CITY COUNCIL
MINUTES
APRIL 18, 1978
Mayor Merritt called the regular meeting of the City Council to
order at 7:34 p.ni. on Tuesday, April 18, 1978, in the Council
Chamber of the City Hall.
2. INVOCATION
The invocation was given by Mayor Merritt.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. ROLL CALL:
Present: Councilmen- Atkins, Dennis, Greenberg, Tyrell, Merritt
Absent.: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager •Pucci, Planning Director Dragicevich,
Parks and Recreation Director Kobett, and Marie Evitt,

5. APPROVAL OF MINUTES:
Councilman Dennis moved to approve the minutes of the regular City
Council meeting held Tuesday, April 4, 1978, as written, seconded by
Councilman Tyrell and carried.
CANVASS OF MUNICIPAL ELECTION:
City Clerk Koski. presented Certificate of Canvass of the Municipal
Election held April 11, 1978 (Exhibit . "A ") which. showed incumbents
Tom D. Atkins and Louis W.. Merritt, and Kenneth G. Gillanders elected
for a seat on the Council. He read the title to Resolution No,
78- 1.722, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD
IN SAID CITY OF TEMPLE CITY ON THE .11TH'DAY OF APRIL, 1978, DECLARING
THE RESULT THEREOF AND SUCH OTHER.MATTERS AS ARE PROVIDED BY LAW,
Councilman Tyrell moved to adopt Resolution No. 78 -1722, seconded
by Councilman Atkins and carried.
Mayor Merritt presented a plaque on behalf of the City Council
to Everett H. Greenberg in recognition and appreciation of his
outstanding leadership and dedicated service to the community.
Mr. Greenberg expressed his appreciation to Council and acknowledged
the many cards, letters.and phone calls, and personal visits he has
received', stating he places a great.i.mportance on personal relation-
ships. He addressed himself briefly to what it means to be a member
of the City Council, stating it is a awesome responsibility because
the decisions made by Council affect people's lives, the way they use
their property and the manner in. which they conduct their business;
their decisions affect all 30,000 residents, all dwelling units;
70 miles of streets, 10,000 parkway trees,. Mr, Greenberg said that
during his tenure, this Council, and he included former Councilman
Gilbertson, served the public interest and accomplished the completion
of the Rosemead Boulevard development, acquired additional land for
the expansion of Live Oak. Park de.velopme.nt, program, completed 20 years
of sidewalks in one year, Lower Azusa Road reconstruction project:, and
most important, preserved and improved the quality of the community,
He stated this City Council has been the envy of many cities in the

San. Gabriel Valley for their ability to work harmoniously. Mr.. Greenberg
paid tribute to his assistant, Rusty Gorre1l, who handled h.i.s printing
business so capably when it was necessary for him to be away on City.
business; to the City Manager, who has brought to the position those
qualities whi.ch.. make. him the finest City Manager around.; and to
his wife, Connie, who supported h.im wholeheartedly. Mr, Greenberg
expressed his pride in the record of achievement made by the City.
Council, Commissioners, staff members, and the Chamber of Commerce
working together,
Counc.i.lman. Atkins stated he found Councilman Greenberg ' s .comments
touching and sincere, and he may have lost a vote or two,..but he
retains the love and respect of the Council, staff and community. He
stated that during his short time on the. City Council he has learned a
great deal from Councilman Greenberg; that many times they have differed
philosophically, but have moved onto the next agenda item .with mutual
respect and friendship. Councilman Atkins thanked his friends and other
people in the community for his election,. to Council for .a full term,
saying he was overwhelmed with the results; that he was appointed to the
Planning Commission some nine years ago and when former.Councilman
Gilbertson resigned he was appointed to Cityy. Council to fill that vacancy,
which. he .felt was the right thing for the wrong reason; and he would like
to think his election for a full term. is the right thing for the right
reason_

Mayor Merritt stated he has enjoyed working with Councilman Greenberg,
first as a .Parks. and Recreation Commissioner and then .as a Councilman.
He fee.ls the. winning or losing an election is .secondary to the fact
that the voter turnout is so light, and hopes that someday we don't wake
up and find our rights have been voted away because we failed. to vote.
Councilman Dennis. stated that during the past eight years he has
had the opportunity of knowing and working with. two of the finest people
in, the community; namely, Ev and Connie Greenberg, and hoped their
friendship and mutual care will continue.:
Councilman. Tyrell .introduced Connie Greenberg to those in the audience
and stated it has been a pleasure to know and work with Connie and
Ev Greenberg, and thanked them for their participation in community
affairs on behalf of the City
City Manager Koski expressed the staff appreciation for the fine
cooperation Councilman Greenberg has given, stating staff would miss
h.im and hope he will remain active in community affairs.
SEATING OF CITY COUNCIL
City .Clerk Koski. presented Certificates of Election to Tom Da Atkins,
Kenneth G. Gillanders and Louis W. Merritt and. administered the Oath
of Office to the newly. elected Councilmen_
Councilman .Gillanders thanked. his wife and family who have been most
patient, his friends who supported him and the people of the • Ci..ty.
who .voted for him,.and also those who voted against him. He stated
it sorrows him to .replace Councilman Greenberg, but the next four
years will be a challenge he looks forward to.
REORGANIZATION;
At this time,. the City Clerk assumed the Cha,i.r and opened nominations
for the office of Mayor for the coming year,
Councilman Atkins nominated Councilman Tyrell for the office of Mayor,
seconded by Councilman Merritt, Councilman Merritt moved that nominations
be closed and a unanimous ballot be cast. for Councilman Tyrell for the
offi.ce. of Mayor, seconded by Councilman Atkins, and unanimously carried
Mayor Tyrell accepted the gavel, and as
for nominations for the office of Mayor
Councilman Merritt nominated Councilman
Pro Tem, seconded by Councilman Atkins,
a first duty in, office, called
Pro Tem.
Dennis for the office of Mayor
Councilman Atkins moved that

nominations be closed and that a unanimous ballot be cast for
Councilman Dennis, seconded by Councilman Gillanders and unanimously.
carried.
Councilman Merritt stated he has enjoyed the past year as Mayor
and looks forward to the next four years.
Mayor Tyrell stated he .is looking forward to the coming year when
he will act as Mayor on behalf of the City and anticipates the
Council will continue their good intentions in the coming year.
APPOINTMENTS:
Mayor Tyrell made the fallowing committee appointments, following
which it was moved by Councilman Dennis, seconded by Councilman
Merritt and unanimously carried that the appointments be confirmed:

Councilman Merritt moved to adopt Resolution No. 78 -1723 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINTING
A MEMBER OF SAID COUNCIL OF SAID CITY TO THE RTD CITY. SELECTION COM-
MITTEE PURSUANT TO PART 3 OF DIVISION 10 OF THE PUBLIC UTILITIES CODE,
seconded by Councilman Atkins and carried.
Councilman. Merritt moved to adopt Resolution No. 7.8 -1724 A. RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING AN ALTERNATE
DIRECTOR OF COUNTY SANITATION DISTRICT NO. 15, seconded by Councilman
Atkins and carried,
Councilman Atkins moved to adopt Resolution No. 78-1725 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING A RULE OF
PARLIAMENTARY PROCEDURE, seconded by Councilman Gillanders and carried.
Councilman Dennis moved to adopt Resolution No. 781726 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING A "CONSENT
CALENDAR" AGENDA, seconded by Councilman Merritt and carried.

UNFINISHED .BUSINESS:
6., ORDINANCE NO. 78-463: AUTHORIZING. BINGO WITHIN CITY BOUNDARIES
City Attorney Martin presented. Ordinance No 78-463 AN ORDINANCE
OF THE CITY OF TEMPLE CITY AUTHORIZING CERTAIN BINGO GAMES WITHIN
THE CITY BOUNDARIES-for second reading by title only.
Council requested correction of several typographical errors; namely,
Section .4.161 (a) the word of to "or ", Section 41E1 (b) spelling of
the word "shall ";. and requested Section 4161 (p) be amended to read
that no location shall be used to, nor shall any applicant, conduct a
bingo game more often than once per weer.
Larry Cude, 9923 E.. Live Oak Avenue, . stated . that under the equal rights
law he feels the rights of citizens are being violated and challenged
the constitutionality of the ordinance, in that only a non - profit or
charitable .organization _ may conduct a bingo game
City Attorney Martin stated that under the penal code ..only .non-profit
and charitable organizations qualify under the constitutional amend-
ment voted by the people of the State of California, and the courts
have. upheld the classification as valid..
Councilman Atkins moved to waive further reading and adopt, seconded
by Councilman .Dennis- and carried. ..
7. PROPOSED AMENDMENT TO TEMPLE CITY ZONING CODE RELATING TO NUMBER
OF DOMESTIC ANIMALS IN .R -ZONES
City Manager Koski. presented background information,. ,stating the
Planning Conimissio.n,. at .their. regular meeting held __January .10, 1978,
adopted a ..resolution recommending the limitation of household pets
on an R- .l.dwelling.containing two or more dwelling units. City
Council.,_, at their regular meeting held January 17, 1978, requesting
staff to conduct a- survey of surrounding cities to determine the
number of household pets permitted in residential zones; the report
has been . complete. d and brought to .Council for consideration.
Councilman Atkins moved .to refer the item to a joint study session
with the Planning. .Commision,. .seconded by Mayor.Tyrell.and carried.
8. APPROVAL OF AGREEMENT: CITY AND COUNTY OF LOS ANGELES - ..TEMPLE CITY
BOULEVARD. AND...CAMINO REAL'-.-TRAFFIC SIGNAL PROJECT
City Manager .Koski .presented a formal agreement received from the
County for the joint participation in the installation of the
traffic ,signal .at . tthe intersection of Temple City Boulevard and
Camino.Real for .Council .approval. The County has adopted a resolution
declaring .a portion of Temple City Boulevard to be a part of the
County System of Highways and have requested Council to adopt a
resolution consenting to. the County's jurisdiction.
Councilman Dennis moved to approve Agreement with the County of Los
Angeles and authorize the Mayor and City Clerk to s,ign, and adopt
Resolution. No. 78-1727 A RESOLUTION O.F THE CITY COUNCIL. OF THE CITY
OF TEMPLE .CITY,.` CALIFORNIA,. CONSENTING TO ESTABLISHMENT OF A PORTION
OF TEMPLE. . CITY BOULEVARD WITHIN SAID CITY AS A PART OF THE SYSTEM
OF HIGHWAYS OF THE COUNTY OF LOS ANGELES, seconded by Councilman
Atkins and carried.
NEW .BUSINESS.:
9. RECOMMENDATIONS .FROM .TRAFFIC COMMISSION. - Meeting of April 5, 1978
A. "ALL ,RED" INTERVAL: TRAFFIC SIGNALS SELECTED INTERSECTIONS-
PILOT STUDY.
_City Manager. Koski ..presented- .background information, stating an
".all r.ed "' interval .has been Instituted at the signal at. Temple City
.Boulevard-,.and Las Tunas. Drive pursuant to a request from the Sheriff's
Department in order to clear the intersection to eliminate conflict

between vehicles entering the 3- second amber light phase 'and .cross-
traffi.c jumping the green, .light:. To improve traffic conditions,
Traffic. Engineer Envall has proposed a pilot study be made at selected
intersections .with ..a follow-up report to be made at. the _end of
six months to..ascertain the results, The Traffi.c. Commission has
recommended the study at five intersections; namely, 1) Temple City
Boulevard and Longden; 2) Temple City Boulevard and Lemon 3) Temple
City Boulevard and Olive; 4) Baldwin Avenue and Live Oak Avenue; and
5) Baldwin Avenue and Olive Street„
Councilman Atkins stated he would like to add the intersection of
Ternple City Boulevard and Broadway; City Manager Koski requested
the intersection of Oak Avenue and Longden Avenue be added to the
interseations .included .in the pilot study,

Council Atkins moved .to approve the pilot study at the five intersections
recommended by the Traffic Commission at an estimated .cost .of $1,665
and in addition,.. the intersections of Temple City Boulevard and Broadway,
and Oak Avenue and Longden Avenue, to appropriate additional funds
and amend the adopted budget, seconded by Councilman Merritt and carried,
B. EAST AND WEST SIDE, CLOVERLY AVENUE - FROM LOWER AZUSA SOUTHERLY
2 -HOUR TIME LIMIT PARKING
City Manager Koski presented background information, stating the
Traffic Commission, at their regular meeting held April 5, 1978,
received request from property owners and residents regarding the
problem of cars parked Continually on both sides of Cloverly, ex-
pressing concern for the safety of children who walk daily to the bus
stop on Lower Azusa Road, Traffic Commission recommended the
installation .of two hour time limit signs provided the City receive a
petition with at least 60% signatures of the property owners. A
petition has been received with 100% represented, The signs to be
installed will read "2 hours, 7 a.m. to 6 p.m., Sundays. Excepted ".
Councilman Merritt moved to approve installation of two hours.
time limit signs from Lower Azusa Road to 4502 Cloverly, and to
appropriate additional funds in the amount of $111 and amend the adopte
budget accordingly, seconded by Councilman Atki.ns and carried.
10, RESOLUTION NO.. 78 -1728 WARRANTS & DEMANDS, DEMAND NOS. 9061 THRU
9249 IN THE AMOUNT OF $81,254.,64
Councilman Atkins moved to adopt Resolution No. 78 -1728 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND
DEMANDS IN THE. SUM OF $81,254.64, DEMAND NOS. 9061 THRU 9249, seconded
by Councilman Gillanders and carried.
11. COMMUNICATIONS
A. Community Disposal Company re CPI rate increase pursuant to
Agreement for Rubbish Collection
City Manager Koski presented communication from Community Disposal
Company requesting a rate increase from $3.70 to $4.10 per month
for single family residences, and from $3:70 for the first unit and
$1.85 for each additional unit to $4.10 for the first unit and $2.05
for each additional unit for multiple units effective July 1., 1978
based upon the rise in the Consumer Price Index pursuant to agreement
with the City.
Councilman Merritt moved to approve rate increase and authorize the
Mayor and. City Clerk to sign, seconded. by Councilman Gillanders and
carried,
B. Community Disposal Company rez CPT. rate increase pursuant to
Street Sweeping Agreement.
City Manager Koski presented communication from Community Disposal
Company requesting a rate increase from $4.64 to $4.92 per mile of
sweeping based upon the rise in the Consume/ ° Price Index pursuant to
Street Sweeping Contracts

Councilman Dennis. moved to approve rate •increase for street
sweeping and authorize the Mayor and City Clerk: to sign, seconded
by Councilman Atkins and carried.
12, TIME FOR THOSE IN THE AUDIENCE -WHO WISH: TO SPEAK:
Lary Cude,. 9923. ;Live Oak ' Avenue, stated', he: feels: the City should
conduct their :. municipal :. election. at the same tinie: as the General
election; and contract'. with the. County, :to :save :° money, which would
also serve to bring about a larger voter turn-out.
Council referred the matter to a future study session and requested
staff to prepare a report regarding changes that would be required
in the Charter and costs.
RECESS TO CRA:
City Council recessed at 8:32 p.m. to meet as the Community Redevelopment
Agency, all members being present; reorganized pursuant to the By -laws
of the Agency; and approved the minutes of the regular meeting held
April 4, 1978. Minutes are set forth in full in the minutes of the Agency.
RECONVENE' AS CITY COUNCIL:
13. ACTION ON REQUEST BY CRA:
There was no .action to be taken.
14. MATTERS FROM .CITY OFFICIALS:
A. WEST SAN GABRIEL VALLEY JUVENILE DIVERSION PROJECT
Mayor Tyrell directed Counci1s .attention to the material received
from West San Gabriel Valley Juvenile Diversion. Project requesting
fifth year funding. Council concurred to refer the matter to a
Study Session.
B. SERVICE ECONOMIES/RAPID TRANSIT DISTRICT - FY 1978 -79
On motion by Councilman. Merritt, seconded by Councilman Gillanders,
Council received and filed a communication from Rapid Transit District
regarding service economies to become effective June 25, 1978,
reducing the intervals on lines #428, 433, and 435
C. ,CAMINO REAL ET AL - STREET IMPROVEMENT PROJECT
APPROVE PLANS AND .SPECIFICATIONS -.
City Manager Koski presented plans and specifications for subject
project which includes Camino Real, Brentmead to Temple. City Boulevard,
Alessandro Avenue, Live Oak to Broadway; and Halifax Road, Key West
to Freer and reported on the calendar of events for awarding bids
to completion of the .:project.
Councilman Dennis moved to 'approve the plans and specifications and
authorize the advertising and receiving of bids, seconded by
Councilman Atkins and carried.
D. On motion by Councilman Merritt seconded by Councilman Dennis,
Council approved Councilman Gillanders attendance to the New-Mayors
and Councilmen's Institute being conducted by the League of California
Cities, his calendar permitting.
E. Mayor Tyrell directed Council's attention to a letter received
from Evergreen Convalescent Home advising that one of their residents,
Mrs. . Nell Dibble, will be one hundred years old April 21, 1978.
Council concurred with the Mayor signing a pr'oclamation declaring
April 21, 1978, Nell Dibble Day in Temple City,
F. 'Proposed Community. Forum
Mayor Tyrell advised a Community Forum 'will be h.eld. Saturday,

May 20, 1978, from 8 .a o m e. , .to 1 ..p.m, at the Rand Media Center, which .
will be open to - residents on .a .reservation basis. . This is to be the
first of other forums throughout the year and will feature the Jarvis
initiative
15, ADJOURNMENT._
On motion by Councilman .Atkins , seconded by ..Councilman Merritt,
meeting .adjourned at 8:43 p.m, Next .regular .meeting of the City
Council will be' held ,.Tuesday, : May 2, 1978, 730 p.m, in the Council
Chamber of the City Hall,
