minimum variance which will alleviate the
hardship.
WHEREAS, the applicant appeared at public hearings before the
Medina Planning Commission on and before the
Medina City Council on
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MEDINA, MINNESOTA, that a variance to the provisions of Section
of the Medina Zoning Ordinance is hereby granted sub-
ject to the following terms and conditions:
1. The said construction of the accessory building shall
be in accordance with the plan submitted to the City
of Medina on property legally described on Exhibit A
which is attached hereto and made a part hereof by
reference.
2. The variance shall expire if the action requested by
the variance has not been completed or installed with-
in one year after the date of this Resolution.
3. The applicant shall comply with all provisions of the
Medina Zoning Ordinance.
4. That the applicant submit a restrictive covenant,
signed by all owners of the property, prohibiting
the use of the accessory building for the housing
of animals.
5. That the subject property be treated, under the
Medina Zoning Code and Subdivision Regulations,
as being combined with the applicant's adjacent
property which is legally described on Exhibit B
which is attached hereto and made a part hereof
by reference.
6. That the applicant pay an additional $106.60 for
additional administrative costs in connection with
the application.
BE IT FURTHER RESOLVED by the City Council of the City of Medina
that the violation of any of the foregoing conditions is declared to
be a violation of the Medina Zoning Ordinance in accordance with the
Zoning Ordinance.
