AMENDING RESOLUTION NO. 07-132, RE: 35 COOKE AVENUE
WHEREAS, as part ofBorongh of Carteret' s ("Borough") ongoing revitalization efforts,
the Borough has obtained title to certain reatproperty commonly known as 35. Cooke
AveilUe and further as Block 202, Lots 9,10 and 11 on the Tax Map oftheBorough; and
. WHEREAS, the Borongh has hereby determined that said parcel ofreaI property is not
needed for public use and is consequently desirous of providing for the public sale ofthe
same in accordance w,ith the provisions of the Local Lands and Buildings Law tN.J.S.A.
40A:12-1 ~~.); and
WHEREAS, the Borongh 'further desIres for the Carteret Redevelopment Agency (the
"Agency") to administer the planned public sale of said real property including the
advertisement and conduct bf said sale, and the award of said sale consistent with the
provisions of the Local Land and Buildings Law and this resolution.
WHEREAS, pursnant to the aforesaid efforts, the Borongh previonsly adopted
Resolution No. 07-132 authorizing the sale of said real property know as 35 Cooke
Avenue; and
\VHEREAS, the Borough now desires to re-authorized said sale subject to the same
conditions except that it wishes to set a revised minimum price for the sale ofthe same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
Carteret as follows:
1. That (he pnblic sale of the real property commonly known as 35 Cooke
Avenue (B 202; L 9, 10 and 11), which has been determined not to be needed
for public use, is hereby authorized and directed, all in accordance with the
provisions ofthe Local Lands and Bnildings Law.
2. That the minimum price for said sale shall be set at One Million Two
Hnndred and Fifty Thousand Dollars ($1,250,000.00), and the Borough
fnrther reserves the right to reject all bids received should the highest bid not
be accepted.
3. That the Agency is hereby authorized to administer the public sale as
authorized herein, with such conditions as shall be approved by the Mayor
and counsel to the Borough.

4. Agency is hereby authorized and directed to retain in trust the proceeds
derived therefrom for authorized lJse in the advancement of the Borough's
approved redevelopment programs.
5. That appropriate Borongh Officials and its professional consultants are hereby
authorized and directed to take all necessary and proper action(s), including,
but not limited to, the execution of any documents and other writings and
things, all in furtherance of implementing the provisions of this authorizing
Resolution and effectuating the sale of the above- referenced real property.
